MINUTES OF THE MEETING OF THE COMMISSION OF THE CITY OF MIAMI, FLORIDA. 0n the 28th day of November, A. D. 1922, the Commission of the City of Miami met in regu- lar session at the City Hall in Miami, Florida. The meeting was called to order at 9:00 o'clock a. m., by Chairman Leffler, and on roll oall the following members were present: C.D. Leffler, J.E. Lummus, J.I. Wilson, J.H. Gilman, E.C. Romfh. READING OF THE MINUTES MEETING OF NOVEMBER 218T The Clerk read the minutes of the meeting of November 21et which were approved and aooepted as written. LIST OF ABSTRACTS AND OPINIONS ON CITY PROPERTY The City Attorney presented oommunication, under date of November 21st, 1922, addressed to the City Commission, In reference to Abstracts of Title and Opinions on City property. On motion of J. E. Lummus, seconded by J. I. Wilson, the said communication was ordered re- ceived and filed and ordered spread upon the minutes: The City Commission, Miami, Florida. Gentlemen: Miami, Florida, November 21, 1922. The following is a list of abstracts and opinions which I have examined and found the fee simple title in the City of Miami, exoepting abstract #20 which shows the title to be in Mary Brickell with an agree- ment to convey the property to the City for a consideration of $12,500.00 payable $'50.00 cash and $1,245.00 every 12 months until.the entire sum is paid. Upon abstracts 1, 4, 7, 10. 27, 28 and 36 there appears to be outstanding tax certificates and I recommend that the City redeem each of these tax certificates, and I have prepared resolution authorizing this to be done. There are several abstracts to City property not included in the following list which I am having brought to date or in which I am engaged in further investigation as to the title. Gilman, received minutes: FOR RECOVERY OF CERTAIN LOTS Commission, under date of November vs. City of Miami, was, on motion of and filed and ordered spread upon the Miami, Florida, November 27th, 1922. The City Commission, Miami, Florida. Gentlemen: In re: John Palmer Correll_ve. City of Miami. John Palmer Correll has instituted suit against the City for the recovery of Lots 1 and 3 of Mary Brickell's Subdivision of certain lands in Seotion 31-53-42 and Seotion 36-53-41 claiming that a mortgage given in Oc- tober, 1906 upon the said property by the owner was improperly foreclosed in 1910 and asking that the decree of foreclosure be set aside and that the City may be decreed to deliver possession of the premises to the complainant. It seems that the City derives its title to that property, which le on the water front, through a purchaser at the foreolosure sale in 1910, the City having purchased the property in 1915. Proper defenses are being urged to the suit. Yours very truly, A. J. ROSE AJR/lgh City Attorney The City Attorney stated that he had ordered Abstracts of Title to the property and was having copy made of the proceedings in the foreclosure suit and the proper defen- ses would be interposed. AUTHORIZING PURCHASE OF LOTS 8, 15 AND 22 OF BLI:. 107 OF LAWRENCE ESTATE SUBDIVISION The City Attorney reported to the Commission that he had secured Abstraot of Title to Lots 8, 15 and 22 of Blook 107, Lawrenoe Estate Land Company's Subdivision, and he presented his written opinion to the City Commission showing that the title is in the Lawrence Estate Land Company, subject to an agreement from that Company to J. W.Wallaoe and W. H. List. Thereupon a resolution authorizing the purohaseof said lots for the purpose of opening up oertain streets mentioned in the resolution was introduced by Commissioner J. I. A RESOLUTION AUTHORIZING THE PURCHASE OF LOTS 8, 16 AND 22 OF BLOCK 107 LAWRENCE ESTATE FOR THE PURPOSE OF OPEN- ING UP CERTAIN STREETS MENTIONED IN THE RESOLUTION AND APPROPRIATING THE SUM OF $3750.00 FOR SAID PURPOSE. WHEREAS, it being necessary, in the opinion of the Commission to open old 17th, 18th and 19th Streets, now known as S. W. 5th, 6th and 7th Streets, from old Avenue U to old Osceola Road, now known as S. W. 16th Avenue to S. W. 17th Avenue, and in order to do so it is necessary that the Commission purohane lots 8, 15 and 22 of Block 107, Lawrenoe Estate; and WHEREAS, the owners of said lots offer to sell same to the City for the sum of $3750.00 in cash, which price the Commission finds, after investigation, to be reasonable; now, therefore, BE IT RESOLVED BY THE COMMISSION OF THE CITY OP MIAMI, that the City of Miami purchase from the owners said lots 8, 15 and 22 of Block 107, Lawrence Es- tate, aforesaid, at and for the sum of $3750.00 in cash. BE IT FURTHER RESOLVED, that the sum of $3750.00 be, and the same is hereby, appropriated from the unencumbered balanoe of the General Fund Surplus for the purpose of making such purchase. BE IT FURTHER RESOLVED, that the City Manager and Direotor of Pinanoe be, and they are hereby, authorized to pay said money to said owners upon approval of title by the City Attorney. Moved by J. I. CONFIRMING ASSESSMENT ROLLS FOR HOUSE CONNECTIONS A resolution confirming the assessment roll for house oonneotions and making the whole oost of said oonnections a lien against the property described in said assessment roll, was in- troduoed by J. E. Lummus: RESOLUTION NO. 664. A RESOLUTION CONFIRMING THE ASSESSMENT ROLL FOR HOUSE CONNECTIONS AND MAKING THE WHOLE COST OF SAID CONNEC- TIONS A LIEN AGAINST THE PROPERTY DESCRIBlD IN SAID ASSESSMENT. WHEREAS, the City Commission has heretofore ordered the owners of proper- ty abutting on real estate described in the report of the City Manager and the Director of Public Service hereto attached to connect their several premises with sewers in front of their said several premises and default having been made by the property owners described in the attached report for ten days af- ter notice thereof had been served and published as required by the City Char- ter, and WHEREAS, the said work of oonneoting said real estate described in said report has been made by the City under the regulations and in accordance with the specifications prescribed by it, and it appearing that the cost of suoh house connections per lineal foot amounted to 01.05, and that the whole cost of said connections against the property set forth in said report is as set forth in the said report; now, therefore, BE IT RESOLVED by the Commission of the City of Miami, that the said re- port of said City Manager and Direotor of Public Service which sets out the amount assessed against each of the property owners and properties described in the said report be, and the same is hereby, confirmed and sustained and eaoh of the said properties set forth in the said report is hereby charged with a lien for the amount set opposite the properties described, which charge shall be, and is hereby, ordered to be forthwith due and payable with the same penal- ties and the same rights of oolleotion and sale and forfeiture as obtain for City taxes. H. Gilman, and on motion of J. E. Lummus, seconded by J. I. Wilson, it was resolved that the charter requirement for read- ing of ordinances on two separate 000asions be, and the same is hereby, dispensed with by the following vote: J. D. Leffler, yes; J. E. Lummus, yes; J. I. Wilsoh, yes; J. H. Gilman, yes; E. 3. Romfb, yes. 0n motion of J. H. Gilman, seconded by J. E. Lummus, the said ordinance was given its first reading and read by title only. D. Moody, Jack- sonville, Florida, to the Director of Public Servioe, of $3500.00 F.O.B. Cincinnati with freight allowed to Miami for one Anderson Asphalt Road Repair Outfit, and reoommended the passage of a resolution authorizing the purchase of such an outfit. On motion of J. I. Wilson, seconded by E. C. Romfh, the oommunioation of M. D. Moody to the Direotor of Public Service was ordered spread upon the minutes: Mr. Chas. W. Confirming my oonversation with you of even date, in refer- ence to Anderson Asphalt Road Repair Outfit: Beg to herewith quote you a prioe of $3500.00 F.O.B. I wish to further advise that, if favored with your business, my company is willing to send a service engineer to Miami to give your operator a sufficient schooling of three days, showing him how to make the proper mixtures of his materials and how to make his patohes. The City Clerk reported that he had oaused notice to be given in the MIAMI METR0P0- LIS that the Commission would onthis date meet to hear the remonstranoes of any person interested to the confirmation of preliminary assessment for Sanitary Sewer Improvements 38 and 40, and it was announced that the Commission was ready to hear any remonstranoes of persons interested to the oonfirmation of said Preliminary As- sessment rolls. There being no remonstranoes filed, Resolution No. 568, oonfirm- ing the preliminary assessment roll on Sewer improvement No. 38, was introduoed by J. I. Wilson: 1()6 November 28th, 1922.
