On the 23rd day of October, A. D. 1923, the Commission of the City of I;liarni, Florida,
met in regular session at the City Hall. The,meeting was called to order at 9:00 o'clock
a. m., an'' on roll call tho following members were present:
J. I. 'Wilson, J. Lwnrnus, J. L. Leffler.
ABSiSSiT: L. 3. Romfh and James H. Gilman, who were out of the City.

It appearing that Messrs. E.3. Ramfh and James H. Gilman were absent from the City on
business, the fc.rrner to be absent for the next 2 regular meetings and the latter for
the 3 succeeding meetings, thereupon motion of Lr. Lumrnus, seconded by IJr. Leffler,
it was resolved t}'.t L.r. J. I. Viilson, be, and is hereby, elected as Chairman of the
City 3o:nmission and Actins Mayor of the Cite of Miami dur ing, the absence of J.:r• s'• 3.

hereby, granted to I.'r• s• 3. Rc:nfh for the next two regular meetings and to Lr. James

Copt. T. E. 1;ewman appeared before the Commission and submitted tentative plans for
the Bay Front development and called attention especially to the provision made for
Charter or For Fire fishing boats. The plans submitted by Mr. flewman were examined
by the Jommission but no action was token.

the entrance to the turning basin at the Municipal Docks and stated that the PAWbEE
had just broken a propo,ler blade in making this turn and that he hnew this to be

The Director of Zublic ervice, through the City 1,1anager, submitted to the Commis-
sion tentative plans for :iidewalk. Improvements Lo. 45 to 49 and Highway Improve-
ments 206 to 212 and after examination of same and after some discussion the fol-
lowing resolutions ordering the construction of said iifievialk. Districts arid said
Highway Districts and directing the City Manager to prepare and file with the Clerk
plans and specifications of said improvements und estimates of the cost thereof
were token up and passed as follows;

setting forth its intention to proceed under Section 66 of the City Charter.
Description of highway or part thereof to be improved, or sidewalk to be constructed or sewer to be laid. The material, nature and character
of such improvement with the terminal points and width thereof:
L. 35th Street from Miami Avenue to L. W. 2nd Avenue by constructing
sidewalk on both sides to a width of five (5) feet.
The City Manager is hereby directed to prepare and to file with the City Clerk plans and specifications of said improvement and an estimate
of the cost thereof, which estimate shall show the estimated amount to be assessed against the abutting property per front foot, including an estimate

yesterday, at which was presented a petition in relation to removing Austra-
lian pines from i3rickell Avenue; but other business prevented.
I live at P36 Brickell Avenue, ond am opposed to cutting clown the
pines in fr.ont of my residence. Of course, I have no voice as to whet shall
be done in front of other premises, ss this is a question which affects each
property owner individually, and all others have no emy us to the street im-
mediately in front of eaoh owner. L:y position is sinpty thie: Each proper-
ty owner has the fee simple in the soil of the street to the center thereof,
subject only :c en easement for public purposes, IL all trees, therefore,
in the street in.front of his property to the center of the street, he has a
rio.ht of properiglionG they cannot be cut down, by the municipality or any
perscn, wIthoutligiuding this proper riGht, unloes the munieipality can prove
