D. 1923, the Commission of the City of Miami, I~'lorida, Met in regular session at the City Hall in Miami, Florida, at nine o'clock a. m.,there being present the following: E. C. Romfh J. E. READING OF MINUTES APPROVED The Clerk read the Minutes of the Meeting of the Board of Equalization of July 9th, loth and llth, and the minutes of the meeting of the Commission on July loth, whioh said minutes were approved and accepted. $892,000 MUNICIPAL BONDS. SERIES "U". AUTHORIZING ISSUANCE Communications from City Attorney in re: Communication from the City Attorney under date of July 13th, in reference to the issuance of $892,000 Improvement Bonds, Series "U", was submitted, and on motion of Mr. Leffler, seconded by Mr. Lummus, the said oommunioation was ordered filed and spread upon the minutes: The City Commission, Miami, Florida. Gentlemen: Re: Miami Local Improvement Bonds, Series 'rU". There will be presented to you at your next meeting on July 17th, a form for the resolution which will authorize the is- suance of these bonds totaling 4892,000.00 in bonds of $1,000.00 each, numbered from 1911 to 2802, both inclusive. You will observe that the bonds bear interest at a rate to be hereafter determined by you not exceeding sir, per centurn per annum, and the last sec- tion of the resolution authorizes the Director of Finance to nego- tiate the sale of the bonds without public advertisement subject to the confirmation thereof by therequisite vote of the Commission. Under the charter provision, page 3G, these bonds can- not be sold at less than par and accrued interest except by unani- mous vote of the members of the Commission, and then at a price not loss than 97 on the dollar and accrued interest, so when these bonds are negotiated and the ;ommission passes the necessary reso- lution confirming the sale by the Director of 7inanco, that reso- lution will have to have the nnani.mous vote of all the members of the Commission if the bonds are sold at less than par. I make this statement because the absence of any one commissioner from a meeting will make it impossible to pass the resolution confirming the sale by the Director of Anance if the bonds are sold at less than par. Gilman and is in full as follows: RESOLUTION NO. 817. A RESOLUTION PRQVIDING FOR THE ISSUANCE OF IM- PROVELIEIIT BONDS, SERIES "U" . WHEREAS, certain hightay and sidewalk improvements have been order- ed by resolutions duly passed by the City Commission under Section 56 of the Charter, and such resolutions have been duly confirmed by the City Commission after advertisement published in accordance with the charter, and after due estimates made by the City Ltanager of the cost of each of such improvements and of the incidental expenses thereunto appertaining; and WHEREAS, contracts have been duly let after due public advertise- ment, for the construction of the said improvements, and it is deemed ne- cessary immediately to issue bonds of the City to pay a portion of the costs of said improvements as hereinafter set forth; and WHEREAS, the following diagram contains a true statement in its several columns of the following facts: • Column 1: The designation of each improvement, the letter H indicating a highway improve- ment and the letters Sk indicating a side- walk improvement. Column 2: The number of the resolution ordering each improvement. Column 3: The date of confirmation of each resolu- tion ordering an improvement. Column 4: The it; L:arager's estimate of the inciden- tal expenses connected with each improve- ment. That In order to pay that portion or entirety, a2 set forth in the fifth column of the diagram centained in the preambles of this resolution, of the cost.of each and every improvement therein specified, as well as to pay the cost of the incidental expenses in connection with each of said improvements, and to reimburse any city fund or funds from which a portion of such cost has been pnid or shall be paid before the receipt of the proceeds of the bonds herein authorized, there ohall be issued the nego- tiable coupon bonds of the City of Miami in the aggreeate amount of 4892,000 the proceeds of Which ehall be applied to said costs and incidental expenses, proportioning the same to each improvement in a.cordance with the figures set 'orth in columns four ene five of so id diegram. Section 2. That said bonds shall be dee1enated as "Improvement Bonds, Series U" an shall be dated July 1, 1923, end shall consist of 892 bonds of 41,050 each, nembered from 1911 to 2002, beth inelusive, and bear interest at a rate to be heleafter determined, not exceeding six per centum per annum, payable semi-annually on the first days of January and July of each year up- on the presentation of coupons to be attached to said bonds, both principal and interest to be payable in Bold coin of the United ;Autos of the present seandard oe eeieht end fineness at the United :Antes elortgage & Trust Com- pany in tee amity of Rew York. :Action 3. That said bonds shall be signed by the IJsyor and City Clerk and attested by the Director of Finance, end sealed with the City seal, and the coupons annexed thereto shall be eiened by said Clerk, whose signature may be in fecsimile: and the form of said bends shall be in accordance with the form provided by resolution ho. 53, passed October 11, 1921. Section e. Sectioe G. That notwithstanding the foregoine provisions for the Se — creation of special assessments for the payment of the bond u herein author- ized aed ieterest, the principal and interest of said bonds shall be payable from general taxation upon all the taeable property of the City of Miami, as provided by Section 50 of the charter now in force, and provision for such levy shall be mede in each year while the bonds herein authorized shall be outstanding. Section 7. That the Director of Finance is authorized to negotiate for the sale of said bends without public advertisement, subject to confirmation thereof by the requisite vote of the City .-iommission. LuMmus, eeconded by Mr. Gilman, the said communication was ordered received nu filed and spread upon the minutes: ,-,L_Aaiu,vpeeeeeev TO THE CITY COMMISSIONERS, MIAMI, FLORIDA: At a meeting of the directors of the Civic Clubs of Miami, held on July 3rd, 1923, it was resolved that: It was the sense of the meeting that a City Planning Board, as provided under Section 72 of the City Charter, should be appointed by the Commission at this time and before aotive work is begun on the filling of the'proposed park. It was further the sense of the meeting that the creation of a Park Board would not satisfactorily meet the stivation; that the Park Board should be a subordinate part of the City Planning Board. It ess further the sense of the meeting that the Civic Clubs would undertake to suggest suitable persons who would serve on this City Planning Board without compensation; that the Civic Clubs would further undertake to furnish a secretary for this Board, withuut ex- pense to the Jity, until such time as the Commissioners saw fit to employ a secretary at the expense of .the City. It was aloe the sense of the meeting that the appointment of this Planning Board would entail no expense to the City at the pre- sent time, as the expenditure of any sums by the Board or any work approved by the City Commission on recommendation of the Board, would of necessity be !authorized by the Commission. It was also the sense of the meeting that such a Board, there- fore, could do no harm, but would very probably be able to make re- commendations to the Commission that would be o; great value to the City. The directors of the Miami Civic Clubs therefore respeotfully request the Jommiseion to indicate whether or not they are willing to appoint a City Planning Board, and whether or not they desire to be appointed to such Board. At the suggestion of Mayor J. L. Leffler, that the directors of the Civic Clubs submit names for appointment to the Park Board should the Commission decide to appoint such a Board, the following names are submitted: John Burd ins Mrs. Marjorie Stoneman Douglas I:.r. Schilling be, and he is hereby, re -appointed as a member of the CiVil Service Board of the City of Miami, Florida, to serve for a term of three (3) years from July 26th, 1923. AUPfl0RIZIUG PURCHASE OF PROPERTY FOR STREET WIDENING PURPOSES A resolution authorising the City Msmler to close negotiations for certain proper- ty for street widening purposes and providing for payment for the property was in- troduced by Mr. Lummus and is in full as follows: RESOLUTION ro. 820. A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER, THRU THE PROPER CITY OFFICEI:S, TO CLOSE NEGOTIATIONS FOR CERTAIN PROPERTY AND PROVIDING FOR PAYMENT FOR SAID PRO- PERTY. WHEREAS, the City Commission of the City of Miami deems it necess- ary to acquire the following described property for street widening pur- poses, to -wit: Begin at the Northeast corner of Lot One (1) of Block Three (3) of Baldwin & Ozars Addition to the City of Miami, run south fifty (50) feet; thence diagonally to a point fifty (50) feet west of the point of beginn- ing; thence East fifty (50) feet to point of beginning. NOW, THEREFORE, BE IT RESOLVED by the Commission of the City of Miami, that tho City elanager, thru the proper City Offieers, be, and he is hereby, authorized and directed to conclude the negotiations for the property above described and to pay the owners thereof the sum of not to exceed Six Thousand Two Hundred Fifty Dollars (.6,250.00). OBJECTIONS THERETO This being the date and hour set for receiving objections of any person inter- ested to the confirmation of Resolution ordering Storm Sewer Improvement No. 60-A, it mas announced that the eommission was ready to hear and consider the remonstrances of all persons to the confirmation of said resolution. .The Clerk presented communieation addressed to him from one Mrs. Frederick Tuhl, protest- ing aeainst the assessment levied on Lot 1 and 20 in Lawrence Estate Subdivi- sion which communication ic in full as follows: Mr. e. I wish to protest against any assessment being levied against Lot 1 (of which I own 50x100 feet) and 20, Lawrence Estate Sub., for ;he above storm sewer, on the ground that it will be of absolutely no benefit to my property, which ic the highest point ofland in that subdivision, and in no sense needs or will benefitted by a :tom sewer. BE IT FURTHER RESOLVED that the City Clerk cause to be published at Least three times in the Miami Herald, a newspaper of general cir- culation in Miami, Florida, and in Jacksonville Times Union a news- paper of general circulation throughout the State, published at Jack- sonvil.le, Florida, a notice calling for sealed bids to be received by the Commission of the City of Miami on the 14th day of August, 1923, at 9:30 o'clock a. m., for the construction of the said work. Said notice shall state the improvement is to be constructed, and paid for in cash, under Section 56, df the City Charter. Any bid covering work to be done under more than one resoTtion shall be in such form as to permit a separation to be made of the cost under each resolu- tion. Each proposal rust be accompanied by a certified check upon a bank or trust company of Florida, in tho amount of 2e0 of the amount of the bid, payable to the City of ?Miami, to insure the execution of a contract and bond to carry out the work in aciordance with the plans and specifications. All bids will be opened and award of a contract made or all bids rejected. After an award has been made, the checks of all bidders, other than tie one to whom the contract has been awarded, shall be returned. In default of the entering into of such contract, the certified check required to accompany such hid shall be forfeited to the City of Miami, 21orida, not as a penalty, but as liquidated dam- ages for the delay or addition cost which may be incurred by the City by reason of such default. No bid will be permitted to be withdrawn .for any reason whatever after having been filed with the Clerk. Motion by 1Mr. Lummus, seconded by i.:r. WHEREAS, the Commission of the City of Miami, by resolution passed and adopted the 3rd day of July, 1923, ordered Highway Im- provement 189-A, District H-189-A, and the City Manager, under the direction of the Commission of the City o1 Miami, has prepared and filed with the City Clerk plans and specifications of such improve- ment and an estimate of the cost thereof, including an estimate of the cost of the incidental expenses of said improvement, and WHEREAS, due notice by publication as required by the City Charter has been made that the Commission of the City of Miami would on the 17th day of July, 1923, at the City Hall, at 9:00 o'clock a. m., receive and hear the remonstrances of all interested persons to the confirmation of said resolution ordering said improve- ment, and all remonstrances received having been heard and consider- ed by the Commission of the City of Miami. This improvement shall be designated in all prooeedings, assessments, and bonds ac Sidewalk Improvement Ilo. EAST COAST LUMBER COMPANY SHED ON FIRST AVENUE BETWEEN 5TH AND 6TH STREETS The Director of Public Service reported that the lumber shed of the East Coast Lumber d: Supply Company, running parallel with N.W.
