RESOLUTION NO. 719.
A RESOLUTION CALLING FOR BIDE TO COMPLETE TEE
CONSTRUCTION AND ERECTION OF THE MIAMI PIRA
DEPARTMENT BUILDING #4, LOCATED AT 3. W. 10th
STREET AND SOUTH MIAMI AVENUE (#4 ?IRE ENGINE
STATION).
WHEREAS, on the 27th of June, 1922, the City of Miami entered
into oontraot with Peter E. Bartnett, of Miami, Florida, whereby
said contractor agreed to provide all materials and perform all
work shown on drawings and plans and described in specifications
for construction and ereation of the Miami Fire Department Building
#4 to be located at S. W. loth Street and South Miami Avenue' (#4
Fire Engine Station) , said drawings and specifications having been
prepared by H. Hastings Mundy:, Registered Architect, of 246 N. E.
First Street, Miami, Florida, and
WHE EA:), said contractor executed his bond in the sum of 019,
797 with the Maryland Casualty Company as surety, and
tiYBAH.N:AS, the contractor has persistently and repeatedly re-
fused and failed to furnish enough proper skilled workmen and pro-
per materials to complete said work as provided for in the contract,
and failed to make proper payments to sub -contractor and failed to
make proper payments for materials used in the building and cer-
tificate thereof has been given by said Architect under date of
January 26, 1923, and notice to the said Peter E. Bartnett was given
by the City Manager under date of January 26, 1923, and copies of
said certificate and said notice were gent by registered mail to the
Maryland Casualty Company, Baltimore, Maryland, and similar notice
was sent to John W. Humphreys, Agent for Marylund Casualty Company,
at Miami, Florida, and
aiLRLAS, said Casualty Company through E. 3. u'urtz, Attorney,
has notified the City that the said Surety Company waives its option
to complete construction of the building and requests tint the said
City complete the contract; now, therefore,
