WHEREAS, prior to the coming in force of the preeeflt City Charter, the City Council of the City of Miami had passed resolutions ordering local improvements vender Section 26 of the former legislative charter, and the City Commission has heretofore passed resolutions ordering other local improvements under Section 56 of the present City Charter, whioh resolutions were thereafter duly oonfirmed by the governing body of the City after advertisement published in accordance with the charter then in force and after due hearing; and WHEREAS, they City! Engineer and the City Manager duly filed their estimates prior to the publication of such notices, of the cost of each of said improvements and of the incidental expenses thereunto appertaining; and WHEREAS, contracts have been duly let after publio advertisement for the construction of certain of the said improvements, and the improvements so contracted for have been oompleted, and WHEREAS, no oontracts have been let for the construction of certain others of the said improvements; and WHEREAS the following is a list of the improvements hereinabove referred to, and of the resolutions authorizing the same, and of the dates of confirmation of said resolutions, with the amounts of said engineer's and City Manager's estimates as to the coat of the work and as to the amount of the incidentals together with the amounts of the contract prices computed by the Engineer and confirmed by the governing body in all oases in which contracts have been let: "DOCUMENT INDEX ITEM NO. Sk . 34 280 * N N 6641.25 664.12 7305.37 Sk.35 281 N N N 1932.00 193.20 2125.20 6k.38 282 N * N 1700.00 170.00 1870.00 and, WHEREAS, that part of the cost of said sanitary improvements, being improvements thirty-one (31) to forty (40) inclusive, which has heretofore been assessed upon abutting property, is sixty seven'thousand three hundred and 51/100 dollars (67,300.51); and WHEREAS, that part of the cost tbf said sanitary improvements, being improvements forty-one (41) to fifty-five (55) inclusive, which is to be assessed upon abutting property, has been and is estimated by the Commission to be one hundred nine thousand and twenty-one and 46/100 ($109,021.46) dollars, and, WHEREAS, prior to the confirmation of each of the said resolutions providing for sanitary improvements, being resolutions 1540B, to 1549E inclusive, and resolutions 220 to 233 inclusive, either the City Auditor duly certified .to the City Council in writing, or after the new Charter came in force the City Manager duly certified to the Commission in writing, that sufficient funds were in the City Treasury applicable to and sufficient for the payment of the City's ehare of the cost of said sanitary sewer improvements, or that a sufficient amount of bonds had been voted by the electors qualified to vote thereon, as provided in the City Charter, the proceeds of which bonds might be used to pay the City's share; and w!EREA`', no assessments heretofore made for any of the said improvements have been pledged or applied to the "SUPPORTIVE of any bonds, contracts or other obligations, and all DOCUM E*T'f are subject to be pledged to the payment of the bonds FOLL.OA' oe authorized in this resolution, and • f WHEREAS, there has heretofore been paid from the General Fund upon said contract designated Sanitary Sewers thirty-one (31) to forty (40) inclusive, and, WHEREAS, there has heretofore been paid from the General l t Fund ,� ©� t� for the property owner's part of the incidental expenses upon the said contract for the improvement designated Sanitary Sewers thirty-one (31) to forty (40) inclusive, and, WHEREAS, the actual cost of work completed has in no case been less than the contract prioe therefor as hereinabove recited, and, WHEREAS, the cost of the incidentals in connection with completed improvements has in no case been less than the engineer's estimate of such coat of incidentals; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI: Section 1. Section 3.
