WHEREAS, in an effort to avoid any appearance of bias, partiality, or perceived conflict regarding a non -criminal violation of the Code of the City of Miami, Floria, as amended ("City Code"), the City Commission desires that another independent local governmental agency should be tasked with the proper investigation of any non -criminal complaints of violations of the City Code alleged against a sitting City elected official; and WHEREAS, the handling of such investigations by the Code Compliance Department or other Department of the City may create the perception of a conflict or impropriety; and WHEREAS, the Miami City Commission desires that any such investigations proceed in a transparent manner, free from potential perceived conflicts; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission hereby directs the City Manager to take any all necessary steps to enter into an Interlocal Agreement with Miami -Dade County, Florida or other appropriate local governmental entity, in order to authorize such agency to properly investigate, and prosecute if necessary, as provided for by law, any non -criminal complaints of violations of the City Code alleged against a sitting City elected official. Section 3. The Interlocal Agreement shall be brought to the City Commission within ninety (90) days for its approval. Section 4. In the interim, until the Interlocal Agreement is approved by the City Commission, the City Commission further directs the City Manager to place on hold the investigation of any complaints against sitting elected officials, except those relating to imminent life safety allegations, until such time as the Interlocal Agreement is finalized.
