HomeMy WebLinkAboutO-00148ORDINANCE N 1.14(r AN ORDINANCE DEFINING AIR VESSELS, CREATING A BOARD OF AERO EXAMINERS, LICENSING AND REGULAT- ING AIR VESSELS AND PILOTS, AND DEFINING THE AREA OVER THE CITY IN WHICH .AIR VESSELS MAY HE OPERATED, AND STIPULATING THE HEIGHT AT WHICH AND THH MANNER IN WHICH THE SAME MAY OPERATED ABOVE THE AREA INCLUDED IN THE CITY LIMITS. BE IT ORDAINED BY THE COMUISSION OF THE CITY OF MIAMI: Section 1. For the purposes of this ordinance the term "air vessel" is defined to be all machines capable of carrying an, aviator with a passenger or freight through the air, by whatsoever means propelled. Section 4. There is hereby created a Board of Aero Examiners to be composed of three persons, experienced id aeronautics, to be appointed by the City Manager, to serve during the pleasure of the City and to receive such compensation as may be fixed by the City. This Board shall have the following duties: 1. To examine all persons making application for license to pilot an air vessel within the 'City of Miami, and to report the result of such examination to the City Manager. 2. To examine all air vessels for which application for registration has been made, and report the result of such examination to the City Manager. 3. To formulate, and under the supervision of the City Manager, see to the enforcement of such rules and regulations ae may be necessary for the proper operation of air vassals within and over the City of Miami. 4. It shall be unlawful for any person, persons, firm, or corporation to operate or cause to be operated air vessels from any point or station within the Oity of Miami unless said air vessel has been duly registered and nomad as herein provided and unless the pilot of such air vessel holds an unrevoked pilaus license issued as herein provided. An application shall be made and filed with the City Manager for each air vessel desired to be operated within the City of Miami, which application shall contain the following information: Name and address of owner, if an actual person; if a corporation, its name, date and place of incorporation; if a partnership or company, its business name and the address and the names and addresses of the persons comprising the partner- ship or company; snake of air vessel, type of engine, number of cylinders, horse power and engine number. Such application shall thereupon be referred by the City Manager to the Board of Aero Examiners, who shall examine said air vessel and report the result of their examination to the City Manager within five days from the date of such application. The City Manager shall thereupon, should he consider said air vessel to be airworthy, direct the City Clerk to register said air vessel and to issue to the applicant upon the payment of a fee as hereinafter provided, a license fox said air vessel, which shall be good for one year from the first day of October, unless sooner revoked by the City Manager because said air vessel has ceased tQ be airworthy. The number of said license, shall thereupon be painted on the lower side of the right lower wing of said air vessel in black figures on a white baokground in figures four (4) moles in width and two thirds of the chord of said wing in height. It shall be unlawful for any person to pilot an air vessel within the City of Miami unless he holds. a license as a pilot issued by the City Manager as hereinafter provided. Any person desiring tb obtain a license as a pilot shall make and file with the City Manager an application containing the following information Name, age, place of birth, experience and training as a pilot. The City Manager shall thereupon refer such application to the Board of Aero Examiners who shall thereupon examine said applicant and report the result of their examination to the City Manager within five days from the date of such application. The City Manager shall thereupon, should he deem such applicant properly qualified to pilot an air vessel, direct the City Clerk to issue to such applicant, upon the payment of the fee hereinafter provided, a license to operate an air vessel within such limits of the City of Miami as are hereinafter prescribed. This license shall be good for one year fromthe first day of October unless sooner revoked by the City Manager on account of a violation of this ordinance or because the holder thereof has failed to show proper skill in the operation of an airvessel. Seotign 5. The annual license fee for the operation of an air vessel within the city limits of Miami shall be #25.00 for ,air vessels having seating capacity of not more than three, including pilot; $24,00 for air vessels having a seating capacity of not more than nix, including pilot; and. $50.00 for air vessels having a seating capacity of more than six. provided that where application is made for license under this ordinance after April. 30th of any year the fee charged for ouch license small be one half that required for the entire year, ,le_Qt.iao. 8,. The annual lie nee fee for the examination and ieeuaneeof a pilet'e lieense for one year shall be ten (310.00) dollars& provided that where application is made far ` the examination and issuance of a pilot,a license, under this ordinance after April. 30th of any year, the fee charged therefor aball be osier -half that required for the entire year. Seotion 76 No air vesaei shall be flown at an altitude of less than twenty five hundred (2500) feet over that section of the Oity of Miami bounded on the east by the West ehore line of Biscayne Bay and on the south, west and north by the. City limits. This area is hereby declared to be a restricted district over which no air vessel shall be flown at an altitude of less than twenty-five hundred (2500) feet. Section 8. No air vessel shall be at any time flown over any bridge, causeway, viaduct or island in Biscayne Bay, Miami Section, at a lower altitude than 500 feet. Section 9. The City Manager may, for educational or military purposes, grant special permission for the flying of air vessels at a lower altitude than that provided for in Sections seven (7) and eight (8). Section )O. No person shall at any time operate an air vessel within and over any portion of the City of Miami in such Manner as to endanger the property, life or limb of any person. Section 11. It is hereby declared by the Commission of the City of Miami that if any section, sentence, clause or phrase of this ordinance shall for any reason be held to be unconstitutional or void, such decision shall not affect the validity of the remaining portion of this ordinance. The .Commission of the City of Miami hereby declares that it would have passed this ordinance, and every sentence, section, clause and phrase thereof, irrespective of the fact that any one or more sentences, Clausen, sections or phrases be declared unconstitutional or void.
