HomeMy WebLinkAboutR-00705A RESOLUTION NO. +a A RESOLUTION REQUESTING THE PASSAGE OF A LOCAL OR SPECIAL LEGISLATION AMENDING THE CITY CHARTER 0P THE CITY OF MIAMI AS SET FORTH IN THIS RESOLUTION. WHEREAS, the Commission of the City of Miami deems it advisable and to the beet interests of the City and its inhabitants that Section 3 (3) of the City Charter of the City of Miami, adopted in 1921, should be amended by adding after the words "persons, firms or industries", the words "municipal corporations" so that no question might arise in the future as to the power of the City to supply its surplus water to municipalities as well as to persons, firms or industries, and WHEREAS, the Commission of the City of Miami deems it to the best interests of the City of Miami and its inhabitants that the power should be given it in its acquisition of future parks, to confer the right and power to give outdoor exhibitions, concerto, games and contests in such parks with the power and authority to charge and collect a reasonable admission fee for each person entering such park or play ground during the times when the same shall be used and employed for such purpose. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, That the representative of Dade County be and he is hereby requested that in addition to the other amendments requested by the City, that he present and urge the passage of the following amendments to the City Charter: "DOCUMENT INDEX ITEM NO. / 5 " "SUPPORTIVE DOCUMENTS FOLIO CITY COMMISSION MEETING OF APR©3-/9J.3 EsuniON Ns O O 70 • "SUPPORTIVE E DOCUMENTS FOLLOW" "To use parks and playgrounds which may hereafter bid aoquired by the. Oity. of Miami,- in which to give .cent -door:,; exhibitions, games and contests, with power and authority:„..: to charge and oolleot a reasonable admission fee for each person entering such park or playground during the time when the same shall be used or employed for such purposes." "SIOTION 3 (j) To acquire in any lawful manner in any: county of the State , or without the State, such water, lands, and lands under water as the City may deem necessary for, the purpose of providing an adequate water supply for said city and of piping or conducting the same; to lay all necessary mains; to erect and maintain all necessary dams, pumping stations and other works in connection therewith; to make reasonable rules and regulations for promoting the purity of its said water supply and for protecting the same from pollution; and for this purpose to exercise full police powers and sanitary patrol over all lands comprised within the limits of the water -shed tributary to any such water sup- ply wherever such lands may be located in this State; to im- pose and enforce adequate penalties for the violation of any such rules and regulations; and to prevent by injunction any pollution or threatened pollution of such water supply and any and all actr to impair the purity thereof; and for the purpose of acquiring lands or material for any such use to ex- ercise within the State all powers of eminent domain. For any of the purposes aforesaid said Oity may acquire by condemnation, purchase of otherwise, any estate or interest in such lands or any of them, or any right or easement therein, or may acquire such lands or any of them in fee, reserving to the owner or owners thereof such rights or easements therein as may be pre- scribed in the ordinance providing for such condemnation or pure chase. The said city may sell or supply to persons, firms or industries or municipal corporations residing or located out- side of the city limits any surplus of water it may have over : m 1 •
