Subject: Authorize - Acceptance CDBG Recaptured Funds
Purpose of Item:
AUTHORIZING THE ACCEPTANCE OF RECAPTURED FUNDS FROM COMMUNITY
DEVELOPMENT BLOCK GRANT ("CDBG") IN THE TOTAL AMOUNT OF
$1,545,846.00 FROM PROJECTS THAT FAILED TO MEET PROGRAM
REQUIREMENTS, TO BE ALLOCATED FOR ELIGIBLE CDBG ACTIVITIES;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ALL THE NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS,
AND MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS THAT REGULATE THE
USE OF SUCH FUNDS, FOR SAID PURPOSES.
Background of Item:
On April 11, 2019, pursuant to Resolution No.19-0146 the Department of Housing and
Community Development ("Department") allocated the amount of $1,105,000.00 in
CDBG funds to acquire the properties located at 2445 Southwest 5 Avenue and 471
Southwest 25 Road, Miami, Florida.
Pursuant to Resolution No.21-0387, adopted on September 23, 2021, the Department
allocated the amount of $3,098,006.65 in CDBG Economic Development category,
which included an amount of $440,846.00 to Casa Valentina for land acquisition for
housing.
The above mentioned projects that were awarded funds fail to comply with the terms of
their agreements in a timely manner and the City of Miami ("City") reserves its right to
recapture the funds.
Pursuant to CDBG regulations Part 24 CFR 24 CFR 570.200(k) and 24 CFR
570.480(h), recaptured amount must be used for eligible CDBG activities.
The Department recommends the acceptance of the recaptured funds in the total
amount of $1,545,846.00 from CDBG from projects that failed to meet program
requirements, to be allocated for eligible CDBG activities.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ACCEPTANCE OF COMMUNITY DEVELOPMENT BLOCK
GRANT ("CDBG") RECAPTURED FUNDS IN THE TOTAL AMOUNT OF $1,545,846.00
FROM PROJECTS THAT FAILED TO MEET PROGRAM REQUIREMENTS, TO BE
ALLOCATED FOR ELIGIBLE CDBG ACTIVITIES, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ALL THE
NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND
MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS THAT REGULATE THE
USE OF SUCH FUNDS, FOR SAID PURPOSE.
WHEREAS, on April 11, 2019, pursuant to Resolution No.R-19-0146 the Department of
Housing and Community Development ("Department") allocated the amount of $1,105,000.00 in

WHEREAS, pursuant to Resolution No. R-21-0387, adopted on September 23, 2021,
the Department allocated the amount of $3,098,006.65 in CDBG Economic Development

housing; and
WHEREAS, the above mentioned projects that were awarded funds failed to comply with
the terms of their agreements in a timely manner and the City of Miami ("City") reserves its right
to recapture the funds; and
WHEREAS, pursuant to CDBG regulations Part 24 CFR 24 CFR 570.200(k) and 24
CFR 570.480(h), the recaptured amount must be used for eligible CDBG activities; and
WHEREAS, the Department recommends the acceptance of the recaptured funds from
CDBG in the total amount of $1,545,846.00 from projects that failed to meet program
requirements, to be allocated for eligible CDBG activities, as more particularly described in
Exhibit "A," attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The recapture of CDBG funds, in the total amount of $1,545,846.00 from
projects that failed to meet program requirements, to be allocated for eligible CDBG activities as
more particularly described in Exhibit "A," attached an incorporated, is authorized.'
Section 3. The City Manager is authorized to negotiate and execute any and all
necessary documents, in a form acceptable to the City Attorney, subject to all federal, state, and
local laws that regulate the use of such funds, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
