Members present: F. G. Erfert, F. H. Wharton, C. P. Filer, L. Ti Highleyman,
E. C. Romfh. (Councilman Bray absent from the oity)
Chairman Hefty announosd that Mayor Henderson is a.beent from the city and that is
(Hefty) is the acting mayor, so it would be necessary to ohooses a chairman for
this meeting.
On motion duly made and carried, Councilman Erfert was chosen chairman of this
malting.

Mr. Wharton: I think they are still operating.
'r. Romfh: We never did have a conferenoe. We notified them several times we were re!dy
to meet them and go over the matter but they never Dame around.
Mr. Hefty: Mr. Romfh has stated the matter just as it was.
Mr. Romfh: I told them several times I would meat them any afternoon after two (Polo°
but they never •alled on me and I thought the matter had been dropped but they seemed to
be going ahead. There was no agreement enetred into because they never presented it.

The clerk- read a letter from the Evergreen Cemetery Company, dated April 2, 1917,
starting that it had been brought to their attention that there is considerable
opposition to the continuance of the colored cemetery in the city limits and offering
to set aside a tract 150 X 150 in their cemetery and sell lots 10 X 20 to colored
people at h3O. Or th:y offered to sell to the city such a tract for the eutp of $15011.
cash, the city to sell the lots to colored people, the cemetery company to give
the tract reasonable care for °'25, per month; that the tract is not yet platted nor
cleared, but a rock road leads to it. 0r they will clear the tract and give perpetua
care for the sun. of 3500. the city to sell the lots.
The clerk read also several Yettitions and letters from various citizens on the .subject

rr. Jones: The injury done this gentleman was a fracture of the frontal bdne and
another man has a fractured hip and will be laid up six weeks or two months in the
hospital, and that very often leaves a deformity for life. He also suffered outs
and bruises. The Gas.Company had its trucks insured and the men insui d. This man
is broke and out of employment and simply asks for enough money to get back to his
old home to ro to work.
?ter. Wharton: I sympathize with all of them but it looks to be establishing a
precedent we would be sorry for in future.
°omfh: It is not a question of the accident. If most anyone was here in destitute
circumstances and wanted to ;et home, we have bought a number of such tickets. That is
all I would think of doing without any reference to the accident. All I would want
would be a. waiver in case he did sue as it would oost "150 or more to. efend it.

of construction work is under way, caused a serious loss of time and was burdensome to

Mr. Cason: I am informed that 20th Street was platted to the old water edge and if t
the pity gets the filled in portion. I understand the Briokells have not blooked th
extension, simply asserted they own it. I think the way to settle it would be to
improve the extension and aaaeaa the post. It is not in anyonea possession. I notioe
they were very careful to keep the Prickeli apartment house off the extension.
Mr. Murray: The original plat shows 20th Street going down to the waters
end there WAS no reservation of the riparian rights.

EXTENSION OF WATER MAINS AND FIRE PROTECTION POINT VIEW SECTION
The clerk read the following:
"We, the undersigned residents of Point View and Broadway, on account of the
amount of building going on in Broadway, and in view of the fact that more buildings
are going up, respectfully petition that the water mains be extended from Briokell Ave
to Broadway, and from Broadway to the Bay. Also that a fire plug be installed at the
interseotion of Broadway and Briokell Avenue.

::r. Hi,hleymen: That is somethin that should be done; building is going on rapidly. At
my own expense, I furnished all the pike laid in Point View. I have tried repeatedly
to get them to connect up to Broadway,- there is a dead end and the water is often
foul and discolored. The water Company should be made to do something in this case.

The oity engineer rercrted that the Freedlund Const. Co. had several oontracta with the
city which are about completed, but the work has been delayed somewhat account
sever construction for which the Freedluni Co., is not reapobsible, but the bonding
company is calling for another annual premium. The engineer reoomu:ended the bonds be
released by the city as the retrained percentage on the contracts is suffioient to
ensure completion of the contracts.

not you could get this about back beg to advise- that
this might be done,provided,the matter was taken up be-
fore the City Counoil as they have the power under the
Charter to remit fines and aeutenoes.
You stated that you were not the responsible
party in this matter as you were only the Manager of
this Company and:;that Mr.O.J.Martin is the Loom: Agent
and that he shoul;,.have been arrested instead of you._

for trial, and when a party under arrest does not,

`�Mr. Switzer, sanitary inspeotor, stated that a flagrant violation of the laws governing
the maintenance of stables had been found and .A'.r. Martin was served with a warrant,
posted a bond of 10. for his appearance and when the o*se was palled he did not appear
nor delegate anyone to represent him; that in order to maintain the city in sanitary
condition it is necessary to punish those who violate the ordinances regulating
h.alth and sanitary measures and made a strong protest agaipst any refund being made.
No action taken by the counoil.
