HomeMy WebLinkAboutR-25-0220City of Miami Resolution R-25-0220 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17332 Final Action Date: 6/17/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY ATTORNEY TO PREPARE AN AMENDMENT TO THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CHARTER"), FOR CONSIDERATION AT THE SPECIAL ELECTION TO BE HELD CONCURRENTLY WITH THE GENERAL ELECTION ON NOVEMBER 4, 2025, PROPOSING, UPON APPROVAL OF THE ELECTORATE, TO AMEND SECTION 4(B) OF THE CHARTER, TITLED "FORM OF GOVERNMENT; NOMINATION AND ELECTION/ELECTION OF MAYOR AND CITY COMMISSION; TERMS OF OFFICE; RECALL," TO ESTABLISH THAT NO PERSON WHO HAS BEEN ELECTED OR APPOINTED TWO (2) TIMES TO THE OFFICE OF MAYOR OR COMMISSIONER SHALL BE ELIGIBLE FOR REELECTION TO THAT OFFICE DURING THEIR LIFETIME; FURTHER PROVIDING THAT THE MAYOR AND CITY COMMISSION'S TERM LIMITS ARE MEASURED RETROACTIVELY FROM THEIR FIRST ELECTIONS OR APPOINTMENTS; FURTHER PROVIDING THAT UPON APPROVAL OF THE ELECTORATE, THIS AMENDMENT WILL BE IMMEDIATELY EFFECTIVE AND APPLIED TO ANY CANDIDATE LISTED ON THE NOVEMBER 4, 2025, ELECTION BALLOT. SPONSOR(S): Commissioner Damian Pardo WHEREAS, the City of Miami ("City") was incorporated by the Florida Legislature in 1896 and operates pursuant to the Charter of the City of Miami, Florida ("Charter"); and WHEREAS, the Charter has been amended from time to time as the governance of the City has evolved; and WHEREAS, the City Commission believes the proposed amendment to the Charter to establish that no person who has been elected or appointed two (2) times to the Office of Mayor or Commissioner shall not be eligible for reelection to that office during their lifetimes and that the Mayor and City Commission's term limits are measured retroactively from their first elections or appointments and providing that upon approval of the electorate, this amendment will be immediately effective and applied to any candidate listed on the November 4, 2025 election ballot, is in the best interest of the residents of the City; and WHEREAS, the City Commission wishes to submit the above -mentioned proposed amendments to the electorate, for approval or disapproval, at the Special Election to be held concurrently with the General Election on November 4, 2025; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 17332 (Revision:) Printed On: 8/25/2025 File ID: 17332 Enactment Number: R-25-0220 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Attorney is directed to prepare an amendment to the Charter, for consideration at the Special Election to be held concurrently with the General Election on November 4, 2025, proposing, upon approval of the electorate, to amend section 4(b) of the charter, titled "form of government; nomination and election/Election of Mayor and City Commission; terms of office; recall," to establish that no person who has been elected or appointed two (2) times to the Office of Mayor or Commissioner shall be eligible for reelection to that Office during their lifetime and that the Mayor and City Commission's term limits are measured retroactively from their first elections or appointments and providing that upon approval of the electorate, the amendment will be immediately effective and applied to any candidate listed on the November 4, 2025, election ballot. Section 3. This Resolution shall become effective immediately upon its adoption.
