MINUTES OF THE MEETING OF THE BOARD OP COMMISSIONERS OF THE CITY OP MIAMI, FLORIDA. On the 7th day of November, A. D. 1922, the Commisoion of the City of Miami met in regular session at the City Hall, in Miami, Florida. The mooting wee called to order at 9:00 0' clock a. m. by Chairman Leffler, and upon roll call the following members were present: C. D. Leffler, J. M. Lumeate, J. I. Wilson. ABSENT: E. C. Romfh and James E. Gilman. READING OF THE mum OF OCTOBER 31Se' The Clerk read the minutes of the meeting of October 31st which were approved and aceept- ed as written. CLOSING OF PARTS 07 STREETS NEAR BAY N. E. BAY SHORE COURT AND FOURTH AVENUE The City Attorney presented a communication addressed to the City Commission under date of November 1st, in reference to closing part of Northeast Fourth Avenue and part of Northeast Bay Shore Court, which on motion of J. E. Lummus, seconded by J. T. W110011, was received end filed. Thereupon an ordinance entitled "An Ordinance Discontinuing and Clos- ing the South Fifty Feet of Northeast Fourth Avenue and the South One Hundred Feet of Northeast Bay Shore Court", was introduced by J. I. Wilson, and on his motion, seconded by J. E . Lummus, the eaid ordinance was given its first reader and read by,title only. Moved by J. I. Wilson and seconded by J. E. Lummus that the said ordinance be passed on its first readiae. 0n roll call the vote was as follows: C. D. Leffler, J. E. Lummus, yes; J. I. Wilson, yes. Motion carried and the said Ordinance passed on its first reading. PROTEST OF HELEN 1. S. GeSENHOW AGAINST CLOSING OF ABOVE STREETS The protest of Helen M. e. Greenhow against the passage of the Ordinance discontinuing and closing the South 50' of Northeast Fourth Avenue and the South 100' of Northeast Bay Shore Court was received and on motion of J. I. Wilson, seconded by J. E. lernmus, the said communication vas received and filed and ordered to be spread upon the minutes: Miami, Florida, November 7, 1922. To the Honorable City Commission: As the owner of lot 8, Block 6, Windsor Park, which abute upon Northeast Bay Shore Court, I hereby enter formal protest to closing said Court as proposed by ordinance to be submitted to your body. I do this because of my vested interest in this street its entire length, believing that closing even a portion of it will injure thc value of my property. When this street was laid out, there vas every reason to believe that Bald street would be extended southward whenever ad- ditional lend was eubdivided. It =lad only revive the purchase of a strip 40.xe0 feet through the oil company's property tocon- nect Northeast Bay Shore Court with the City dock property. That there will be need for such an opening to tne city dock is apparent to any one examining the map. It would provide for an additional outlet direct to the Causeway and Miami Beach, and connect at an angle with a through street running North. A lease to the oil company of such portion of the street as is needed might be given by the city on condition that the oil company agree to dedicate the street through its property whenever the city ehould find the necessity of opening up the entire street. To this I would not objeet, but feel compelled under the circum- stances to formally protest against the passage of the present or- dinance. Respectfully submitted, HELEN M. 6. GREENHOW Mr. Junkin appeared before the Commission on behalf of Mrs. Greenhow, who had filed the aforesaid written protest and on her behalf objected to the passage of the ordi- nance so far as it affects the closing of the Street ehown as Northeast Bay Shore Drive. DELEGATION FRth LAPATTAB REQUESTING CITY' S AID IN CLEARING DITCH A committee, eoeposed of F. P. Moss, J. N. Wheatley and O. Vermeulen, representing the Allapattah AF;SOCiatiOn appeared before the Comtiosion, making complaint against the drain and raquesting the eity's aid in clearine the ditch or drain running thru the Al- lapattah section and thru the Golf Grounds north as far as Johnson Street - the ditoh or drain being ;Inown as eiagner'e Creek - etatine to the Commission that the ditch was unsanitary and a menace to the health of the people of Allapattah and requested the Com- mission to to.o such action as mig.ht be necessary to clean out the ditch and relieve the situation. 0n motion of J. hummus, seconded by J. I. Wilson. it was resolved that the matter Le referred to tha Oity Nanager to take up with the Committee of Allapattah and with authority to take such action on behalf of the City as might result in the cleaning out of the 6:ain and abniting all nuisance complained of. A RESOLUTION AU°THORIZING THE MAYOR AND CITY MANAGER TO EXECUTE, ON BEHALF OF THE CITY OP MIAMI, A DEDICATION OP PART OF LOT NINE OR "GULDCOURT" AND LOTS FIFTE1N, THIRTY-SIX AND THIRTY-SEVEN OF "BANKER'S PARK", ADDI- TIONS TO THE CITY OF MIAMI, FOR THE OPENING OF NORTH- EAST THIRD AVENUE THROUGH SAID LOTS AND PARTS 'Jr SAID LOTS AND THAT THE DEDICATION OF SAID PROPERTY AS PUBLIC STREETS AND THE DEDICATION OP PART OF SAID LOT THIRTY- SIX AS A PUBLIC PARE. WHEREAS, the City of Miami hao acquired lot fifteen and lit thirty- six of Banker's Park, and part of lot thirty-seven of said Banker's Park, and part of lot nine of Goldcourt, additions to the City of Miami, fox the purpose of opening Northeast Third Avenue, in a northerly direction thru the said lots, and for the purpose of a public park in the Southwest cor- ner of said lot thirty-six; now, therefore, BE IT RESOLVED by the Commission of the City of Miami, that the Mayor and City I:anager be and they are hereby authorized to execute, on behalf of said City, a dediontion of the said property so owned and acquired by said City for street purposes and for public park purposes, as shown upon plat approved by the Director of Public Service. Rose, presented the City Commission a communication addressed to e him under date of November let, from Armstead Brown, in reference to the suit of the State ex rel L. T. Norwood against the :,Iiami Water Company to which was attached com- munication from the City Attorney stating that he could not see that the City is in- terested in this private litigation and unless otherwise instructed ho would not re- sist the motion to dismiss the proceedings. 0n motion of J. I. Wilson, seconded by J. E. Lummus, the communications were received and filed and the communication of Arm stead Brown ordered spread upon the minutes. IDear Judge; 1 I have filed a motion to dismiss the mandamus proceeding en- titled State ex rel L. T. Norwood, V. Miami Water Company, in our Circuit Court here, for want of prosecution; no steps having been taken by the relator in the proceeding since May, 1919. I have set this motion down for hearing on November 8, 1922, at two p. m., be- fore Judge Branning and am serving a notice of the hearing on Mr. L. T. Norwood personally. The purpose of this proceeding was to make the Water Company allow IIr. Norwood to pay one minimum service charge for water ser- vice to his rr idence and also to a dwelling on the rear of his lot which ho rented out. He contended that we were discriminating against him in requiring him to pay'two minimum service charges of 0 per quarter. We thought that his contention was far from well founded, and filed a return, and then an amended return. Since then nothing has been done. '++1ie1. tt_is proceedir:g has begun, the petition was prepared and filed by the then City Attorney, but I could not understand why the City Attorney shoeld take the matter up. The successor to that City Attorney, Le. S. P. Robineau, never took any steps in the matter, and I do not think that you have ever considered that this case was properly a city case. In fact, I do not know that you have this case on your docket, but ? thought I would let you know about this motion to dismiss as information. GASOLINE STORAGE PLANT DECLINING REQUEST OF PENINSULAR STATE OIL COMPANY A communication from Shaw Northers, Agents of the Peninsular State Oil Company, under date of November 6th, 1922, addressed to the City Manager to which was attached oom- munication from the Sun Company, the Fire Chief Marshall of Philadelphia, and the Chief of the fire Department of the City of Miami, requesting the Commission to grant them authority to install a four hundred thousand gallon gasoline storage plant within the City Limits upon the property lying on the west side of the southeast Second Ave., on the north side of Miami River, lying a little more than 300 feet on the north river line and a little more than 200 feet along the west line of Second Avenue, and bounded on the north by the Mathewson property about 200 feet, was received and after a dis- ouesion of the communication by the meters of the Commission it wae the unanimous op- inion of the Commission that the permit for the installation of such a storage tank upon the property designated in the communication would not be to the best interest of the -City; that such an inotallation should be in some other location and thereupon mo- tion of J. E. Lummus, seconded by J. I. Wilson, it was resolved that the said request be declined. On roll call the vote was as follows: C. D. Leffler, you; J. E. Lum- mus, yes; J. I. Wilson, yes. AUTHORIZIIAG PURCEASE OF NEW STREET SWEEPER FOR CITY The City hanager reported to the Commission that the City needed a new street sweeper and that the cost thereof would be in the neighborhood of 0,000 or 0,000. On mo- tion of J. Lummus, seconded by J. I. Wilson, it was resolved that the City Manager be,and is hereby, authorized to purchase a new motor driven street sweeper and to re- port same t.n the City Commiosion. AOCEPTING DEDICAo!ION UP STREETS sUBDIVISION KNOWN AS "HOLLEMAN PARK" An Ordinance entitled "An Ordinance Accepting tho Dedication of the Streets of the Subdivision in Section 30 and 39 in Township 54, South, Eange 41 East, Known as "Holleman Parh", was introduced by J. I. Wilson, and on his motion seconded by J. E. Lummus, it was resolved that the charter requirement for readings of Ordinances on two separate occasions be, and in hereby, dispensed with by the following vote: C. D. Leffler, yes; J. E.
