Subject: Rescind/RE 23-0347 - Accept Funds - Southeast Overtown Park West CRA
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), rescinding Resolution
No. 23-0347, adopted on July 27, 2023, in its entirety and enacting a new Resolution to
clarify contract term provision, authorizing the City Manager to negotiate and execute a
first amendment to the agreement, in substantially the attached form, attached and
incorporated herein as Exhibit "A," for the provision of enhanced police services within
the Southeast Overtown/Park West Redevelopment area ("Program"); further
authorizing the City Manager to continue allocating funds in an amount not to exceed
$955,252.43 until funds are depleted.
Background of Item:
The City of Miami ("City") is responsible for public safety throughout the City, which
includes the Southeast Overtown/Park West ("SEOPW') Community Redevelopment
Agency's ("CRA") Redevelopment Area. Pursuant to Section 163.370(2)(o), Florida
Statutes, the CRA has the power to develop and implement community policing
innovations with the objective of remedying slum and blight, and the causes thereof,
within its Redevelopment Area. The City's Police Department ("MPD") has an interest
in continuing the CRA Detail, an innovative service -oriented police unit, in a problem -
solving team capacity, to establish and support working partnerships with the CRA,
Neighborhood Enhancement Teams, residents, business owners, and homeless
outreach programs. In January 2023, the Board of Commissioners of the CRA adopted
Resolution No. 23-0003; this Resolution was rescinded and replaced with CRA
Resolution No. 25-0012 to clarify contract term provision, with the continuance of the
grant award in an amount not to exceed $955,252.43 to MPD to fund the costs
associated with the CRA Detail's enhanced police services. The awarded funds do not
require a City match.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
RESCINDING RESOLUTION NO. R-23-0347, ADOPTED ON JULY 27, 2023, IN ITS
ENTIRETY AND ENACTING A NEW RESOLUTION TO CLARIFY CONTRACT TERM
PROVISIONS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
AN AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED AND
INCORPORATED AS EXHIBIT "A," FOR THE PROVISION OF ENHANCED POLICE
SERVICES WITHIN THE SOUTHEAST OVERTOWN/PARK WEST
REDEVELOPMENT AREA AND OTHER SAFETY MEASURES; FURTHER
AUTHORIZING THE CITY MANAGER TO CONTINUE ALLOCATING FUNDS IN AN
AMOUNT NOT TO EXCEED $955,252.43 UNTIL FUNDS ARE DEPLETED;
FURTHER AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF
POLICE OR OTHER DESIGNEE TO NEGOTIATE AND EXECUTE ANY AND ALL
OTHER NECESSARY DOCUMENTS, ALL IN FORMS ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") is responsible for public safety throughout the City,
which includes the Southeast Overtown/Park West ("SEOPW') Community Redevelopment
Agency ("CRA") Redevelopment Area; and
WHEREAS, pursuant to Section 163.370(2)(o), Florida Statutes, a CRA has the power
to develop and implement community policing innovations with the objective of remedying slum
and blight, and the causes thereof, within its Redevelopment Area; and
WHEREAS, the City's Police Department ("MPD") has an interest in continuing the
enhanced police services detail in the CRA Area ("CRA Detail"), an innovative service -oriented
police unit, in a problem -solving team capacity, to establish and support working partnerships
with the CRA, residents, business owners, and homeless outreach programs; and
WHEREAS, the SEOPW CRA adopted Resolution No. CRA-R-23-0003 on January 26,
2023, that was rescinded and replaced with CRA Resolution No. CRA-R-25-0012 to clarify
contract term provision and providing for a grant award in an amount not to exceed
$955,252.43, to MPD to fund the costs associated with the CRA Detail's enhanced police
services for several prior community policing innovation programs within the Redevelopment
Area, including the Police Visibility Pilot Program, the ShotSpotter Flex Gunfire Alert Pilot
Program, and the SEOPW CRA Police Camera Pilot Program; and
WHEREAS, the Miami City Commission adopted Resolution No. R-23-0347, on July 27,
2023, as the companion item to accept funds provided by the SEOPW CRA pursuant to
Resolution No. CRA-R-23-0003; and
WHEREAS, rescinding Resolution No. R-23-0347 and adopting this resolution serves to
clarify the new terms of agreement between the SEOPW CRA and the City which allows for the
expenditure of available funds until depleted and subject to annual renewal and/or extensions,
upon the discretion of the SEOPW CRA Executive Director; and
WHEREAS, no matching funds are required from the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Resolution No. R-23-0347, adopted on July 27, 2023, is hereby rescinded in
its entirety.
Section 3. The City Manager is authorized' to negotiate and execute an agreement, in
substantially the form attached and incorporated as Exhibit "A," for the provision of enhanced
police services and other safety measures within the SEOPW CRA Area.
Section 4. The City Manager is further authorized1 to continue allocating funds in an
amount not to exceed $955,252.43 until funds are depleted.
Section 5. The City Manager is further authorized' to designate the Chief of Police or
other designee to negotiate and execute any and all other necessary documents, all in forms
acceptable to the City Attorney, for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City of Miami Commission.
