D. 1922, the Commission of the City of Miami met at the City Hall in Miami, Florida, in regular session. The meeting was called to order at 9 o'clock a. m., by Chairman Leffler and on roll call the following members were present: ABSENT: READING OF MINUTES The Clerk read proved. C. D. Leffler, J. E. MEETING OF SEPTEMBER 5 the minutes of the meeting of September bth which were accepted and ap- APPROVING CONTRACT WITH COMER-EBSARY CO. FOR CONSTRUCTION OF BRIDGE AT SW 2ND AVE. A resolution approving the contract between the City of Miami and the Comer-Ebsary Foun- dation Company was introduced by J. E. Lummus and was read in full as follows:. RESOLUTION N0. 503. A RESOLUTION APPROVING THE CONTRACT BETWEEN THE CITY OF MIAMI AND THE COMER-EBSARY FOUNDATION COMPANY. WHEREAS, a contract between the City of Miami and M. F. Comer and W. H. Ebeary, partners, doing business under the firm name and style of Comer -Binary Foundation Company, for the ereotion and construction of a bridge across the Miami River at Southwest Second Avenue having been submitted to the City Com- mission by the City Manager and the contract having been approved as to form by the City Attorney; now, therefore, BE IT RESOLVED by the Commission of the City of Miami, that the said con- tract be and the same is hereby approved by the City Commission of the City of Miami. CLEANING AND MAKING SANITARY AND FREE FROM WEEDS CERTAIN LOTS LEVYING TAX OF ACTUAL COST A communication to the City Commission from the City Manager stating that in pursuance of Resolution No. 488, passed August 8th, 1922, directing the cleaning of lots, he had cleaned the lots and giving statement of the actual cost of cleaning and the names of the owners, was reoeived and on motion of J. H. Gilman, seconded'by J. E. Lummus, was ordered spread upon the minutes. The said communication is as follows: The City Commission, City of Miami, Fla. Gentlemen: Miami, Florida, September llth. 1922. In pursuance of Resolution # 488 passed and adopted on August 8th, 1922, directing the City Manager to remove or cause to be removed the weeds from, and to clean and make sanitary the lots and parcels of land described in the said resolution, and to keep an accurate and correct account of the actual cost of cleaning said lots of weeds and making the same clean and sanitary, and to make report thereof to the City Commission so that the costs thereof might properly be assessed against each of the said lots and paroels of land and charged to the owners or occupants of said lots or parcels of land, I beg to report that the lots described in the said resolu- tion have been cleaned and made sanitary and free from weeds and that the following list made a part hereof, shows accurately and clearly the actual cost of cleaning said lots and parcels of land of weeds and making the same sanitary and clean, and that the said cost should be properly assessed against each of said lots and parcels of land and charged to the owners or occupants of said lots or paroels of land, the names of said owners of said lots and parcels of land be- ing shown on the list attached hereto and made a part hereof. Gilman and was read in full: RESOLUTION N0. 504 A RESOLUTION LEVYING TAX OF THE ACTUAL COST OF CLEAN- ING AND MAKING SANITARY AND FRES FROM WEEDS THE PROPER- TIES AND LOTS HEREIN DESCRIBED. WHEREAS, on August 8th, 1922, the Commission of the City of Miami passed and adopted Resolution No. 448 which direoted the City Manager to remove or cause to be removed the weeds from, and to clean and make sanitary the lots and paroels of land in the City hereinafter described, and to keep an aoourate and correct aecoount of the aotual cost of cleaning said lots of weeds and mak- ing the same clean and sanitary, and to make report thereof to the Commission so that the post therof might be properly assessed against each of the said lots and parcels of land and charged to the owners or occupants of said lots or paroles of land, and WHEREAS, the City Manager has reported that he has caused to be cleaned in pursuance of said Resolution No. 488 the lots hereinafter described on the day set forth in said report, said report also showing the name of the owner or occupant thereof, and The City Commission does find that said report is correct and that the aotual cost of said work for each of said lots is as set forth in said re- port of said City Manager; now, therefore, BE IT RESOLVED by the Commission of the City of Miami, that the said re- port of the said City Manager be and the same is hereby confirmed, and that the said work is hereby accepted, and that each of the said lots is hereby assessed with the actual cost of the cleaning thereof as follows: Description of Property Lots 18-19-20 Law. AUTHORIZING CLEANING OF CERTAIN LOTS BY THE CITY OF MIAMI A resolution authorizing the City Manage, to olean, keep clean, sanitary and free from weeds the properties and lots described in the resolution was introduced by Mr. J. I. Wilson and was read in fall. The said resolution is as follows: RESOLUTION NO. 505. A RESOLUTION AUTHORIZING THE CITY MANAGER TO CLEAN, KFh;P CLEAN, SANITARY AND EREE FROM WEEDS THE PROPER- TIES AND LOTS HEREIN DESCRIBED. COMMUNICATION FROM ARMSTEAD BROWN IN RE MIAMI WATER FRONT The City Attorney presented to the Commission a communication addressed to him from Arm - stead Brown, Division Solioitor for F. E. C. Ry. Co., in reference to the Miami Water Front property. On motion of J. H. Gilman, seconded by J. E. Lummus, it was resolved that the communication be spread upon the minutee. Judge A. J. Rose, City Attorney, Miami., Florida. Dear Judge: In re: Miami Water Front. Miami, Florida, Aug. 23, 1922. Pile 346. Some months ago, I brought suits in unlawful detainer in the name of the Railway Company for the use and benefit of the City, against all of the old tenants which the Railway Company had at the time of the transfer of the water front property who reused either to rent to the City or to move out upon demand. After the bringing of these suite, one of the defendants, J. R. Hamer, entered into a contract of lease with the City, and I dismissed the suit as to him. Three others of the defendants moved out before trial of their cases, leaving only one of our old tenants occupying space leased from ue, to -wit: one L. H. Whitney, who had a lease covering that space on the water front at a point about 100 feet south of the South line of Northeast Fifth Street, oocup ied by the bouseboat "Egret" in which he was living. This was a somewhat indefinite description but I finally succeeded in getting a judgment against Whitney on July 29, 1922, and a writ of possession was issued under this judgment, and the sheriff informs me that Whitney has been ousted from the spaoe desoribed in the writ. This oompletes the carrying out of the Railway Company's guarantee to oust all of our old lessees of water front spaoe who held over against the objection of the City and refused to attorn to, or rent space from, the City. REGULATING THE DISTRIBUTION OF HANDBILLS ON PUBLIC STREETS An ordinance regulating the distribution of handbills, and other notioee of advertisement upon the public streets of the City of Miami, aril providing a penalty for the violation of the ordinance was introduced by J. I. Wilson, and on motion of J. H. Gilman, seconded by J. E. Lumraue, it was resolved that the charter for readings of ordinances on two separate occasions be and the same is hereby dispensed with by the following Note: C. D. Leffler, yes; J. E. Lummus, yes; J.I.Wilson, yes; J. H. Gilman, yes. On motion of J. I. Wilson, seconded by J. H. Gilman, the said ordinance was given its first reading and read by title only. Moved by J. I. Wilson and seconded by J. H. Gilman that the said ordinance be passed on its first reading. 0n roll call the vote was as foliage: C. D. Leffler, yes; J. E. Lummus, yes; J. I. Wilson, yes; J. H. Gilman, yes. Motion carried and the said ordinance passed on its first reading. On motion of J. I. Wilson, seconded by J. H. After an examination of the plat of the subdivision the members of the Commission agreed with Mr. Taylor that his protest was justified, but were of the opinion that there was no remedy unless Mr. Krull, the owner of the subdivision, would voluntarily ohange the looation of the streets in the subdivision. TRANSFERS BETWEEN APPROPR IAT IONS WITHIN SAME DEPARTMENT A resolution making oertain transfers between appropriations in the same department was introduoed by J. H. Gilman and was read in full as follows: RESOLUTION NO. 506. A RESOLUTION MAKING CERTAIN TRAN S?1RS BETWEEN APPROPRIATIONS IN THE BALL DEPARTMENT. WHEREAS, the Director of Public Safety, and the Direotop of Publio Servioe request certain transfers between appropriations within their departments as necessary for the proper maintenance and operation of the various divisions in their departments; now, therefore, BE IT RESOLVED by the Commission of the City of Miami, that the Di- rector of Finance be and he is hereby authorized, and directed, to make transfers between appropriations, within the Department of Public Safety and the Department of Public Service, as follows: Section 1. To transfer the sum of 46800.00 from the uninoumbered balance in the appropriation for Street Repairs - Materials to the fol- lowing appropriations: Wages - Laborers - Sewer Maintenance 44,000.00 Repair - Materials - Sewer Maintenance 1,000.00 Salaries - Plumbing Inspectors 1,800.00 Total 46,800.00 Section 2. To transfer the sum of 01500.00 from the unincumbered balanoe in the appropriation repairs to roadbed - Municipal Railway to Wages - Laborers - Municipal Railway. Section 3. To transfer the sum of $500.00 from the unino mubered balanoe in the appropriation for Maintenance and Operation other Appa- ratus - Fire Department, and 4150.00 from the unincumber ed balanoe for Power High Pressure Station - Fire Department, aggregating 4650.00 to the oredit of the appropriation for gasoline and oil- Fire Department. CONTRACT WITH ARTHUR PRYOR REFUSED BY COMMISSION The City Attorney submitted to the Commission proposed contract between the City of Miami and Arthur Pryor for the furnishing of musical concerts during the coming Winter. Upon examination it appeared that the contract was a three party contract which was objected to by Commissioners Lummus, Wilson and Gilman. Chairman Leffler stated that while it was a very poor contract it was the only agreement under which Mr. Pryor would be able to come to Miami and furnish concerts this winter. After some discussion the matter was referred to the City Attorney with instructions to draw up a contract to be signed by Mr. Pryor and The City of Miami which would exclude the local Musicians Union as a party to such contract. REPORT OF CITY MANAGER ON MEETING OF FLA. LEAGUE OF MUNICIPALITIES City Manager Wharton submitted to the Commission a report of the convention of the Flori- da League of Municipalities which was held in Orlando recently. 0n motion of J. I. Wil- son, seconded by J. H. Gilman, the communication was ordered spread upon the minutes and is as follows: City Commissioners, Miami, Fla. Gentlemen: Miami, Florida, Sept. 11, 1922. I beg to hand you herewith a brief report of the con- vention of the Florida league of Municipalities which was held in Orlando on last Thursday, the 7th inst. There were twenty-five cities represented and about sixty delegates in attendance. The morning session was taken up largely by reports of the standing committees. After the morning session, we attended a "get together" luncheon at the Chamber of Commerce Building. At the afternoon session of the League, a great many in- teresting topioa were discussed, the two principal topics being Municipal Ownership of Public Utilities and Traffic Problems. The Convention as a whole was very interesting and in- structive. Miami was unanimously chosen as the meeting place for the next convention which will be held the first Thursday in Feb- ruary. It was thought best to hold this meeting at this time as there may be some State Legislation sought at the next session o , the Legislature, and this would give us sufficient time in which to shape up any bills that we may want passed.
