Background of Item: The City's Police Department Marine Patrol Division is interested in leasing approximately 250 square feet of privately owned property for the use of an administrative office, and secure vessel storage located at 881 NW 13th Avenue, Miami, Florida 33125 (the "Premises"). The initial term is for one (1) year, with the option to renew, for additional one (1) year terms until either party terminates. The annual rent is equal to Sixty Dollars ($60.00) for the initial and every renewal term, and no guarantee deposit is required from Landlord, and no increase in the annual rent will be applied for every year including the renewal term. The City and Landlord desire and intend to enter into a new Lease Agreement ("Lease") authorizing the City's use of the Property. WHEREAS, the City of Miami's ("City") Police Department ("MPD") Marine Patrol Division is interested in leasing approximately 250 square feet of privately owned property for the use of an administrative office, and secure vessel storage located at 881 Northwest 13th Avenue, Miami, Florida 33125 ("Premises"); and WHEREAS, the initial term is for one (1) year, with the option to renew, for additional one (1) year terms until either party terminates; and WHEREAS, the annual rent is equal to Sixty Dollars ($60.00) for the initial and every renewal term; and WHEREAS, no guarantee deposit is required from Landlord; and WHEREAS, no increase in the annual rent will be applied for every year including the renewal term; and WHEREAS, the City and Landlord desire and intend to enter into a new Lease Agreement ("Lease") authorizing the City's use of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized1 to execute a Lease Agreement in a form acceptable to the City Attorney, between the City and Landlord, for the use of the Premises, for the purpose of operating administrative office and secure vessel storage for an annual rent equal to Sixty Dollars ($60.00) which equates to a monthly rent in the amount of five Dollars ($5.00), a no guarantee deposit, and with no increase in the annual rent including renewal terms, subject to additional terms and conditions to be more specifically set forth in said Lease Agreement. Section 3. The City Manager is further authorized' to negotiate and execute all necessary documents, including amendments, renewals and modifications to said Lease Agreement, in a form acceptable to the City Attorney, as may be necessary. Section 4. This Resolution shall become effective immediately upon its adoption.
