A. REQUEST
Pursuant to Chapter 55, Section 55-15 (a) of the City of Miami Code of Ordinances (the "City
Code"), as amended, Arthur Noriega, V. on behalf of the City of Miami, the "Applicant," is
requesting to vacate a portion of NW 34th Terrace between NW 2nd Avenue and NW 1st Avenue
consisting of 27,501.76 square feet located at 101 NW 34 Street, Miami, Florida, also known
as Roberto Clemente Park, as further depicted in Figure 4 below.
B. RECOMMENDATION
Pursuant to Chapter 55, Section 55-15 (a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department
recommends Approval with Conditions of the requested closure, vacation, abandonment
and discontinued from public use of a public alley (the "Right -of -Way") based on the facts and
findings in this staff report.

D. BACKGROUND
Proposal
This application seeks to vacate a portion of NW 34th Terrace between NW 2nd Avenue and
NW 1st Avenue. The vacation will be processed through a replat of the above mentioned
properties to formally vacate the street segment that currently divide the existing park into two
segments. The purpose of this request is to accelerate all future improvements permitting
process without the need to obtain Resilience and Public Works authorization to improve the
street segment.

E. ANALYSIS
Miami Comprehensive Neighborhood Plan (MCNP)
The Property is designated as "Public Parks and Recreation" under the MCNP. The primary
intent of this land use classification is to conserve open space and green spaces of a park
while allowing access and uses which shall not interfere with the preservation of any
significant environmental features which may exist within the park.
The proposed closure is consistent with the underlying MCNP designation.
Miami 21 Code
The Property is designated as "CS" Civic Space Transect Zone under the Miami 21 zoning
code. "CS" is defined as a zone with mainly outdoor area dedicated for functioning for
community purposes.
The proposed closure is consistent with the underlying Miami 21 zoning designation.

Dimensions and Area of the Public Right of Way
That certain portion of the 50 foot right-of-way for AVE. 24 north park drive (NW 34th terrace)
lying between blocks 5 and block 8, city park, bounded on the west by the east right-of-way
line of NW 2nd avenue and bounded on the east by the east line of lot 23, block 5 extended
southerly, all of the above, as shown on map of Wynwood Park, according to the plat thereof,
as recorded in plat book 5, at page 23, of the public records of Miami -Dade county, Florida,
containing 27,501.76 square feet or 0.63 acres more or less.

Criteria
Pursuant to Chapter 55, Section 55-15(c) of the City Code, in addition to review for technical
compliance, the request for vacation and closure shall be considered with respect to the
following criteria:
Criteria 1: Is it in the public interest, or would the general public benefit from the
vacation of the rights- of -way or easement?
Analysis 1: The vacation of the rights- of -way or easement would allow for unobstructed
park space which will benefit the public in terms of recreation and safety.

fire, or other emergency vehicles?

The area is already used as a park and not needed for any service vehicles.

Would there be no adverse effect on the ability to provide police, fire, or
emergency services?
The area to be vacated is not used as a right of way, no services will be
affected.

Would the vacation and closure of the rights of way or easements have a
beneficial effect on pedestrian and vehicular circulation in the area?
The vacation and closure would not affect vehicular circulation and would
maintain existing pedestrian connectivity through the public park.

Pursuant to Chapter 55, Section 55-15(a) of the City of Miami Code of Ordinances, as
amended, the City of Miami Plat and Street Committee and Planning Department recommend
Approval with Conditions of the requested closure, vacation, abandonment and
discontinued from public use of a public alley based on the facts and findings in this staff
report.
CONDITIONS
1. The vacation and closure of the Right -of -Way shall be developed in accordance with the
"Tentative Plat # 2064", consisting of two (2) sheets, digitally signed and sealed by Silvia
Nuin of Manuel G. Vera & Associates, Inc., Professional Surveyor and Mapper, LS No.
5982, State of Florida, with a Survey Date of January 29, 2025.
2. The Applicant or their successor shall comply with all conditions and/or comments in the
letters drafted and signed by Juvenal Santana, P.E., CFM, Supervisor of Plats - Plat and
Street Committee, Department of Resilience, Public Works, Development and Roadway
Plans, Planning and Zoning, and standard comments, on February 7, 2025, and February
20, 2025, for the Tentative Plat # 2064 located from NW 34 Street to NW 34 Terrace, and
along the north side of NW 34 Terrace; from NW 1 Avenue to NW 2 Avenue.
3. The Applicant, owner, or successor shall meet applicable development standards
identified in the Miami 21 Code and all applicable local, county, state, and federal
regulations.

4. The Applicant, owner, or their successor shall provide an access plan for review and
acceptance by the City's Fire -Rescue, Police, Solid Waste Departments, and the Capital
Improvements Program/Office Transportation.
5. A building permit, including phased permits, shall not be issued on the Property being
platted until the final plat is recorded in the official records of Miami -Dade County, Florida
or as authorized by Section 55-10(j) of the City of Miami Code of Ordinances, as amended.
6. Approval of the requested vacation and closure shall be valid for a period of four (4) years
and shall remain independent of the referenced tentative plat during this period, pursuant
to Section 55-15 of the City of Miami Code of Ordinances, as amended.
7. A Certificate of Occupancy shall only be issued after all the required subdivision
improvements have been completed.
8. The City reserves the right to inspect the site to ensure compliance with the conditions
listed.
