Subject: Execute - Off System Construction and Maint Agrnmt - FDOT - SR 25/NW 36 St
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute an Off -System Construction and Maintenance Agreement, in
substantially the attached form, with the State of Florida Department of Transportation
("FDOT"), for improvements on State Road 25 /NW 36 Street at the intersection with
NW 18 Ave, Miami, Florida, for General roadway improvements in this corridor,
including improvements on roads not on the State Highway System.
Background of Item:
Florida Department of Transportation ("FDOT") has developed design plans Financial
Management ("FM") Project No. FM 451034-1-52-01 for the updating of pedestrian
ramps with ADA-compliant ramps, construction of high -emphasis crosswalks, addition
of pedestrian push buttons and signs, and upgrading of the intersection to video
detection ("Project") and intends to undertake and complete the Project, a portion of
which includes work on roads not on the State Highway System but City of Miami
("City") right-of-way, specifically along NW 18 Avenue about 115' south of SR-25 / NW
36 Street for the addition of a FPL service point (for purposes of this agreement, the
"Off -System Project Limits"). The Project includes installation of signalization pull boxes
and conduits ("Local Roadway Improvements") and all activities associated with, or
arising out of the construction of the Local Roadway Improvements. The Off -System
Construction and Maintenance Agreement ("Agreement"), attached and incorporated as
Exhibit "A", establishes the terms, conditions, and responsibilities of FDOT and the City
to accomplish the Project and Local Roadway Improvements on the City's Streets. The
City agrees with the terms and conditions in the Agreement, in substantially the
attached form.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD 25 /
NORTHWEST 36 STREET AT THE INTERSECTION WITH NORTHWEST 18
AVENUE, MIAMI, FLORIDA, FOR GENERAL ROADWAY IMPROVEMENTS IN THIS
CORRIDOR, INCLUDING IMPROVEMENTS ON NORTHWEST 18 AVENUE, A ROAD
NOT ON THE STATE HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans for the Financial Management ("FM") Project No. FM 451034-1-52-01 for the updating of
the curb ramps with Americans with Disabilities Act ("ADA") compliant ramps, construction of
high -emphasis crosswalks, addition of pedestrian push buttons and signs, and upgrading of the
intersection with video detection ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, on State Road ("SR")
25/Northwest 36 Street at the intersection with Northwest 18 Avenue (for purposes of this
agreement, the "Off -System Project Limits"); and
WHEREAS, the City of Miami ("City") is the holder of ownership rights to Northwest 18
Avenue, a road not on the State Highway System but which is within the City right-of-way; and
WHEREAS, the Project includes the installation of an additional FPL Service Point at
Northwest 18 Avenue at 115' approximately from intersection of SR 25/Northwest 36 Street at
Northwest 18 Avenue ("Local Roadway Improvements") and all activities associated with, or
arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
Streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT, for the Project on SR 25/Northwest 36 Street at the intersection
with Northwest 18 Avenue, Miami, Florida, which includes improvements on roads not on the
state highway system, and the Local Roadway Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
