On this 7th day of March, A. D. 1922, the Board of Commissioners of the City of
Miami met in regular session at nine o'olook a. m. at the Oity Ball at Miami,
Florida, there being present, on roll oall, the following:

NEW PLUMBING ORIINANCE PIRST READING
Mr. J. E. Lummus introduced an ordinance to regulate plumbing, drainage and the in-
epeotion thereof, and for the examination, licensing and registration of plumbere,
as provided by the City ordinanoes, and on motion of J. H. Gilman, seconded by E.
0. Romfh, the said ordinanoe was given its first reading and read by title only as

Mr. J. E. Lummus introduced a resolution authorizing the Director of Finance to re-
deem a Tax Certificate reporting the sale of Lot eight (8) of Block seventeen (17)
of Robbins, Graham & Chillingworth's Addition for unpaid City Taxes for the year
1916, whioh was read as follows:
RESOLUTION NO. 159.
A RESOLUTION OF THE CITY OF MIAMI, FLORIDA, AU-
THORIZING THE DIRECTOR OF FINANCE TO REDEEM A
TAX CERTIFICATE REPORTING THE SALE OF LOT EIGHT
(8) BLOCK SEVENTEEN (17) OF ROBBINS, GRAHAM
& CHILLINGWORTH' S ADDITION FOR UNPAID C IlYY TAXES
FOR THE YEAR 1916.
WHEREAS, it appears that Lot 8 of Block 17 of Robbins, Graham
and Chillingworth'e Addition was sold for City taxes for the year 1916,
amounting to $7.50, and that said lot during the year 1916 was the pro-
perty of the People's Congregational Church, and exempt from taxation;
now, therefore:
BE IT RESOLVED by the Commission of the City of Miami:
That the Director of Finance be and he is hereby authorized
to redeem the said certificate, paying the amount necessary out of the
appropriation for tax refund.

An ordinance reluirin . all street railway companies operating within the City of
Miami to furnish separate accommodations for white and colored passengers was intro-
duced by E. C. Romfh, and on motion of J. H. Gilman, seconded by J. I. Wilson, it
was resolved that the charter requirement for readings of ordinances on two separate
days be and is hereby dispensed with by the following vote: O. D. Leffler, yes; J.
E. Lummus, yes; J. I. Wilson, yes; J. H. Gilman, yes; E. C. Romfh, yes. On mo-
tion of J. E. Lummus, seconded by J. I. Wilson. the said ordinanoe was given its

8eotion 1. That all street railway eompaniee ot►o
the Oity of Miami, Florida, shall provide equal separate aadOO
for white and oolored passengers, and all white and oolored pa8Se.

Florida, by any street railway company are hereby required to Odou'
the respeotive oars or divisions of oars provided for them, so that the
white passengers shall 000upy only the oars or divisions of oars pro-
vided for white passengers and the oolored passengers only the ogre or
divisions of oars provided for oolored passengers.
Seotion 2. Any person, assooiation of persons, firm or cor-
poration violating any provision of this ordinanoa shall be punished by
a fine not exceeding '200, or by imprisonment not exoeeding 60 days, or
by both such fine and imprisonment in the disoretion of the court.
Seotion 3. This ordinanoe is hereby deolared to be an emer-
genoy ordinanoe on the ground of urgent public need for the preservation
of publio safety end shall go into effect jmmediately.

The City Manager submitted to the Commission a letter addressed to him, dated Maroh
4, 1922 from the Mills Corporation, to whioh was attaohed a letter dated February
28, 1922, addressed to Mills Corporation from W. O. Lenten, Major, Corps of Engin-
eers, U. S. A., and to whioh was also attaohed blue prints showing proposed bulk-
head and fill for whioh permits is being requested by Mrs. J. E. Botsford. On mo-
tion of J. E. Lummus, seconded by J. H. Gilman, the said letters were ordered to
be oopied upon the minutes. Motion carried and the said letters copies upon the
minutes as follows:

ourselves will have to make a fill in front of our properties, but the

make these fills or whether the property owners will be required to do
this, and if the latter who will be the ownere of the extended streets?
We hope that you will take up this question with the Oommie-
sioners at their meeting on Tuesday next, before we oan intelligently

Pursuant to the foregoing oommunications and disoussion the following resolution was
introduced by J. E. Lummus:
RESOLUTION N0. 160.
A RESOLUTION REQUESTING MAJOR WM. 0. LEMEN, CORPS
OF ENGINEERS, U. S. A., TO WITHHOLD ANY PERMISSION
FOR PROPOSED BULKHEADS AND FILLS UPON BAY FRONT PRO-
PERTY UNTIL SUCH TIME AS SAID BULKHEADS AND FILLS
CAN BE ARRANGED TO BE UNIFORM AND CONTINUOUS, AND
DIRECTING THE OITY CLERK TO MAIL CERTIFIED DOPY OF
THE RESOLUTION TO SAID MAJOR WM. C. LEMEN.
WHEREAS, Mrs. J. E. Bostford has requested permission for a propo-
sed bulkhead and fill of ninety-eight (98) feet in width upon her lot
on the bay front of one hundred (100) feet in width, and
WHEREAS, the Mills Corporation, an adjoining owner, has communica-
ted with the City Manager, objeoting to a fill of less than the full
width of said lot, and
WHEREAS, the City Commission deems it neoessary that the fills and
bulkheads upon the bay front property should be uniform; now, therefore,
BE IT RESOLVED by the Commission of the City of Miami:
That Wm. C. Lemen, Major, Corps. of Engineers, U. S. A., in Jack-
sonville, Florida, be requested to withhold any permission for said pro-
posed bulkhead and fill until suoh time as the bulkheads and fills upon
bay front property oan be arranged to be uniform and continuous.
BE IT FURTHER RESOLVED that the City Clerk be and he is hereby au-
thorized and directed to mail a certified oopy of this resolution to
Major Wm. C. Lemen Corps of Engineers, U. S. A., Jaoksonville, Florida.

CLAIM FOR REFUND -SANITARY SEWER LIEN MR. CRAS. BROOK:MY
Mr. Charles Brockway presented claim for refund amounting to 485.75 for Sanitary
Sewer liens on the West 50 feet of lots 38 and 39 and 40 and 42 of Blook 11 of High-
land Park. It appearing that the resolution ordering the improvement was past :April
26, 1918, and that the liens upon the property became effective from that date, end
that the certificate of the City Clerk of date 9-22-19, showing that the Oity did
not hold any certificate of indebtedness against said property, speoially provided
that inquiry should be made at the offioe of the City Engineer in relation to im-
provements made by order of the City Oounoil whioh had not been oertified to the
City Clerk, and no evidenoe having been presented to the City Commission that any
such inquiry was made or any such certificate obtained from the City Engineer, there-
fore, upon motion of J. E. Lummus, seconded by J. H. Gilman, it was resolved that the
said claim or refund is hereby rejected. The vote thereon was as talent O. D.
Leffler, yes; J. E. Lummus, yes; J. R. Gilman, yes; E. O. Romfh, yes.

The City Attorney reported to the Oity Commission a soft against the City by a (041
structural steel worker, it being alleged by the plaintiff that injuries were re-
oeived about the head and eyes While passing beneath bridge over Miami Bieer, due
to the slowness of the bridge tender in raising the bridge, or due to the bridge
not being raised to a sufficient height to allow clear paseage. No aotion was taken
by the Commission.
MR. PATTER OF LUNA PARK BLLNXET LICENSE POR JOHNNY JONES
Mr. Pattee, Manager of Luna Park, appeared before the Oommission and requested that
the City issue blanket lioense to the Johnny Jones Show. After diaousfion of the
matter by the members of the Commission it was deoided to take no notion on it.

A RESOLUTION AUTHORIZING THE APPROPRIATION OP
THIRPY THOUSAND DOLLARS (30,000) FROM GENERAL
FUND SURPLUS FOR THE PURPOSE OP COMPLETING THE
PRESENT SEWER OONTRACTS.
BE IT RESOLVED by the Commission of the City of Miami:
That the sum of thirty thousand dollars (030, 000) be and
is hereby appropriated from the General Fund Surplus for the purpose
of oompleting the present sewer oontraots.
