HomeMy WebLinkAboutR-25-0201City of Miami Resolution R-25-0201 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17615 Final Action Date: 6/17/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTION(S) NECESSARY TO EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS ("DTPW') CONSIDER THE PROPOSED TRAFFIC FLOW MODIFICATIONS, WAIVE THE REQUIRED RESIDENT CONCURRENCE, AND EXEMPT THE BALLOTING PROCESS, IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING DEVICES AT TWENTY-SIX (26) LOCATIONS IN THE RESIDENTIAL SILVER BLUFF NEIGHBORHOOD, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THIS RESOLUTION TO THE DTPW DIRECTOR. SPONSOR(S): Commissioner Joe Carollo WHEREAS, several locations in the City of Miami's ("City") District 3 Silver Bluff neighborhood are experiencing significant cut -through traffic and speeding during rush hour periods; and WHEREAS, such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life; and WHEREAS, in addition to quality -of -life problems such as noise and general congestion, such cut -through traffic and speeding creates significant life -safety risks as residential streets are narrower than nearby arterial roadways, increasing the risk of vehicular accidents, including those involving pedestrians; and WHEREAS, the City's Department of Resilience and Public Works produced a neighborhood traffic study for the Silver Bluff neighborhood, and on September 26t", 2024, Miami Dade County Transportation and Public Works approved, under DR2024004231, the recommendations for the traffic calming devices identified; and WHEREAS, those drivers who cut -through residential neighborhoods during rush hour traffic tend to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and WHEREAS, in order to alleviate these issues, the City proposes to install twenty-six (26) traffic calming devices at these locations in the Silver Bluff neighborhood, as described in Exhibit "A," attached and incorporated, that experience significant cut -through traffic and speeding during morning and afternoon rush hour periods; and WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/ Street City of Miami Page 1 of 3 File ID: 17615 (Revision: A) Printed On: 8/25/2025 File ID: 17615 Enactment Number: R-25-0201 Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department ("PWD") Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "B" ("County Procedure"), requires concurrence from the affected residents and/or property owners; and WHEREAS, Section 1.6 of the County Procedure further states that "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County Department of Transportation and Public Works ("DTPW)] to consider the proposed traffic flow modification(s)/street closure(s)"; and WHEREAS, in order to expeditiously address the aforementioned quality of life and life - safety issues, the City desires to install the twenty-six (26) traffic calming devices, as more particularly described in Exhibit "A," attached and incorporated, in designated residential Silver Bluff neighborhood without delay by holding a public hearing in lieu of resident/property owner concurrence through balloting; and WHEREAS, although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "A," attached and incorporated; and WHEREAS, in lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes' and directs the City Manager to take all actions necessary to expeditiously request that DTPW consider the proposed traffic flow modifications at the following twenty-six (26) locations within Silver Bluff neighborhood, as more particularly described in Exhibit "A," attached and incorporated, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Southwest Sixteenth Avenue between Southwest Twenty -Second Street and Southwest Twenty -Second Terrace 2. Southwest Sixteenth Avenue between Southwest Twenty -Second Terrace and Southwest Twenty -Third Street 3. Southwest Sixteenth Avenue and Southwest Twenty -Third Street 4. Southwest Sixteenth Avenue between Southwest First Avenue and Southwest Twenty -Third Terrace 5. Southwest First Avenue and Southwest Third Avenue 6. Southwest Third Avenue between Southwest Fourteenth Avenue and Southwest 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. The City Clerk is directed to send a certified copy of this Resolution to the Director of Miami -Dade County's Department of Transportation and Public Works. Section 4. This Resolution shall become effective immediately upon its adoption.
