MINUTES OF THE MEETING OF THE BOARD OF 00?MISSIONERS OF THE CITY OF MIAMI, FLORIDA.
0n the 31st day October, A. D. 1922, the Commission of the City of Miami met in
regular session at the City Hall, in Miami, Florida. The meeting was called to order
at 9:00 o'clock a. m. by Chairman Leffler, and upon roll call the following members
were present:
C. D. Leffler, J. E. Lwnmus, J. I. Wilson, E. C. Romfh.
Jas. H. Gilman, who was out of the City.

The Clerk read the minutes of the meeting of October 24th which were approved and ao-
oepted as written.
RECEPTION OF BIDS
FOR CONSTRUCTION OF COLFORT STATION
This being the day named for the reception_ of bide for labor and material to erect and
complete comfort station according tp plans and specifications of A. E. Lewis, Archi-
tect, the City Manager submitted the following sealed bids:
Goo. N. Smalridge Const. Co., 42571.00, with the state-
ment that if the floor was changed to concrete with two coats
of Bordner and one coat of Cement paint deduct the sum of $125.00.
Sandquist & Snow, Inc., 42757.00. This bid expressly states
that it does not include screens for doors and windows, elec-
tric work or plumbing.
Will A. Otter, 42800.00.
At the same time there was received the following bids for the labor and material ne-
cessary for the installation of the plumbing work of the comfort station:
Alexander Orr, Jr., 41350. The bid stating that the sewer from
the building is to terminate at the curb and that the extensions
and connections to city sower are not included in the bid.
E. J. ,unborn, 41590, with the statement that the bid includes
making sewer and outer connections. The replacing of Asphalt
paving and street permit not included. The bid also stated that
IF 10 Flushon,eter closot combinations and one 6 foot trough
urinal with integral back, enameled inside, were used in the
p1aee of there previously stated in the bid, then to deduct from
the bid 005.00; and if the following fixtures: 10 Water closets
with high painted tanks and one 6 foot trough urinal with inte-
gral back, enameled inside, are used in the place of those first
specified, then to deduct the sum of $503.00.
Each of the said bide were accompanied by certified chocks or cash for 2/0 of the
bid. There Brae also received a bid of Pullen -loll Electric Company for the electric
work in the comfort station according to the plans and specifioations for $115.21,
with an alternate for furnishing fixtures known as PZ #802, 491.21; and with an al-
ternate bid for all cork as recited in the bid excepting fixtures and installation,
$71.21, and in the ,event of the substitution of non lock flush switches and stuck
up plates for los: ::witches with solid plates, deduct 45.28.
And it appearing from the bids that the bid of Geo. N. Smalridge Const. Co., of
$2446.00 for furnishing all labor and materials and erecting and completing comfort
station according to the plans and specifications prepared by 21. E. Lewis, Architect,
was the lowest and best bid the following resolution was introduced by J. E. Lummus:

BE IT RESOLVED by the Commission of the City of Miami, that the bid
of Geo. N. Smalridge Construction Co., for the construction and erection
of Comfort Station according to plane and specifications prepared by A. E.
Lewis, Architect, be and the tame is hereby accepted.
BE IT FURTHER RESOLVED that all bids for the plumbing and electric
work on said building be and the same are hereby rejected.
BE IT FURTHER RESOLVED that the City Manager be and he is hereby di-
rected to cause the plumbing work to be installed by the City if the cost
thereof does not exceed the sum of 41,000.00.
BE IT FURTHER RESOLVED that the City Manager be and he is hereby di-
rected to cause the electrical work to be installed by the City if the
cost thereof does not exceed the sum of :1,000.00.
BE IT FURTHER RESuLVED that the checks and money accompanying the
bids of the unsuocessful bidders be returned by the Clerk to such bidders.
Moved by J. Lummus and seconded by J.I. Wilson that the said resolution be pass-
ed and adopted. On roll call the vote thereon was as follows: C. D. Leffler, yes;
J. E. Lummus, yes; J. I. Wilson, yes; E. C. Roan, you. Motion carried and the said
resolution passed and adopted.

Communication from Tatum Bros. Company in reference to agreement between the City and
that Company for street car line extension, was received, and on motion of J. I. Wil-
son, seconded by J. E. Lummus, the said communication was received and filed.

PURCHASE OF ADDITIONAL STREET OARS FROM. J. G. BRILL COMPANY
The City 'Manager presented communication from the J. G. Brill Company of Philadel-
phia under date of October 24, 1922, in referenoe to the purohase of 4 street cars,
and on motion of E. C. Romfh, seoonded by J. E. Lummus, the said communioation was
received and filed and ordered spread upon the minutes.

We take pleasure in handing you herewith con-
tracts in duplicate covering the four safety cars, the
order for which you so kindly planed with our representa-
tive, Mr. George Frey a few days ago.
We have taken care of the various details in the
contract and addenda to specifications, and believe you
will find this entirely in order,
We have the cars under construction now, and you
can rest assured that every endeavor will be made to make
shipment of these cars so they will be received in Miami
about the first of January.
Mr. Prey elaborated fully on the entire transac-
tion, and all the various details will be cared for in ao-
oordance with your wishes.

executed on behalf of the City of Miami, returning it for
our record.

Accompanying the communication was the form of contract for the purchase of the
cars for the sum of 425, 600; 25%, 46400, to be paid on or before January 2, 1923,
and the balance of 419,200 to be paid on or before February 15, 1923; and the
City Manager requested authority to sign the contracts on behalf of the City,

Miami. Florida,
October 30th, 1922.
In pursuano;e to your authority I have had a deed of
exchange executed between the City and Ethel H. Threadgill and
her husband, Percy Threadgill, whereby the City acquires a con-
veyance :for the part of the 3. W. corner of Lot thirty-seven_
(37) of "Bankers Park", and the City conveys a strip five (5)
feet wide off the East side of a part of Lot thirty-six (36) of
"Bankers Park" to Mts. Threadgill.
In as much as Lot thirty-seven (371 is encumbered with
a mortgage for Sixty-five hundred dollars ( 6500) I included a
provision in the deed of exchange vh eroby if the mortgage was
not paid and was -foreclosed and the City lost its title and
right of possession to the property convoyed by it by Ltrs.
Threadgill, that in such event the title to the five (5) foot
strip conveyed by the City should immediately revert to the City
free from any claim of LIrs. Threadgill, her heirs or assigns,
but also providing that if the mortgage was satisfied as to the
piece of property conveyed by Mrs. Threadgill, that in suoh event,
the provision as to the reversion of the five (5) foot strip should
be null and void.

CONTRACT BETWEEN CITY OF MIAMI AND ARTHUR PRYOR FOR MUSICAL CONCERTS
The City Manager presented to the Commission contract executed in triplicate by Ar-
thur Pryor for musical band service commencing December 12, 1922, and ending April
2, 1923, at and for the sure of 05,600, payable in weekly installments of $2225 on
Monday at the end of each week's performance. The proposed contract as executed by
Mr. Pryor is the form proposed by the City Commission and on motion of J. S. Lummus,
seconded by J. I. Wilson, it was resolved that the City Manager be and he is hereby
directed and authorized to execute the contracts in triplicate on behalf of the City
of Miami.
CANCELLING CERTaIIt LIENS AGAINST SCHOOL PROPERTY AND DECLINING TO CANCEL CERTAIN OTHERS
Mr. W. H. Price presented to the Commission communication under date of October 23,
1922, signed by 1. E. I+cCaskill, County Attorney, addressed to H. H. Filer, Chairman
of the Board of Public Instruction, setting forth liens for taros and improvements
held by the City against lots 14 and 15, Block 85 North, Lots 16 to 19, inclusive, in
the same block and other lots in the same block, with the request that the City take
some action to relieve the property from the taxes set forth in the communication and
from the liens of the City for improvements. Mr. Price requested that the Board take
such action that in their discretion they thought proper for the purpose of relieving
the property described from taxes and liens. 0n motion of J. I. Wilson, seconded by
E. ;. Romfh, the said communication was reoeivod and ordered spread upon the minutes:

I have ermined the abstracts of title which you sub-
mitted to me with reference to the Central School property.
I find that lots 14 and 15 of Block 85 North of Miami,
Florida, according to a plat recorded in Plat Book B, at
page 41, of the Public Records of Dade County, Florida, which
is a part of the Central School property, mas deeded to Spe-
cial Tax School District Number 2 of Dade County, State of
Florida, a corporation. I shall want the Trustees of that
school district to make a special warranty deed as such trus-
tees to the Board of Public Instruction of Dade County, Flori-
da. If you get the deed you need not place it on record as
yet. I understand :.'rs. Warner, i.x. E. P. Duncan and H. K. B.
Davis were thooe trustees. Whoever the trustees are, I shall
want a certified copy of :It:.ch proceedings in your office as
will shoe: that they were elected to that office, when they were
and that they still hold that offioe.
I find lots 16 to 19, inclusive, in the came block are
iecumbered with liens in behalf of Miami, Florida, as follows:
1. Paving lien, '4755.58, with interest at 6 per cent.
from November 5, 1915.
2. Storm sewer lien, y1;274.56, with interest at 6per
cent. from February 4, 1916.

Lot 20 is vested in "T. V. Moore, M. D. Frice, A. E. Hey-
ser, Trustees of Special School District Number 2 of Dade
County, Florida, and their sueoesnors in offioe." I shall re-
quire a quit -claim deed from the present trustees of that school
district, together with certifiedcopy of your prooeedings show-
ing who the present trusteee are, when they were elected and
that they still hold office. This lot is also incumbored in be-
half of Miami, Florida, as follows;
1. Sidewalk lien filed March 8, 1904, for $16.05. See lien
Book 1, page 37.
2. Paving lien, $436.44, with 6 per cent. from 1,1ay 1, 1916.
3. Paving lien for $188.91 with 6 por cent. from November
25, 1912.
4. Storm sewer lien for '66.64 with 6 por cent. from Febru-
ary 4, 1916.
You will note that some of the tax liens exist in behalf of
Miami and oue sidewalk lien made in 1904 exists in behalf of Miami.
Perhaps you can go before the City Council and have them authorize
the satisfaction of these liens, executed by the proper authority,
to be placed on record so as to clear the title of such liens.
The other liens for paving and storm sewers are relatively
recent lions in behalf of the City of Miami. It may be that the
City Commissioners could be induced to satisfy these liens for the
benefit of the school. They amount to a considerable sum. If not,
it may be that the County will require you to pay them from the pro-
ceeds of the moneys to be paid to you, but you might see what can •
be done with the City Commissioners. It would be well to take these
matters up as soon as possible so that the proper machinery may be
put into motion to have a termination one way or another.

The City Attorney reported to the City Commission that the School property is and.
has been for many years exempt from taxation under the statutes of this state pass-
ed in pursuance to the Constitutional provision authorizing such exemption and the
said property was improperly assessed for taxes. After some discussion among the
members of the Commission it was decided that all liens filed for taxes and lien
filed for $16.05 on March 8, 1904, for sidewalk improvement, be cancelled, and there-
upon the following resolution was introduced by J. I. Wilson:

WHEREAS, it appears that the Central School Property has been im-

WHEREAS, it appears that the lion filed for 0.6.05 on March 8,
1904, appearing in Lien Book 1, page 37, was filed prior to the passage
of the special charter of the City of Miami in 1905. and the right of
the City to file such a lien being doubtful, and
WHEREAS, it appears from the City Charter of 1915 and 1921 that
the following provision appears therein:
"Dada County, and any school district, or other poli-
tical subdivision, wholly or partly within said city,
shall possess the same power and be subject to the
same duties and liabilities in respect of said as-
sessments affecting their real estate that private
owners of real estate possess, or are subject to here-.
under, and such real estate of said county, school dis-
tricts and political subdivisions Shall be subject to
liens for said assessments in all cases where the same
property would be subject had it at the time the lien
attache been owned by a private owner."

power or authority to relieve said property from the payment of the
paving, storm sewer and other liens set forth in the communication of
G. E. Me]askill, excepting the sidewalk lien of Mareh 8, 1904, afore-
said; now, therefore,

Director of Finance be and he is hereby authorized to canoel liens for
taxes held by the City of Miami set forth in the communication of G. E.
MeCaskill, addressed to H. H.Filer, Chairman Board of Public Instruction,
under date of October 23, 1922, and to cancel the sidewalk lien filed on
March 8, 1904 for 0.6.05 as recorded in Lien Book 1, page 37.

ORDERING CERTAIN IMPROVEMENTS HIGHWAY AND SANITARY SEWER
The following resolution ordering the construction of Highway Improvement H-189 and set-
ting forth the intention of the City Commission to proceed under Section 56 of the City
Charter was introduced by J. I. Wilson:

That the construction of the following described improvement is hereby

The City Manager is hereby directed to prepare and to file with the City
Clerk plans and specifications of said improvement and an estina to of the boat
thereof, which estimate shall show the estimated amount to bo assessed against
the abutting property per front foot, including an estimate of the °oat of the
