AN ORDINANCE TO AMEND SECTIONS 551, 552, 553,
554 AND 556 AND TO REPEAL SECTION 555 OP THE
CODS OP THE CITY OP MIAMI, BATING TO EXCA•
VATIONS IN STREETS AND SIDEWALKS.
SE IT ORDAINED EY THE CITY COUNCIL OP THE 0/TY OP MIAMI*
Section 1. That Section 5$1 of the Coda of the City of
Miami be, and the name is hereby amended to read as follows*
Section 5516 When any person or persons, firm or cor-
poration shall desire to disturb, out into, dig up or excavate
any public street or sidewalk, whether same be paved or unpaved, or to
cause the same to be done, application must be made to the City
Engineer for permission therefor.
Section 2. That Section 552 of the Code of the City of
Miami be, and the same is hereby amended to read as follows:
Section 552. Upon compliance with the terms of the pre-
ceeding section, the City Engineer shall calculate the post of
fully restoring the said street or sidewalk to the condition in
which it may be found upon the filing of such application. The
said cost shall be calculated by the square foot at such reasonable
rates as the City Council may by resolution from time to time pre-
scribe for such work, and thereupon the City Engineer shall prepare
a permit for the said work and shall therein fix such time for the
completion of said work as under all the circumstances will be
reasonable. Such permit shall be in substantially the following
form:

Said cut and axeavation Shall not exaeed

than rest in depth.
(2) The work herein deeoribed and permitted ie to be
completed not later than 1 19, on which
date this permit expires.
(3) Upon oompletion of the aforesaid work the "Inspector's
Approval", properly signed, which is attached to this permit, is
to be returned to the City Engineer's office as notification of
such oompletion and until notification is given in this manner,
the above named is to provide
sufficient lights and danger signals and take all other necessary
precautions for preventing accidents or injuries to persons or
property in or about the work herein permitted.
RECEIPT is hereby acknowledged of the sum of
Dollars in payment for this permit and it is
understood and agreed on the part of the City of Miami that the
said amount covers all charges for repairs to the paving or side-
walk made necessary by reason of the aforesaid cut and excavation
and that said repairs are to be made by the City Street Department
or otherwise at the City's expense.

I agree to the terms of the foregoing permit and undertake
to fully comply therewith.
The applicant ehall pay to the City Engineer the amount of
the cost of said restoration as calculated by the City Engineer
and shall sign his acceptance of the terms of the said permit and
thereupon the said permit shall be delivered to the applicant who
shall thereafter, and not before, be authorised to proceed with
the said work, And shall complete the same within the time pre•
scribed by the said permit.
Section 3• That Section 553 of the Code of the City or
I''Aiami be and the same is hereby amended to read as follows;

complying with the provisions of the last two proceeding eectione6
Section 4. That Section $54 of the Code of the City of
Miami be and the same is hereby amended to read as folloWa:
Section $54. All dieturbanae, digging up or excavation
of streets, avenues, sidewalks, pavements or sidewalk pavements,
in the City of Miami, shall be made under the supervision and di-
rection of the City Engineer.
Section 5. That Section 555 of the Code of the City of
Miami be, and the same is hereby repealed.
Section 6. That Section 556 of the Code of the City of
Miami be, and the same is hereby amended to read as follows:
Section 556. Whoever shall violate any provision of this
ordinance or any provision of Sections 551, 552, 553, or 5 54 of
the City Code, as amended by this ordinance, or whoever shall fail
to comply with the terms and requirements of the permit provided
by Section 552 of the Code of the City of Miami, as amended, by
this ordinance, shall, upon conviction be punished by a fine of not
more than Two Hundred Dollars, or by imprisonment not to exceed
sixty days, or by both such fine and imprisonment.
Section 7. It is hereby declared by the City Council that
the health and welfare of the City of Miami are in peril and that
this ordinance is for the immediate preservation of the public
peace, health and safety, and that this ordinance may therefore
have three readings in one session of the oouncil, and shall go
into effect upon its passage and approval and publication.
