Staff Report and Business Impact Statement
Ancillary Dwelling units and Related Stn.,
Purpose:
This Miami 21 Code amendment updates provisions pertaining to Ancillary Dwelling Units
(ADUs) and related Structures. The proposal widens the allowable ADU locations from T3-L to
all T3 Lots that contain a single-family home. Additionally, any Lot within T4, T5, T6, CI -HD,
and D1 that contains a single-family home shall be allowed to benefit from the proposed
ADU provisions. Clarifications are proposed to the definitions, general regulations, unit sizes,
parking, and design standards.
Estimated Direct Economic Impact:
• There will be no additional municipal regulatory costs for businesses.
• Ancillary Dwelling Units (ADUs) are subject to Impact Fees.
• The addition of an ADU may impact the value or homestead status of a property.
• ADUs are more affordable to build than full-sized homes or apartments because they
don't require additional land, elevators, or major infrastructure and use less energy for
heating and cooling.
• ADUs that are rented also provide additional income opportunities for homesteaded
property owners.
Estimated Number of Businesses to be Impacted:
The City of Miami has approximately 36,000 single-family parcels, inclusive of vacant lots.
Twenty percent, or 6,600, of these lots in T3-L and T4 Transect Zones currently allow for an
ADU. By widening the allowable locations, as proposed, an approximate additional 27,000+
parcels developed with a single-family home could potentially also accommodate an ADU.
Additional Information:
Ancillary Dwelling Units (ADUs) are smaller in size than the primary residence and located on
the same lot. They are either located within the Principal Dwelling Building or a standalone
attached or detached structure. ADUs provide additional housing options that contribute to
the creation of compact, pedestrian -oriented communities in accordance with the Miami 21
Code Guiding Principles. ADUs create opportunities for additional housing within single-
family neighborhoods without changing the low scale and detached character.
ADUs also provide opportunities for older adults to "age in place" within their neighborhood
by providing a smaller living space on -site. In certain circumstances, ADUs can make it easier
for families to provide caregiving services to aging parents or allow grandparents to live close
to their grandchildren and support their upbringing.
