REFERENCES: 15 Day Notice ENCLOSURES: Ad of Notice of Public Hearing Enclosed you will find an advertisement for a public hearing to be held by the City Commission on June 12, 2025, for the purpose of amending the existing concession agreement between the City and Eventstar Structures, Corp. the confirmed sole source provider. The objective of this public hearing is to discuss Eventstar Structures, Corp. intentions to extend the term of the agreement for an additional five (5) years, increasing the City's revenue share to twenty percent (20%) during the extension, and accepting an in -kind donation from concessionaire valued at three hundred thousand dollars ($300,000.00) for the installation of new foundation cover plates to replace the existing equipment. Spring, CFO/ Assistant City Manager CITY OF MIAMI, FLORIDA NOTICE OF PUBLIC HEARING A public hearing will be held by the City Commission of the City of Miami, Florida on Thursday, June 12, 2025, at 9:00 A.M. at City Hall, located at 3500 Pan American Drive, Miami, Florida, 33133 for the purpose of granting the following: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, PURSUANT TO SECTION 18-92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF A SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND AUTHORIZING THE CITY MANAGER, TO NEGOTIATE AND EXECUTE AN AMENDMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CONCESSION AGREEMENT ("AGREEMENT") BETWEEN THE CITY OF MIAMI ("CITY") AND EVENTSTAR STRUCTURES CORP., ("CONCESSIONAIRE"), AS THE SOLE SOURCE PROVIDER, FOR THE EXCLUSIVE PROVISION OF TENT STRUCTURES AT MIAMI MARINE PARK IN VIRGINIA KEY, ALSO KNOWN AS THE COMMODORE RALPH MUNROE MARINE STADIUM PARK ("MIAMI MARINE PARK") ALSO KNOWN AS FLEX PARK, EXTENDING THE TERM OF THE AGREEMENT FOR AN ADDITIONAL FIVE (5) YEARS, INCREASING THE CITY'S REVENUE SHARE TO TWENTY PERCENT (20%) DURING THE EXTENSION, AND ACCEPTING AN IN - KIND DONATION FROM CONCESSIONAIRE VALUED AT THREE HUNDRED THOUSAND DOLLARS ($300,000.00) FOR THE INSTALLATION AND REPLACEMENT OF EQUIPMENT; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. All interested persons are invited to appear at the meeting and may be heard with respect to the proposed resolution. Should any person desire to appeal any decision of the City Commission with respect to any matter to be considered at this meeting, that person shall ensure that a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based (F.S. 286.0105). Pursuant to Miami City Code Section 2-33(o), whenever a scheduled City Commission meeting is cancelled or is not held due to a lack of a quorum or other emergency, a special City Commission meeting will be automatically scheduled for the Tuesday immediately following the cancelled meeting. In the event of one of the aforementioned circumstances, the special meeting would be held on June 17, 2025, at 9:00 a.m. in the City Commission chambers located at Miami City Hall, 3500 Pan American Drive, Miami, Florida 33133. All of the scheduled agenda items from that cancelled meeting shall automatically be scheduled as an agenda item at the special City Commission meeting. The City Clerk shall notify the public of the special meeting that is to take place by placing a notice of the special City Commission meeting at the entrance of City Hall and the City's main administrative building, placing a notice on the City's website, and, if feasible, placing an ad in a newspaper of general circulation before the special meeting on the immediately following Tuesday. There shall be no additional notice by publication required for any such scheduled agenda item that is moved to the special City Commission meeting.
