BURCH rr) RF'PUCTION II LIONar, FEE CHARGED FOR OPERATING SIGHT SEEING OARS "To the Honorable City Council: The undersigned petitioner would respectfully represent unto your body that he is a resident of the oity of miami and has been for a number of years; that he is engaged in the operation of a bus lino running from Miami to Cocoanut Grove on the Bay Route, returning by the Waverly Route through Musa Isle; that this is a regular schedule route for one oar while another oar makes the trip to Aroh Creek and return; that the lioense oruinanoo of the oity of Miami enumerates bus lines and fixes the license for their operation in the sum of 425. Under another heading they enumerate sightseeing oars, the tax on the e is fixedat,$100. Your petitioner further represents that in procuring lioensas that he was required to pay the sum of 4100. on each of these oars, while other automobiles of a similar charaoter are paying only the sum of $35. operating as buses. Your petitioner respectfully represents to you that this is discrimination and PRAYS thet you grant to him a refund on the license paid for in the sum of the difference between 470. the amount he should have paid and the sum of 4200. the amount aotually paid, viz: the sum of 4130. Gautier, representing Mr. Burch, requested that council take up and dispose of the mat.er as quickly as possible, homfh: As I understand it, a bus line is one that operates on a regular schedule, and a sight seeing oar is one that stands on the streets until it fills up and them goes out On its trip; they don't make regular stops to let people on and off. It seems to me to be a different business. ..r. Gautier: I don't believe the sightseeing oars have any regulation tnat prohibits their stop in_ an.. allowing people to get on and off. r. Romfh: Don't they charge ao much per round trip? r. Gautier: Yee, sir, an. so do the others; they charge so much for one trip and pay the -same to get back,- it i. in effect the same. I suppose the sight seeing oare would let a man atop at the other end if he wanted to. .r. Romfh: Any. ..olieot fure for the rounu trip. r. Gautier: if it is a reasonable classification, ear. Burch will have to stand by it, but it strikes me as unreasonable for tr,is line of business. Then again, it is ..isoriwinat,ion, in a manner. None of the private oars pay anything like that. There is no particular orlosition in these other lines of traffio hauling people that I oan see, the rate is more or less reasonable - they do charge 41.00 for the rounu trip and I should say between 15 an, 20 p:ople ride in them. There are teo questions involved,- is it a reasonable classification, ie the opinion of th.. city attorney, and if not is the council willing to make the rebate regardless of the opinion. I think it only fair to get the city atorney's opinion en it. I have not talked to him. This will only last about three months and this man is oalledon to pay the full rate of 4100 per oar for the short time they operate eounoilman Hiehleyman thought some special arrangement, say six months, should be made if they are only to operate the oars three months out of the year. ..;oven by I. City Attorney Cason: I think it is a matter to be decidecby council. You have a legal right to impose that tax if you see fit. I think it was the desire to reach the people who come down here for only a few months each year and engage in business without payint_ a license. I believe .ter. Buroh is a tax payer here and that the law was passed to reach the people who stay a few months, damage the streets and leave when the season is over. I think it for council to decide whether it is just to impose the tax under the circumstances. Ward, compiler of the bo:klet, dated January 20, 1916 advising that he is in receipt of requests from representatives of various railroads throughout the United States for copies of the book for distribution and stating that the Chamber of eomr;.eroo is without funds for the purpose; Mr. Ward offering to furnish the books at cost, viz 4%300. per thousand. The offer is 4600 eacrh, the owner to move the oottages or 4500 and the oity move them, whioh I figure about the same. The lots are in the low part of the blook and oertainly the least d3ioe of the blook. We bought the property on a basis of 4500. per lot. and I would not recommend the purohase of these three lots at that price. I told Mr. Brossier he oould explain the oase to council if he oared to. :dr. G. D. Broeaier: All the members of the old oounoil are familiar with this trans- action. I took it up 'ith council over a year ago and the basis was we were to sell 17 lots in the blook because there were three lots that had oottages on them an a m mortgage on each. I think it was ;ur. Romfh and IIr. MoDonald looked the ground over and :dr. Romfh asked if there were 20 lots and I told him there was 20 in the block but three under mortgage and we could not sell them. At that time the pity had no funds and we had to negotiate with :,frs. Briokell to ao.;ept the oity'saper and site the owner credit ens-h#a-Ie4e or other lots for this paper on terms of OO . oash on one and $1000 on the other. It rocked along until about March from September before final disposition and Mrs. Briokell had agreed to take the oity's paper at qt for the 8500 for the 17 lots but during the delay she changed her mind and said she had to have cash. and we were forced, in order to make the sale to the oity to sell the 17 lots to another individual at a discunt of 41,000. and that individual took the city's paper for 48500. The six months before we were expecting to get the face value of.,the3 oontract and the city agreed to payrin one year at 8% There was some question about the title to the three lots and the city attorney at that time demanded that a bond of 4500 be put up We got up the bond and I was here several times tryinj; to get the resolution thorough to put the sale in effeot, but understand the foemer reaolution was repealed and there is where the wetter stood. We feel we have lct tree interest on 41500 and lost 41,000 besides in. perfeoting this sale and we are aakine enev .;1500 for the lots whioh is 4150 less than lots aoross the street are oeingof:ered and a great deal lase than lots sold for ,opposite the park. -r. Rals Jn: I was not the park . ommittee..,an when this came up and don't know anything; about tau history of the case, but taking the matter as it presents itself, there are three lots - there is no use comparing them with lots on the other side as they are very low but I don't think subject to over flow - and we only paid 4500 for each lot including the beautiful site on the hill and I would reoom..end, in order to get the mat tr out of the lvay that a flat price of 41500 for the three lots, they to mote the houses. ..loved by E.
