On the 21st day of November, A. D. 1922 the Commission of the City of Miami met in re
lar session at the nits Hall in Miami, *lorida. The meeting was oalled to order at 9:00
o'olook a. m., by Chairman Leffler, and on roll call the following members were present:
C. D. Leffler, J. E. Lummus, J. I. Wilson, J. H. Gilman, E. O. Romfh.
ABSENT: None.

The Clerk read the minutes of the meeting of November 14th whioh were approved and aooept-
ed as written.
PETITION FROM PHOTOGRAPHERS
IN RE LICENSE TAX
The oommnunioation of John Petroff of the John's Studio, F. A. Robinson, Mgr. Photo Dept.,
Burdine's Sons, and Claude C. Matlack, of Claude Matlack Company, to the City Commission,
under date of November 20th, 1922, requesting the Commission to amend the License Tax
Ordinance by inoluding therein a lioense for agenoies for photographers, photograpio
printers and developers. of $25.00, was reoeived. After some discussion, and it appear-
ing to the Commission that under the lioense tax ordinanoe now in foroe that a $25.00 Vi-
cente is imposed upon any agenoy or other business not epeoifioally mentioned in the li-
oense tax ordinanoe, and that this provision will meet the requirement of the petitioners,
on motion of J. E. Lummus, eeoonded by J. H. Gilman, the petition was ordered filed and
the City Manager notified to oolleot from all agencies or other businesses not specifi-
cally mentioned in the lioense tax ordinance the sum of $25.00 mentioned and provided for
therein. 0n roll call the vote was as follows: C. D. Leffler, yes; J. E. Lummus, yes;
J. I. Wilson, yes; J. H. Gilman, yes; E. C. Romfh, yes. Motion carried.
REQUEST FOR CONSTRUCTION OF TEMPORARY STREET S. W. FIRST ST.
C. C. Rawls and E. H. Eaton appeared before the Commission and requested the Commission
to build and construct a temporary street on S. W. First Street between Ninth And Tenth
Avenues, until such time as the street could be permanently paved, and it appearingto
the satisfaotion of the Commission that the street is a dedicated street and that the
plaoing of a permanent roadway thereon would be a benefit and convenience to the River-
side Baptist Churoh, who were represented by C. C. Rails and E. H. Eaton, on motion of
J. I. Wilson, seoonded by J. H. Gilman, it was resolved that the City Manager be, and
he is hereby, directed to promptly construct a temporary roadway upon 8. W. First Street,
between Ninth and Tenth Avenues, to meet the temporary requirements of the church and in-
habitants of the section, and until such time as permanent paving can be plaoed thereon.
On roll pall the vote was as follows: C. D. Leffler, yes; J. E. Lummus, yes; J. I.
Wi)eon, yes; J. H. Gilman, yes; E. C. Romfh, yes. Motion carried.
SATISFACTION OF MORTGAGE AUTHORIZED
HELD AGAINST A. LOUIS AND WIPE
The City Attorney presented communication addressed to him from the Director of Finance
under date of November 18th, 1922, setting forth a mortgage held by the City of Miami
against A. Louie and Gisella Louis, his wife, dated February 11, 1920, recorded in Mort-
gage Book 104, page 466 to secure the sum of $13,333.34, on whioh there is a balanoe
due March 11, 1923, of #4444.46, on the property in the City of Miami described as:
^The North 121 feet of Lot 3 and the North
46 feet of the South 1/2 of Lots 1 and 2
of Block 19 North, City of Miami, a000rd-
ing to the Knowlton Plat of the said City,
reoorded in the Office of the Cirouit Court
Clerk.“
The Communication stated that the present owner of the property is willing to pay up
the indebtedness and requested a satisfaction of the mortgage. On motion of J. I. Wil-
son, seoonded by J. H. Gilman, the oommunioation was reoeived and filed and ordered
spread upon the Minutes. Motion oarried by the following vote: C. D. Leffler, yes; J.
E. Lummus, yes; J. I. Wilson, yes; J. H. Gilman, yea; E.C. Romfh, yes. Said oommu-

Miami, to secure a note of $4,444.45, which matures Maroh 11,

debtedness, and if you will draw up a satisfaotion of mort-
gage, I will place it in the hands of the Southern Bank do
Trust Company for oolleotion, as per instruotions.

Communication addressed to the Commission from the property owners on Briokell Avenue,
requesting that the park -way on Briokell Avenue from old Seventeenth Street to what
is known as old Broadway be ourbed and guttered and .that the cost thereof be assessed
against the adjoining property owners as provided for by the City Charter, was reoeiv-
ed and on motion of J. I. Wilson, seoonded by J. E. Lummus, the said communication was
ordered reoeived and filed and spread upon the minutes.

of Miami respectfully request that the park -way on Briokell Avenue

Briokell Avenue Park -way is the only extensive park -way in the
City, but it cannot be kept in proper oondition by the adjoining pro-

District H-190 Highway Improvement No. 190.
• BE IT RESOLVED by the Commission of the City of Miami, that
the construction of the following described improvement is here-
by ordered to be made; the Commission of the City of Miami, Fla.,
hereby setting forth ite intention to prooeed under Section 56
of the City Charter.
Desoription of highway or part thereof to be Improved, or
sidewalk to be constructed or sewer to be laid. 'The material,
nature and character of such improvement with the terminal points
and width thereof:
The building and construction of ourb and gutter
on Briokell Avenue, from South -East 5th Street to South -
East 15th Road, including curb and gutter around the pu-
blio Parkway known as Briokell Avenue Parkway, between
S. E. 5th St. and S. E. 15th Road, exoept where suitable
curb and gutter to the proper grade and line is already
in plaoe.
The City Manager is hereby direoted to prepare and to file
with the City Clerk plans and speoifioatione of said improvement
and an estimate of the oost thereof, which estimate shall show
the estimated amount to be assessed against the abutting proper-
ty per front foot, inoluding an estimate of the poet of the ex-
pense of preliminary and other surveys, the inspection and super-
intendence of the work, the preparation of plane and speoifioatione
and estimate, the printing and publishing of notices and prooeed-
ings, the preparation of bonds, and any other expenses neoeosary
and proper. This improvement shall be designated in all proceed-
ings, assessments, and bonds as Highway Improvement No. 190 and
the property against whioh assessments may be made fr the cost
thereof+ hereunder shall be designated as District H-169.00

ested to the onnfirmation of the resolution ordering said improvement:

WHEREAS, on the 21st day of November, 1922, the Commission of the City
of Miami, Florida, passed and adopted a resolution ordering the improvement
designated as Highway Improvement No. 190, District H-190, and directed the
City Manager to prepare and file plans and speoifioations of suoh improve-
ment and an estimate of the oost thereof, inoluding an estimate of the inoi-
dental expenses, and the said plane and specifications and estimate of oost
and estimate of incidental expenses have been filed by the City Manager with
the City Clerk; therefore,
BE IT RESOLVED by the Commission of the City of Miami, that the City
Clerk shall cause to be published for at least once in the MIAMI METROPOLIS,
a newspaper of general oiroulation in the City of Miami, a notioe stating
that at a meeting of theCommisdion of the City of Miami, to be held at the

CLAIM OF LEON 3. LITCHENSTETTER ALLEGED DAMAGE CAUSED BY OPEN SEWER DITCHES
The City Attorney presented communication to the Commission, under date of November
20th, in referenoe to the claim of Leon J. Litohenstetter, to which was attaohed
copy of notice received by the City Attorney. The notioe set forth a claim against
the City on account of damages alleged to have been caused by the failure to pro-
perly light and keep closed sewer openings for sewers under construction by J. J.
Quinn Company. 0n motion of E. C. Romfh, seconded by J. E. Lummus, the oommunioa-
tion,together with the accompanying notice, was reoeived, ordered filed and spread
upon the minutes. The matter was referred to the City Manager for investigation.

NOTICE.
TO THE CITY OF MIAMI, FLORIDA:
Notioe is hereby given that I, Leon.J..Litohenstetter, living at 425 Northeast
25th Street, in the City of Miami, County 'of Dade and State of Florida, on Thursday
night, 0otober 22, A. D. 1922, at the hour of 7:10 p.,tn, a000mpanied by my wife,
baby and mother-in-law•, Mrs. Sophie Ackerman, went to my oar parked at the side of
my house, baoked out into 25th Street, and headed went, and started towards Biscayne
Drive, I was driving at the rate of tea miles per hour; ,the lights of my oar were
turned on, there being no lights in the street, and when three hundred yards from
my house the oar went into a hole abcut four feet deep, I swing to the left to miss
the hole, but the right front wheel failed to.olear and there being no lights on the
street the lights of the car were not euffioient for me to see the hole before being
on top of it; that upon investigation.I found there were three holes and only one
red light, whioh was at the corner of the first avenue east of Bieoayne Drive and
25th Street; that said aooident was due to the negligence of the City of Miami,
Florida, through its agents, by failure to have the openings in the street properly
lighted; that said openings were made by the J. J. Quinn Company, operating under
Sewer Oontraot Sr. 29; that my wife, baby and myself were badly braised and shaken
up, and my mother-in-law, Mrs. Sophie Aokerman, suffered two fraotured ribs, and it
was neoeesary for her to go to the hospital; that my oar was badly damaged and to
the extent approximately of One Hundred Twenty-five (0125.00) Dollars and in oonee-
quenoe of the damages sustained be intend to hold the City of Miami, Florida, res-
ponsible.
This notice is given in oomplianoe'with the Ordinanoes of the City of Miami,
Florida.

ORDERING REMOVAL OF TREE IN ROADWAY ON BRICKJLL AVENUE
The City Attorney presented to the Commission oommunioation-under date of Novemb en
20th, 1922, and on motion of J. E. Lumonue, eeoonded by J. I. Wilson, the said oom-
mnnioation was reoeived and filed and ordered spread upon the Minutes:

Gentlemen:
There is a live oak tree on Briokell Avenue near Southeast
Tenth Street that ie along the edge of the street and not in the
parkway. The tree partially obetruota the street and there have
been several accidents caused by oars running into the tree at
night. The property owners in that neighborhood recommend that
the tree be promptly removed and that it be replaoed by another
tree setting bank into the parkway.
The number of aooidente that have been verbally reported to
me and to other offioials of the City are sufficient in my judg-
ment to charge the City with notice of the danger and have the
tree removed, and for this reason I recommend that the proper of-
f ioere be directed to see to having the tree removed.
It may possibly be that Mr. Deering would be glad to take
this live oak tree and have it removed at his own expense.

,OMPLAIBTCF HOVEL ASSOCIATION AGAINST MUSIC AT LATH HOURS
Mr. W. F. Miller, and others, representing the Hotel Association, appeared before
the Commission and oomplained about the noises and music in restaurants and other
public places after midnight disturbing the guests of the hotels. After disouesion
the Commission decided to take the oomplaint under consideration and to endeavor to
give such relief as might be possible and convenient.
REPORT OF 0]TY MANAGER ON ROOK PITS AND DUMP GROUNDS WITHIN CITY LIMITS
Pursuant to inatruotions given at the last meeting, the City Manager presentedoom-
munioation reporting the condition of all rook pits within the City Limits together
with map showing the location and size of eaoh pit as well ae the owner thereof.
On motion of J. I. Wilson, eeoonded by J. H. Gilman, the report of the City Manager
was reoeived and filed and ordered spread upon the minutes:

Gentlemen:
At the last meeting of the City Commission I,was request-
ed to furnish you a oomplete list of the rook pits within the
City limits, their size, location and sanitary condition.
I have made a personal investigation of these rook pite
with Mr. Murray, and find there are twenty-three rook pits with,
in the City limits, only three or four of whioh are being need
at the present time.

I find all the rook pits in a very good sanitary condition
except two, - the County Rook Pit near the City Inoinerator'and
.the I. E. 3ohilling Pit in the Dale Miller tract. These are the
only two pits where there is any great amount of trash being dump-
ed and they are really very bad and unsanitary. The I. E. Schill-
ing pit, however, is being rapidly filled and Mr. Schilling has a
man at the pit all the time to take oars of the stuff that is be-
ing dumped there. I do not think we will be bothered with this
rook pit very long as it is getting pretty well filled np.
The County Rook Pit is being used regularly as a dumping
ground and owing to its size, will be many a day before it will be
filled up. The City keeps a man at this pit all the time, but in
spite of that, a good deal of stuff is being dumped in the pit
whioh should not be. The City Will take extra preoaution from now
on to see that these pits are kept in a better sanitary oondition.
All the other rook pits in the City are in very good condition
from a sanitary stand point and very little trash is being dumped
in any of them.
I have not yet been able to locate an area for a City Rook
pit, but am looking into this.

4UTNOIZING THE TRANSFER OF $400.00 IN APPROPRIATIONS WITHIN SAME DEPARTMENT
A resolution authorizing the Director of Finanoe to make a transfer in the sum of
Four Hundred Dollars between appropriations within the same Department was intrbduo-
ed by. J. E. Lummus. Said resolution was read in tall as follows:

A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO
MAKE A TRANSFER IN THE SUM OF FOUR HUNDRED DOLLARS BE-
TWEEN APPROPRIATIONS WITHIN THE FIRE DIVISION OF THE
DEPARTMENT OP PUBLIC SAFETY.
WHEREAS, the Direotor of Pubiio Safety has requested the transfer
of $400.00 from the appropriation of Salaries - Fire Department, to
Uniforms - Fire Department, as being necessary for the proper mainten-
anoe of this department; now, therefore,
BE IT RESOLVED by the Commission of.the City of Miami, that the Di-
reotor of Finanoe be and is hereby authorized and directed to transfer
the sum of $400.00 from the unenoumbered balanoe in the appropriation
for Salaries - Fire Department, to the appropriation for Uniforms within
the same department.
0n motion of J. I. Wilson, seconded by J. H. Gilman, the said resolution was passed

AUTHORIZING REDEMPTION OF CERTAIN TAX SALE CERTIFICATES BY DIRECTOR OF FINANCE
A resolution authorizing the Direotor of Finance to redeem certain tax sale oertifi-
oates was offered by J. H. Gilman:

A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE
TO REDEEM 1917 TLX SALE CERTIFICATE NUMBER 396,
1919 TAX SALE CERTIFICATE NUMBER 540, AND THAT POR-
TION OF 1920 TAX SALE CERTIFICATE NUMBER 736 APPLI-
CABLE TO THE WEST HALF OF LOT 7, MIRADO COURT.
WHEREAS, the Direotor of Finance reports that property desoribed ae
the "NWT of Na of SEt of Sat, less the North 9 feet and less tracts each
150 feet square in the Northwest Corner and Northeast Corner, Seoti0n 3,
Township 54, Range 41" was assessed twioe on the 1917 Tax Roll, both des-
criptions appearing on Page 92, and while 1917 Tax Reoeipt $2595 svidenoee
payment of taxes, the duplicate assessment was sold on Tax Sale Certifioate
396 for taxes in the sum of $1.95; and
WHEREAS, Lot 6, Block 71 North is owned by the City of Miami and was
erroneously assessed for taxes on the 1919 Tax Roll in the sum of 015.95
and sold on Tax Sale Certifioate $540; and
WHEREAS, the West half of Lot 7, Mirado Court was sold for 1920 taxes
and included in Tax Sale Certificate $736 in the sum of $21.55 when pay-
ment had been properly made and entered in the 1920 Rax Roll; now, therefore,
.E IT RESOLVED by the Commission of the City of Miami, that the Di-
rector of Finance be, and is hereby, authorized and direoted to redeem 1917
Tax Bale Certificate $396, 1919 Tax Sale Certifioate #540, and that portion
of 1920 Tax Sale Certifioate #736 applicable to the West half of Lot 7,
Mirado Court.

The Olerk reported that, pursuant to resolutions 546 to 550, passed and adopted Nov-
ember 14th, he had oaused to be published in the Miami Metropolis notice•that the 0om-
mission would on the 21st day of November hear the remonstrances of all persons inter-
ested to the oonfirmation of resolutions ordering Highway Improvement No. 189 and
Sanitary Sewer Improvements 56 to 59, both inolnsive, and submitted proofs of publica-
tion of suoh notice to the Publio. It was then announoed that the Commission was
ready to hear the remonstranoes of any person interested to the oonfirmation of the
resolutions ordering said improvements. No remonstrances to the confirmation of said
resolutions were received.
