FIRST
That the said Party of the Second Part has purchased
from the Party of the First Part, a double unit standard
brick incinerator of the NYEODORLESS CREMATORY COMPANY,
at and for the agreed sum of Thirty-two thousand two hun-
dred and twenty DOLLARS, payable as follows; tbg20.00 in
cash upon the satisfactory completion and acceptance of
said incinerator and the balance $9000.00 per year payable
respectively one, two and three years from the date of com-
pletion and acceptance of incinerator.
It is understood and agreed, that :unless otherwise
specifically ::trued, all deferred payments are to bear 6
interest from date of .zompletian of plant, whether evidenced
by notes, warrants ur otherwiee, and shall be payable ser.i-
a►znnually, by separate interest coupons. Both interest and
principal aaall be payable at ANY Bank in the City of Miami,
Fla.
This settlement ie to be made when the crematory is com-
pleted, according to each and all cf the terms, conditions
and stipulations hereinafter mentioned, and curtained in the
specifications, a copy of which is herete annexed, and which,
together with the plans attached (the sane being plane of
Design No. 11) are hereby ruade a part of tha s agreement as
fully as if they had been set forth at length herein.
The Party cf the First Part hereby undertakes and ccn-
tracte to furnish all of the labor and material necessary
for the construction and completion of the eaid plant as
specified, the game to be built and acz)structed at the ex-
pense of the eaid Party of the First Part. The Party of the
Se. cnd Part i4 to sele. t, dcei jte and furnish the site for
the said arematcr;, , witheut expense to the Tarty cf the
First Part. The Party cf the First rart shall have free
aaaese thereto, without interference or expense.
That the Party cf the Firet Part hc4 e+sy euarsntees,
when eaid location ie furnished ae above speaifiea, tc ccn-
plete the wcr z cf ccnetruvting said garbage arematary within
90 drays, and to have the ea.me ready for operation, unless
Prcvidentia1 or other aauees beyond the control of the Party
of the Pint Part, shall ,prevent the completion within said
t ime.
F UITH
The Party ef the :'irat Part further agrees that when
eaid plant IS completed, a de o!iytration of its operation
and utility Shall be made, and guarantees that the capacity
ofthe said double unit plant i e from 30 to 40 tore of average
city -run garbage, trash, waaete paper and dead auima?e per
day of twelve hours.

It is undexatood further and agreed between the parties

When the operation of the plant is in ao ordazlae with the
gasranteea herein ode, the Party of the 4e4ond Part hereby
agreee to wa4e settlement for said plant se above stated.
SIXTH t
It is understood that said crematory design is patented
and the patent owned exclusively by the Party of the Pirst
Part, who shall protect Warty of the Second Part against any
Suits growing out of any alleged infringements.
SEVENTH:
This contract includes the building or roof superstructure,
shown in plans for the respective standard brick plants,
single or double unit as the contract calls for, unless other-
wise specified here.
EIGHTH:
Said incinerator shall not be deemed complete or accept-
able until it shall have been demonstrated to the satisfaction
of the engineer and the Sanitary Committeeman that it can con-
sume from thirty to forty tone of average city run garbage,
trash, waste paper and dead animal: per day of twelve hours
without obnoxious odors from furnace or smoke stave:.
This contract shall become binding onl& when signed by
the executive officers of the Company at the home office in
kacon, Ga. , and it is understood that all of the terms of the
contract are embraced herein in writing.
In Testimony Whereof, The Party of the First Part, by its
duly authorized officers, has hereunto eet its name and affix-
ed its seal, and the Party of the Second Part by the duly
authorized officials of the said City has caused these pre-
aente to be signed and its seal to be affixed.
This contract is executed in duplicate, the day and year
first above written.

petent superintendent on the work during progress of in-
stallation. A11 materials shall be of the best as herein-
after specified. All work both in preparation and incorpora-
tion of materials shah be performed in a skillful manner by
competent workmen. It le to be expected that in all brick
furnace work of this character, subject to extremes of heat,
there will be some cracks to develop.
INSP CTION.
All materials and wcramanship shall be sub je;:t at all times
to the inspeotiou of the proper party designated by the amity,
and any of either that is not in a000rdance with the plans
and specifications shall be removed on complaint of the
City'e representatives, and proper materials or worxrnanship
substituted. said objection or complaint must be made
promptly when any deviation from plans and specifications
is made by contractor.

The City shall furnish free of cast to the Lye Odorless
Crematory Company, a :city license and building inspectcr'e
permit for the ere,:ticn and construction of the crematory.
SITL.
The City shall furnish and designate to the Lye Odorless
Crematory Company, on demand of its Constru::tion Department,
the lot on which to build the Crematory, and point out by
stakes or other suitable markings, both the let lines and
the position of the crematory on the lot. And if the City
fails to furnish lot on demand, within a reasonable time,
the City shall pay to the Nye Odorless Crematory Company
all cost ,and expense incurred an aooeunt of su7oh failure.

ROADWAYS,
Tne Jity at its own Jest anj expenee shall do all fining,
grading, exJavating, terraoing, eta.. for all roadways
neJeseary for the proper use and operation of the crematory,
under the direction of the Construction Department of the
Nye odorless Crematory Company.
ACOIDLNTS AND NEaLIGENCE,
The 2arty of the First fart will be responsible for all
acoidental damages to the Incinerator during conetruction,
whether from 13re, :;1!.d r tL,r 3 , until the
plant is finished, and will is responsible for any a'ccidents
arisine from defective scaffolding cr negligence cr ita
part.
LXJAVATION.
The Nye Odorlese Crematory Company shall excavate to the
depths ehewn cr, the plans (but exclueive of any blasting cr
pile driving), icr all walls, footings, etc., and see that
thefcandations are sufficient to carry the load before
menJinE construction cf the walls. Larth ta4en from exaa-
vatione shall be used to fill in areund the walls and be
graded so us te shed water away from the walls. All sur-
plus earth from excavations and grading may be used by the
City In ocnstruating roadways, cr must otherwise be dis-
posed of by them at their cwn Jost and expense.
EAU.
All brick throughout, except where fire and speaial brick
are shown, shall be good, sound, average, mer3hantable,
building brick of standard size, and well made. Al? regular
fire and speaial brick shall be good, stund, well made, and
well burned fire bric4 that will not show fusing at leas
than '.'600 degrees :Fahrenheit. All specials 8hall be true
to shape and fit places for which intended.

The reinforced aoliarete shown it the charging floor of the
plant shall be the thickness shown on the plane, properly
reinforaed with euffiaient steel of approved design for
such work, and shall be carried by reinforced concrete
beams of the sizee ehown. Oreat are must be exercised in
planing the concrete so as to prevent any separation of the
cement from the aggregates, and any displacements of the
steel, and to see that the concrete is thoroughly spaded,
and the steel completely enveloped with the concrete.
All aoharete work having exposed surfaces shall be built
within surfaced forms, and the finished eurfaaes must be
made uniformly emoth, regular, and full dimensioned and
in accord with the drawings and specifications governing
the same.
CEMBET.
The cement called for shalibe one of the standard brands of
Ameriaan Portland cement and shall meet the requirements of
the tests specified by the American Society of Testing ka-
terials, to the satisfaction of the .:”.ty'e inepeator.
All lime used ehall be good, standard brand, well burned and
in good condition. It hall be elaaked at eite, and shall
be allowed to cool before using.

The lintel against the smoke stauk, the steak base plate,
the garbage ahute, the firing and garbage doors, the counter
balanae weights, the flue dampere, the grate bare, the bar
reete, the tie rod waehere and all other castings of both
single and double unit plants shall be of soft gray aaat
iron, free from blisters or blow holes, alld cast true and
straight.
The animal door, guides for animal door, tie rode through
crematory, of both the eingle and double unit plaits (and

unless otherwise 'specified, to be of the best quality TNessemer
or open hearth process eteel, milled straight and true and out

All steel shall be medium deformed steel with an, ultimate
strength of 60,000 to 70,000 pounds per square inch, and
an elastic limit not lees than one-half the ultimate
strength. Steel shall comply with all the requirements
of the manufacturer's standard specifications for medium
steel, both as .to quality and workmanship.

furnace or smoke stack.
Section 3. That the kayor and the City Clerk be and the same
are hereby authorized to execute said aontraat in behalf of the City
in order that the Work of construction may commence at once and the
said inainerator be aompleted aith;n the period of 90 days as in
eald aontraat provided.
Seation 4. The City Counall does hereby declare that the health
and welfare of the City it citizena are in peril by reason of the
inadequaay of the present incinerator to dispose of the garbage, traah,
waste paper axid dead animals and that preu4t and immediate messuree
muut be taken to provide for the sanitary diepoaal of euah trash, garb-
age, waste paper and dead animala, and the City Council does also de-
clare that the amid aontraat is neceeeary for the immediate preserva-
tion of the public health and therefore this aontract shall have three
readings at one eession and shall go into effe t immediately upon ita
passage by the City Council and approval by the Mayor.
Section 5. All ordinahaea and part e of ordinal:zee in conflict
with thie Ordinance be and the eame are hereby repealed.
