bid of Knight & Lomas for the sum of $57,294.00 was the lowest and
bid, the following resolution, accepting the bid of said Knight & Lo-

A RESOLUTION AWARDING CONTRACT FOR CONSTRUCTION OF WARE-
HOUSE #4 UPON THE OITY DOC1:S TO KNIGHT & LOMAS FOR. THE
SUM OF $57,294.00; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO ENTER INTO, ON BEHALF OF THE CITY, CONTRACT
FOR THE CONSTRIJCTION OF SAID WAREHOUSE; AND PROVIDING
A TIME LIMIT IN 'V.EICE THE SAID CONTRACT AND BOND ARE TO
BE EXECUTED.
WHEREAS, the City Manager has, pursuant to notice given, received
and submitted to the Commission the following bids for the construction
of Warehouse #4 upon the City .Docks, to -wit:

WHEREAS, it appears from the bids and from the statement of the Ar-
ohiteot and the City I.ianager that the bid of Knight & Lomas, for the con-
struction and erection of said Warehouse #4 is the lowest and best res-
ponsible bid; now, therefore,

Section 1: That the bid of Knight & Lomas, for the construction
and erection of Warehouse #4 upon the City Docks, at and for the sum of
$57,294.00, be, and the same is hereby, accepted.
Section 2: That the City Manager be, and is hereby, directed to en-
ter into contract, for and on behalf of the City of Miami, with Knight
& Lomas, for the construction of said Warehouse #4, in the usual form and
submit same to the City Attorney for his approval together with the bond
of the said contractor and that the said contract and bond both be sub-
mitted to the Commission for approval.
Section 3: That the said contract and bond be executed within not
later than fifteen (15) days from date hereof.
Section 4: That the certified c1ecks and bidders bond of the un-
successful bidders be returned to them forthwith by the City Clerk.
Motion by L:r. Wilson, seconded by Mr. Leffler, that the said resolution be passed and
ado»ted. On roll call the vote thereon was as follows: AYES: Messrs. Romfh, Lummue,
Wilson, Leffler. NOES: None. Motion unanimously carried and the said resolution pass-
ed and adopted.

PURCHASE OF MATERIAL AND EQUIPMENT FOR EXTENSION FIRE ALARM SYSTEM FROM GAMEWELL CO.
Communication from the City Manager to which was attached an offer of the Gamewell
Fire Alarm Telegraph Co., for material and equipment needed by the City in the ex-
tension and betterment of the fire alarm system was received and on mbtion of Mr.
Leffler, seconded by Mr. Lummui, the said communications were ordered filed and
spread upon the minutes:

I am submitting you herewith the proposition from Mr. Chas.
Beret, Southeastern agent for the Gamewell.Fire Alarm Telegraph
Co. for the material and equipment the City will need in the ex-
tension and betterment of its fire alarm system.
Mr. Beret has gone fully into this matter with the Chief of
the Fire Department, and the attached proposition covers every-
thing needed for the present installation recommended by the
Chief of the Fire Department.
There can be no competitive bids obtained on this equipment.
I would, therefore, like a resolution authorizing the Purchasing
Agent to place this order with the Gamewell Fire Alarm Telegraph
Co.

to furnishing and delivering to your department an estimated cost
on Fire Alarm equipment, therefore I beg to submit for approval
to your Honorable City Manager and yourself the following:

switchboard of white Italian marble.

that is in the Proteotor and Repeaters switchboard you will be en-
abled to add another 12 Circuit switchboard and 8 Circuit Automa-
tic Repeater with 6 Gong circuits as your City grows.
All of the above equipment and materials are to be delivered
F.O.B. Miami, Fla. but I am not figuring on the installation as
this can be made under the supervision of the Chief of the Fire
Dept. we will however furnish you with wiring diagrams so that the
installation can be made according to Gamewell methods.

'Thereupon the following resolution, authorizing the City Manager to enter into oontraot
with the Gamewell Fire Alarm Telegraph Company for the equipment and apparatus set forth
in the oommunication of said Company, was offered by Mr. Wilson and is as followe:
RESOLUTION NO. 888.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO
CONTRACT WITH THE GAMEWELL FIRE ALARM TELEGRAPH COMPANY
FOR MATERIALS, APPARATUS AND EQUIPMENT AS SET FORTH IN
THEIR COMMUNICATION UNDER DATE OF JULY 27th, 1923, AND
PROVIDING FOR THE PAYMENT THEREOF.
WHEREAS, the City Manager has submitted the proposition of the Game -
well Fire Alarm Telegraph Company to furnish the City with the neoessary
materials, apparatus and equipment for extending and improving the pre-
sent fire alarm system, and
WHEREAS, there can be no competitive bids obtained on the equipment
required for this purpose; therefore,
BE IT RESOLVED by the Commission of the City of Miami:
Section 1: That the City Manager be, and is hereby, authorized and
directed to enter into contract, for and on behalf of the City, with the
Gamewell Fire Alarm Telegraph Company for the purchase of materials, ap-
paratus and equipment for the extension and improvement of the present
fire alarm system of the City as set furth in the communication of said
Company, addressed to the City Manager, under date of July 27, 1923, at
and for the sin of ti 28,108.00.
Section 2: That tho said sum of money for the payment of the cost
of the said materials, apparatus and equipment be paid out of the Fire
Alarm Extension Bond Fund.
Motion by JIr. Wilson, seconded by Mr. Leffler, that the said resolution be passed and
adopted. 0n roll call the vote theron was as follows: AYES: Messrs. Romfh, Lummus,
Wilson, Leffler. NOES: None. Motion unanimously carried and the said resolution passed
and adopted.

Gentlemen: Re: F. E. C. R. R. Co. ve. City of Miami -
Storm Sewer Assessment Cases.
This suit was instituted against the City on June 3,
1918 for the purpose of setting aside storm sewer aasesements
against the property of the Railroad Company. A demurrer was
sustained to the bill, and on appeal the Supreme Court Reversed
Judge Branning. I filed an answer in which the City claimed that
while a part of the property was not benefited by the storm sewer,
part of it was, and the Railroad Company agrees that I am right
in my position and I have entered into a stipulation with Judge
Brown whereby the assessment will be sustained as to part of the
property, the assessment amounting to $932.52 and the interest
thereon from February 1, 1917 at 6% amounting to $306.64, or a to-
tal of $"1239.16, and that the assessment as against part of the
property amounting to $1012.82 should be cancelled. •I have ac-
cordingly prepared a decree in favor of the City for $1239.16
which will be paid in due course by the Company, and the decree
includes a cancellation of the assesment against a part of the
property amounting to $1012.82.
I expect to collect the $1239.16 within the next few
days.

WIDENING OF SOUTHWEST SECOND AVENUE REPORT OF CITY ATTORNEY
The City Attorney submitted Communication addressed to the Commission, under date
of July 27th, 1923, in reference to the Widening of Southwest Second Avenue, and
said communication was, on motion duly made and seconded, ordered filed and spread
upon the minutes:

Gentlemen: Re: Widening Southwest Second Avenue
After some conference with Dr. Jackson, the guardian
of Miss Patterson, the Patterson interests represented by Mrs.
Markley, formerly Mrs. Jesse B. Patterson, and her husband, and
Miss Patterson have agreed to give a deed to the East 10 feet
of the Patterson property, and I have prepared the deed and mail
ed it to Dr. Jackson. I have taken the liberty on behalf of the
City to express the appreciation of the Commission for the oo-
operation of the owners in widening this Street.

Gentlemen: Re: Condemnation Suits.
Suits have been instituted by me on behalf of the City to
condemn property on Southwest Second Avenue; on North Miami Ave.
and South Miami Avenue, for the purpose of widening certain parts
of these streets, and for the purpose of acquiring park property.
Since the passage of the resolution:, and before the institution of
the conedemnation proceedings, arrangements were made with Mr. 1dc-
Ghan, the owner of the Eaet 5 feet of the South 20 feet of Lot 1,
Block 138 North, for the purchase of this property by the City.
The owners of the property known as the Patterson estate,
have through Dr. James W. Jackson, agreed to convey a deed to the
East 10 feet of that property to the City.
The owner of the Weet 20.feet of Lot 3, Block 2 of Fleming &
Pearson Subdivision, On North Miami Avenue have made a conveyance
of that property to the City under agreement made to the City
Manager approved by the City Commiesion..

You will see from this statement that all the property des-
oribcd in the resolution of the condemnation are being condemned
under the law for public purposes, except those three,pieoes re-
ferred to above in which esttlements have been made between the
City and the owners.

PROTEST AGAINST ASSESSMh;NT

Communication from the Miller -Shepard Company addressed to the City Commission, under
date of July 17th, 1923, requesting the Commission to give further oonsideration to
the former written statement in regard to assessment of property described as Lots
17 and 18, the West 50 feet of Lot 1, and the South 45 feet of Lot 4, All in Bleck
118 North, was received and on motion duly made and seconded was ordered filed and no
action taken.
PROTEST AGAINST PROPOSED STREET CAR LOOP

Communication from Mr. A. K. Shipman addressed to the City Commission, under date of
July 27th, 1923, protesting against the proposed street railway loop suggested by the
Miami Realty Board, was received, and on motion duly made and seconded the oommunioa-
tionwas ordered filed and spread upon the minutes;

Gentlemen:
I wish to protest against the adoption of
the street car loop as proposed by the Realty Board.
This loop should only come up N. E. Second
Street as far as N. E. Second Avenue, thence on N.E.
Second Avenue to Flagler Street. These blocks are
business blocks and would net be injured by a trolley
line, but to extend it to N. E. Third Avenue and thence
to Flagler Street would injure the beautiful private
residences, apartment houses and hotels in this
block. The occupants of these buildings, - coming
here for rest and quiet, - would be very much annoyed
by the jarring and banging of passing cars.
Before the bonds were voted the only plan
published was of a loop South of Plagler Street, which
the public, of course, supposed would be adopted.
I am just completing an addition and improve-
ments to the Belfort Apartments at No. 252 N. E. Se-
cond Street, the value of which property would be
greatly reduced if the trolley line was extended past
it.

ORDERING SEWER LATERAL CONNECTIONS ON CERTAIN STREETS
A resolution requiring owners of certain property set forth in the resolution who
have not already connected their premises with sewers to connect with sewers, and
upon default of compliance, to order such connections and fix a lien against the
property for the cost thereof, was introduced by Mr. Wilson and is in full as fol-
lows:
RESOLUTION NO. 889.
A RESuL UTION REQUIRING OWNiIRS OF THE PROPERTY HEREIN-
AFTER DESCRIBED WHO HAVE NOT ALREADY CONNECTED THEIR
SEVERAL PREMISES IITH SEWERS, TO CONNECT THE SAME WITH
SEWERS IN FRONT OF THEIR SEVERAL PREMISES, AND UPON DE-
FAULT OF COMPLIANCE, TO AUTHORIZE THE COMMISSION TO
MAKE CONTRACTS FOR SUCH CONNECTIONS AND FIX A LIEN AG-
AINST THE PROPERTY FOR ±EE COST THEREOF.
WHEREAS, the City Commission has power to order all or any owners
of abutting real estate to connect their several premises with sewers
about to be constructed by the City of Miami, in front of their several
premises, rand in default of compliance for ten days after notice publish-
ed in the newspaper, authorizes the city commission to contract for or
make such connections and assess the whole cost thereof against the par-
ticular premises with which the connection is made,
NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of
Miami: That all owners of property upon the following streets named who
have not connected their several premises with sewers, Which are about
to be constructed by the 0 ity of Miami on the said streets, are hereby
required and ordered within ten days from the date of the publication
of the notice thereof, to make such connections of their several premis-
es with the sewers to be constructed on said streets under such regula-
tions in accordance with the specifications as prescribed and found in
the office of the Director of Public Service in the City of Miami, and
upon default of compliance with the order contained in this resolution
within ten days after such notice, the City Commission will contract for
or make such connection, and the whole cost of said connections shall
be made a lien against the particular property with which the connection
is made to the same extent and character as the lien provided for special
assessments.

OPPOSING APPLICATION FOR PERMIT FOR CONSTRUCT ISLAND IN BISCAYNE BAY
A resolution opposing the application of the Fairhaven Company for a permit to con-
struct an island in Biscayne Bay and requesting the U. S. District Engineer to grant
a hearing was introduced by Mr. Wilson and is in full as follows:
RESOLUTION NO. 890.
A RESOLUTION OPPOSING THE APPLICATION OP THE
FAIRHAVEN COMPANY FOR A PERMIT TO CONSTRUCT AN
ISLAND IN BISCAYNE BAY AND REQUESTING THE UNITED
STATES DISTRICT ENGINEER TO GRANT A PUBLIC HEAR-
ING.
WHEREAS, information has been received by the City Commission
of the City of Miami that an application has been made to the United
States District .Engineer at Jacksonville, by the Fairhaven Company,
through its secretary, L. E. Kloeber, for a permit to construct and
build an island in Biscayne Bay, to be known as Fairiele, off the
shore of the Town of Silver Bluff and the southern shore of the City
of Miami, the northern end of which island will be within the limits
of the City of Miami, an4
WHEREAS, the City' Commission of the City of Miami, by resolution
No. 631, adopted February 27th, 1923,.placed itself of record against
the constructio—ef,any island in Biscayne Bay south of the County
Causeway, except when such island is to be used for the benefit of the
public.
NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of
Miami: That the City Commission again places itself of record against
the issuance of h permit for the construction of any island in Bis-
cayne Bay, south of the County Causeway, except when such island is
to be used for the benefit of the public.
BE IT FURTHER RESOLVED that it is the belief of the City Com-
mission that the construction of the island in question, to be known
as Fairisle, will interfere with navigation, will cause an unsanita-
ry condition in the waters of Biscayne Bay between such island and
the shore, and would be detrimental to the best interests of the City
of Miami.
BE IT FURTHER RESOLVED that the City Commission request the U.
S. District Engineer, at Jacksonville, to grant a public hearing upon
the issuance of such permit, at Miami, preferable not earlier than
December, 1923, in order that citizens and property owners affected,
many of whom are now absent, may be heard.
BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby,
directed, to immediately mail a certified copy of this resolution to
the office of the United States District Engineer at Jacksonville,
Florida.
Motion by Mr. Wilson, seconded by Mr. Leffler, that the said resolution be passed and
adopted. On roll call the vote thereon was as follows: AYES: Messrs. Romfh, Lummus,
Wilson, Leffler. NOES: None. Motion unanimously carried and the said resolution pass-
ed and adopted.
CONFIRMATION OF RESOLUTIONS ORDERING SK. 41-A & SR. 61 TO 79. ORDERING NOTICE FOR BIDS
This being the date set for receiving and hearing the remonstrances of all interest-
ed persons to the confirmation of Resolutions ordering Sidewalk Improvement No. 41-A,
and Sanitary Sewer Improvements No. 61 to 79, both inclusive, the Clerk reported that
notice of the meeting had been properly given in a newspaper of general ciruulation
and submitted to the Commission proof of publication of such notice, and thereupon
it was announced that the Commission was ready to receive and consider the remon-
strances of all interested persons to the confirmation of said resolutions ordering
Sidewalk Improvement No. 41-A and Sanitary Sewer Improvements No. 61 to 79, both in-
clusive. There being no remonstranoes or objections filed the Commission proceeded
with the confirmation of the said resolutions ordering the said sidewalk and sanitary
sewer districts by the passage and adoption of the following resolutions, to -wit

BUDGET ESTIMATE FOR FISCAL YEAR 1923-1924-PROVIDING FOR HEARINGS FILED BY CITY MANAGER
The City Manager submitted to the Commission the Budge Estimate for the fiscal year
from July 1, 1923 to June 30, 1924 of the expenditures and revenues of all city depart-
ments, divisions and offices, which, on motion of Mr. Wilson, seconded by Ltr. Leffler,
was ordered reoeived and filed. Thereupon the following resolution, providing for pu-
blic hearings on the proposed appropriation ordinance, was introduced by Iir. Lummus:

A RESOLUTION PROVIDING FOR PUBLIC HEARING ON PRO-
POSED APPROIRIATIOL ORDINANCE FOR THE FISCAL YEAR
FROM JULY 1, 1923 TO JUNE 30, 1924.
WHEREAS, the City Manager has submitted his budget estimate to the
City Commission as required by Section 29 of the City Charter, and
WHEREAS, the City Commission has prepared an appropriation ordinance
for the fiscal year from July 1, 1923 to June 30, 1924, using the City
Manager's estimate as a basis, and
WHEREAS, the City Charter requires that provision be made for public
hearings on said proposed appropriation ordinance before the Commission
sitting as a committee of the whole;'
NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of
Miami:
Section 1. That the City Clerk he directed to give public notice
in the Miami herald and in the Miami News -Metropolis by publication in

the conflroiatioc of the preliminary assessment roll of Sidewalk Improve-
ment No. 3F, District Sk-35 by any person whose property is described in
said preliminary roll; and
WEERr:AS, the Commission of the City of Miami, having received and
considered all written remonstrances filed to the confirmation of the
preliminary roll by any pe sons whose property is described in said roll.
TEEREFCRE, BE IT RESOLVED by the Commission of the City of Miami:
That the prima facie assessment, as indicated on said preliminary
assessment roll, be and is in all things confirmed and sustained against
any and all lots or parcels of ground described thereon.
BE IT FURITER RE6 LVE1, that the sums and amounts against each of
the lots or parcels of ground in said preliminary assessment roll are
less than the amount that each of said lots or parcels of ground is be-
nefited by said improvement and that such amounts are in proportion to
the special benefits, and that the proportion of said cost to be paid
by said city of Miami on account of highway intersection 1s the sum set
oprosite to the same therein.
The total cost of the said improvement, in the sum of 41611.07,

SIDEWALKS ON N. E. 15TH STREET
REQUEST FOR SAME ON ONLY ONE SIDE OF STREET
A resident and property owner on N. E. 16th Street (Old Collin's Bridge Road) appear-
ed before the Commission and asked that sidewalks be built on only one side of the
said street on account of that street being only eighteen feet in width or that if it
was decided that sidewalks should be oohstructed on both sides of the street that they
be made a width of 2i- feet. Ltr. Murray, Director of Public Service, stated that he
would not care to build a 2-foot sidewalk and after some discussion it was decided
that a sidewalk of such a width was impracticable and that it would be necessary to
submit a petition signed by all the property owners abutting on the street in order to
do away with a sidewalk on either side.
