in willing to agree to the installation et such temporary crossing
of a ohereoter which will assure the pfe operation et its trains
and the safety of the publia; during said temporary period;

in consideration of the premises, end in consideration sf the
assumption by the party of the second part of the terms and
obligations of the original contract between the party et the
first part And the Miami Traction Company, hereinabovs referred
to, and which has been assigned by said Miami Traction Company,.
together with its tracks end other property, to the said City
of Miami, the said Florida East Coast Hallway Company does hereby
give to the sold City of Bland the right to construct end use a
temporary croacing over its main line on 1'legler Ctreet in said
City upon the following conditions, to -wit:
1, That the said temporary crossing herein specie
fled is to be confined to the Train track of the City's said street
railway across said crossing, es well as to the main track of the
said railway Company at oaid crossing.
2. That the said temporary crossing so agreed upon
between said parties shall be constructed in accordance with the
specifications of the said hallway Company, which ere as follome: .

said temporary crossing, it ntiould develop, in the Judgment of
the Engineering Department of the said Railway Company, that the
operation of the paid temporary creeping herein above sereed on
Ee ruid constitute a menace or deneer to the proper operation of
rid 1:eiliNry Company's tocogotivcn rind trains. the said party
of the first pr r.t n' ail hr>ve the rivht to remove said crossing
at the expense of the party of the second part in order to abate

5. The said party of the second part further agrees to
indennify the party of the first pert and hold it harmless from
