HomeMy WebLinkAboutR-25-0200City of Miami Resolution R-25-0200 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17617 Final Action Date: 6/17/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE INTERLOCAL AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI- DADE COUNTY ("COUNTY"), A POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, REPLACING THE INTERLOCAL AGREEMENT THAT WAS EXECUTED PURSUANT TO RESOLUTION NO. 07-0272, ADOPTED MAY 10, 2007, AS AMENDED, TO CONTINUE TO ALLOW THE CITY OF MIAMI ("CITY") TO RECEIVE ITS PORTION OF MUNICIPAL SHARE FUNDS FROM THE CHARTER COUNTY TRANSIT SYSTEM SURTAX FOR TRANSPORTATION AND TRANSIT PROJECTS AND TO ALLOW THE USE OF THE SURTAX FOR ON -DEMAND TRANSPORTATION SERVICES, TO SERVE VISITORS, RESIDENTS, AND WORKERS BY PROVIDING A CONVENIENT, EFFICIENT MOBILITY OPTION TO CIRCULATE THROUGHOUT DESIGNATED AREAS OF COCONUT GROVE AND COCONUT GROVE BID AREAS; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. SPONSOR(S): Commissioner Damian Pardo WHEREAS, pursuant to Resolution No. 03-651, adopted June 12, 2003, the City of Miami ("City") Commission approved the first Interlocal Agreement ("ILA") for distribution of Charter County Transit System Surtax ("Surtax") Proceeds pursuant to Section 212.055, Florida Statutes (also known as the one-half cent transit surtax) levied by Miami -Dade County ("County"); and WHEREAS, pursuant to Resolution No. R-07-0272, adopted May 10, 2007, the City Commission approved the second ILA for distribution of Charter County Transit System Surtax Proceeds pursuant to Section 212.055, Florida Statutes to allow the continued use of the Surtax to support transportation initiatives; and WHEREAS, pursuant to Resolution No. R-11-0223, adopted May 26, 2011, the City Commission approved the third ILA for distribution of Charter County Transit System Surtax Proceeds pursuant to Section 212.055, Florida Statutes to allow for pre -arranged on -demand transportation services for low-income seniors who are aged 65 years or older and individuals with disabilities; and WHEREAS, pursuant to Resolution No. R-21-0336, adopted September 13, 2021, the City Commission approved the fourth ILA for distribution of Charter County Transit System Surtax Proceeds pursuant to Section 212.055, Florida Statutes to continue to allow for pre- arranged on -demand transportation services for low-income seniors who are aged 65 years or older and individuals with disabilities; and WHEREAS, the proposed fifth ILA addresses the use of the municipal share of the Surtax proceeds for on -demand transportation services for visitors, residents and workers to City of Miami Page 1 of 3 File ID: 17617 (Revision:) Printed On: 8/25/2025 File ID: 17617 Enactment Number: R-25-0200 allow for a convenient, efficient mobility option throughout the designated areas of Coconut Grove and the Coconut Grove Bid areas; and WHEREAS, the proposed fifth ILA has the following revisions: - Fares are in accordance with the Section 29-124 of the Code of Miami -Dade County; - The existence of Park -and -Ride Facilities; That modifications to the ILA regarding service areas, days of week, span of service hours and fares, may be approved by the County Manager and City Manager or their respective designees; - No restriction on the length of route; - The County shall provide On -Demand service information and schedules; - Route modifications including discontinuation of service greater than 25% shall require a technical analysis by the City; - The option for On -Demand Signs and bus stops has been eliminated; - Reporting requirements are to be quarterly; - Real Time Data is based upon General On -Demand Format Specification (GOFS- lite); - The County may but is not required to provide all or part of monies or other types of matches required for state and federal grants, which may be received by the City for expansion of the On -Demand service; - The provision as to the City's share of the supplemental State funding has been eliminated; and - Renegotiation or modification of the ILA requires a legally noticed public hearing to be held prior to implementation. WHEREAS, it is recommended that the City Commission approve a fifth ILA in order to continue to allow the City to receive and expend funds provided by the Surtax; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the Interlocal Agreement, in substantially the form attached and incorporated as Exhibit "A," with Miami -Dade County, a political subdivision of the State of Florida, to allow the City to receive its portion of municipal share funds from the charter county transit system surtax to supplement, not replace, the city's general fund support of transportation and transit projects. Section 3. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
