D. 1922, the Commission of the City of Miami met in regular session at the City Hall in Miami, Florida, at nine o'clock a. m. The meeting was called to order by Chairman Leffler and on roll call the following members were pre- sent: C. D. Leffler, J. E. Lummus, J. I. Wilson, J. H. Gilman, E. C. Romfh. READING OF THI MINUTES OF DECEMBER 12TH The Clerk read the minutes of the meeting of December 12th, 1922, which were approved and accepted as written. ABSTRACT OF TITLE TO LOTS 8y 15 AND 22, LAVLENCE ESTATE, BLK. 107 REPORT OF CITY ATTORNEY The City Attorney presented to the Commission communication under date of December 18th, which on motion of J. E. Lummus, seconded by J. I. Wilson, was ordered received and fil- ed and spread upon the minutes: The City Commission, Miami, Florida. Gentlemen: Miami, Florida, December 18th, 1922. The abstract of title to Lots 8, 15 and 22, Block 107, of the Lawrence Estate Land Company's Subdivision, purchased from J. W. Wal- lace and W. H. List, has been brought to date and the abstract and opinion on the title showing the title in the City of Miami have been delivered to LIr. W. A. Kohihepp, Director of Finance. Yours very truly, A. ROSE City Attorney REPORT OF CITY ATTORNEY ON PROPERTY OF JOE CONRAD ACTION OF COMZIISSION ON SAI,fE The City Attorney made verbal communication to the Commission in reference to communi- cation of Joe Conrad under date of November 29th respecting the opening of S. W. 7th Street, reporting that abstract of title was furnished him and that the abstract shows good title in Conrad as shown in the opinion of the City Attorney attached to the said Abstract of tittle. On motion of J. E. Lummus, seconded by J. I. Wilson, it was re- solved that the written offer of Joe Conrad, under date of November 29th, 1922, of two thousand dollars (2,000) for the property described in the Abstract and Opinion of Title, be, and the same is hereby, accepted by the City of Miami, the payment of the purchase price to be made as soon as possible after January 1, 1923, and the title to be approved by the Jit,y Attorney free from all incrmrbrances. Relative to the complaint of Dr. Bayles and Calvin Oak that the lot cleaning gang destroyed numerous valuable trees on their property facing Briokell Avenue, beg to submit the following report: This afternoon I went over the ground personally with Dr. Sayles and found that numerous oaks jungle trees, and several fruit trees ranging from seedlings to 2" caliper, had been out down. I suggested that the Park Department v Auld replace these trees from time to time procuring same from some of the various development work in different sections of the City. The fruit trees we can immediately replace as I have a small stock in the slat house. 127 12b December 19, 1922. Mr. Oaks is willing to aocept replanting of trees and has left the seleotion of same to me. Both parties concerned are satisfied with this arrangement. Trusting the above report meets with your approval and with the as-. suranoe that trees will not be removed from private property to take care of this replanting, I am Yours truly, J. Pelsang addressed to the'City Commission, in reference to moving of ways and office building made necessary by the constructidn of Bridge at S. W. Seoond Avenue was received, and on motion of J. E. Lummus, seconded by J. I. Wilson, the commu- nication was referred to the City Manager with the request that he make a report of the cost of moving said ways and office building at the next meeting of the Commission. AUTHORIZING EXECUTION OF QUIT -CLAIM DEED BY CITY IN RE CENTRAL SCHOOL PROPERTY M. D. Price appeared before the Commission in reference to the communication of October 23, 1922, signed by G. E. McCaskill, County Attorney, addressed to H. H. Filer, appear- ing upon Page 75 of Minute Book 13, and called attention to the passage of Resolution No. 534, passed und adopted October 31, 1922, appearing on page 76 of Minute Book 13, wherein the Director of Finenee was authorized to cancel the liens for taxes held by the City of Miami set forth in the communication of McCaskill to Filer and to cancel side- walk lien filed March 8, 1904 for ‘‘:.a6.05 as recorded in Lien Book 1 at page 37. 341.4 Price requested the passage of the proper authority to the Llayor and City Manager for quit -claim deed upon the payment of the principal amount due the City for the liens set forth in said communication excepting the lien of 0.6.05 dated March 8, 1904. There- fore, the following resolution was introduced by J. I. Wilson: RESOLUTION N0..589. BE IT RESOLVED hy the Commission of the City of Miami, that the Mayor and the City Manager of the City of Miami, be, and they are hereby, author- ized and empowered to execute and deliver to the Board of Public Instruction of the County of Dude, State of Florida, a quit -claim deed'conveying to said Board of Public Instruction of the County of Dade, State of Florida, a cor- poration, all the right, title, interest and claim that the City of Miami now has in the following described property, to -wit: Lote 1 to 7, bnth inolusive, and loLs 14 to 20, both inclusive of Bloch 8E florth, City of Miami, Florida, ac,:ording to the map or plat of said City made by A. Poteford aineared before the Commission and made complaint of the sewer outlet at ':he f-ot ef k. E. end Terrace stating that the pipe should be carried out into the Bay 15r: foot fro the present shore line instead of 25 feet which she thought was their present Intention. After some discussion, the Commission not being familiar with the details of the sewer construction, the matter was referred to the City Manager and Di- rootnr f Public Service. J. Quinn Company, accompanied by certified check for $750.00. Upon motion of J.I. Wilson, seconded by J. H. Gilman, these bide were referred to the Direotor of Publio Service for tabulation who reported that the bid of Jno. J. Quinn Company was the lowest and best bid, and thereupon the following resolution was introduced by J. E. Lummus: RESOLUTION NO. 590. A RESOLUTION ACCEP2ING TEE BID OF JNO. J. QUINN COMPANY FOe SANITARY SEWER DISTRICTS 66, 57, 58 AND 69; AUTHORIZING CITY MANAGER TO EXECUTE CON- TRACT FOR SUCH SEILER CONSTRUCTION; AND DIRECTING THE RETURN OF CERTIFIED CHECK,3 TO UNSUCCESSFUL BIDDERS. BE IT RESOLVED by the Commission of the City of Miami, that the bid of John J. Quinn Company for aanitary Sower Districts 56, 57, 58 and 59 be and the same are hereby accepted and the City Manager authorized, on behalf of the City of Miami, to execute proper contract with the suoceesful bidder and re- ceive proper bonds, same to be approved by the City Attorney. BE IT FURTHER RESOLVED that the check of the unsuccessful bidder be return- ed to him forthwith by the City Clerk. Moved by J. E. Lummus and seconded by J. I. Wilson that the said resolution be passed and adopted. 0n roll call the vote was as follows: J. D. Leffler, yes; J. E. Lum- mue, yes; J. T. Wilson, yes; J. N. Gilman, yes; E. C. Romfh, yes. Motion carried and the said resolution passed and adopted as road. This also being the day set for the reoeption of bids for Highway Improvement H-189, there was received one bid, that of John J. Quinn Company, accompanied by certified check for 200.00. The Director of Public Service reported that the bid was in line with the last bids received and was a reasonable bid. Thereupon a resolution accept- ing the bid and authorizing the City Manager to execute contract with the John J. Quinn Company was introduced by J. E. Gilman: RESOLUTION NO. 591. A RESOLUTION ACCEPTING THE BID OF JNO. J. QUINN COMPANY FOR HIGHWAY IMPROVEMENT NO. 189, AND AUTHORIZING CITY MANAGER TO EXE- CUTE CONTRACT FOR SUM HIGHWAY CONSTRUCTION. BE IT RESOLVED by the Commission of the City of Miami, that thebid of John J. Quinn Company fnr Highway District No. 189, be, and the same is hereby, accepted and the City ;alnager is hereby authorized, on behalf of the City of Miami, to enter into contract with the successful bidder and procure proper bond, eald contract and bond to be approved by the City At- torney. AUTHORIZING CERTAIN TRANSFERS BETWEEN APPROPRIATIONS WITHIN SAME DEPARTMENT A resolution authorizing certain transfers between appropriations within the same de- partment was introduced by J. I. Wilson. Suid resolution was read in full and is as followz: RESOLUTION NO. 592. NOTICE FOR REMONSTRANCES The City Manager reported to the Commission that the work included under Sanitary Sewer Improvement No. 34 had been completed and that he had filed with the City Clerk the Preliminary Assessment Roll for said Improvement, thereupon upon motion of J. I. Wilson, seconded by E. C. Romfh, it was resolved that the City Clerk he, and he is hereby, directed to cause notice to be given in a newspaper published in the city twice weekly for two weeks, stattng that at a meetin of the City Commission to be held on January 2nd, 1923, at nine o'olock a. m., any person whose property is de- soribed in the said preliminary roll, may appear and file written objections to the confiraution of the preliminary roll.
