McAllister: In the contemplation of the hotel at the corner of 12th and the • roulevard, I expeot to take the atone from the basement and make this fill and turn tne reclaimed land into a nice little park and have a bulk head on one side. It has long been used for a dumping ground right there and at ebb tide a great deal Of trash ao urnulatee. I saw Sheriff Hardie and asked him if he thought it would interfere with navigation and he saia it would not. I also saw the Mayor and he seemed to think it was all right. I know there is some l..tigation between the railroad and the'city as to the o,+nerehip of this bay front land, but I am a friend of both sides. Mr. Ingraham and also iaaj. Ladue will be here soon. I propose to keep it open for the city and will make it as attractive as possible. I want everybody to be satisfied and dvn*t want to do anything objeotionable, but think it would be a permanent improvement. to the water front. I went to Mr. Reilly but he told me to draw the plans, but before the War Department decide they want to know that everybody is satisfied. Mr. Elser, who owns the bay front at the foot of 12th St. wants to take away the little buildings and I' think he will join, me in this improvement. I will put in a nioe element wall. err. Highleyman: How far out do you expect to go? mre.Mo. As far as I have stone, out about the east end of the Fair Building. I will build a sea wall and have bulkheads on the aides, the front of oonorete and the sides piling, but if Mr. Eller joins me there will be no need for a bulkhead on the ' south side. I don't expect to put any building on it, no sir, never. I want•to utilize it for a park. Mr. Highleyman: You will dedicate it for a park? Chairman: She would have no right. ors. MoAllister: Yes, sir, whatever right I have. If the oity or the railroad owns it 1 will try and keep it up. I have 140 feet fronting on the Boulevard and everybody has always figured the same distanoe on the bay shore, and the railroad has always given the lot owners along the Boulevard the privilege of filling in. ,•1r. Ralston: This is really a form matter so far as the oity goes and I don't believe objection would have any weight with the War Department beoause all they oare about is protecting navigation. In these tabulations -therefore, I have ma-e no(e ) allowance whatever for engineering, and con- tingencies, a matter which should not exceed 413,000.00 In order to reduoe the net cost of eaoh structure to 475,000.0D it is therefore neoeseary to affect a further reduction on the Twelfth Street bridge of $4,534.0 and`on the Avenue "D" bridge of $7,276.15. In order to affeot this reduction I reoommend the elimination of oer- tain items as noted below and have also oontemplated a ohange in plans ten,: orary structures to carry traffic during oonstruotion. In the temporary structure at Twelfth Street I have oontemplated the substitution of the swing span no in use at the Twelfth Street bridge for the timber jack knife span -•_roposed in our original plans. This ohange in construc- tion will effect a saving of 62,000.00.0t !&venue no. I have contemplated ,,he use of te. orary structure for carrying pedestrians only. In Re Dade County Bond Issue. 1916. $150.000 In response to your request for an opinion as to whether or not the proposed issue of $50,000 of Bonds by Dade 4* County for the purpose of contributing toward the cost of erect- ing two Bridges in the City of Miami, one at Avenue "D" and one at 12th. Street, would have to be used in retiring a portion of the $150,000 Bond Issue of the City of Miami voted for this pur- pose, or whether it could be used to pay the additional oost of the Bridges over and above the $150,000 appropriated by the City, beg to advise that the general understanding of the County Commissioners was that this money was to be used to retire a part of the City's Bond Issue of $150,000. However, in preparing the Resolutions for the Bond Issue of Dade County the item for the Bridges for the City of Miami reads as follows: "Be it further Resolved that Dade County expend the sum of $50,000 for the purpose of assisting the City of Miami to erect two Bridges across the Miami River con- necting the public highways, one at 12th. Street and the other at Avenue "D" and that Bonds be issued in the sum of $50,000 for that purpose". In view of the fact that the Resolution as pre- pared, and as will probably be adopted, does not state that•the money to be derived from the sale of the Bonds shall be used to retire part of the City Bonds, in my opinion there is nothing to prevent the City from using this $50,000 for defraying the addit- ional cost of the Bridges. This opinion is based entirely upon the legal phases of the matter. The Board of County Commissioners has not yet called a Bond Election. The Resolutions, however, have been prepared and are now being passed upon by Bond Attorneys in New York. The Resolutions will not be passed until they have been approved' by Messrs. Dillon, Thomson & Clay of New York. If approvp'd in their present form the Board will pass them in that terra. The Board expect to take aotion on the matter at their, regular meeting in Maroh.
