After the announcement, the following omplaint of Mrs. Mary Briokell was presented and read by the clerk. I I Members of the City uounoil, iamb, Florida. entlemen: i Please give this remonstranoe against the confirmation of your resolution $o. 927, highway improvement No. 21, your oareful consideration. This resolution expreeses our intention to improve 26th St. from the west side of Briokell Avenue to the east side f Avenue E, in the manner therein speoified. My objeotione to the improvement are: let. There is only one house of any description on either side of this highway .long its entire length. 2nd. Broadway, near to this street, is being improved between the same two bgibwa $etween which it ie prop^sad to improve ?Bth Street and will answer all neoessi'.ies of raffio demanded by that sparsely settled community. b •This is also my remonstrance as to the confirmation of your Resolution No. 926, Highway Improvement No. 20, as far as it pertains to the improvement specified of Avenue H between 16th and 17th Streets, no objections being made to the propoeed improvement of Ave 3 between 17th and 20th Streets. The reasons for remonstrance are: ghway "Miami, Florida, November 11, 1915. let. There are no improvements between 16th and 17th Streets exbept an old shaoklei plat house unused by anyone, nor will the improvement induoe any traffic there. There oan be no resultant benefit to any ono in making this out of the way improvement. These remonstrances are respectfully submitted pursuant to your notion heretofore published specifying this day as the one for hearing these objeotione. (Mary Briokell." t ,ounoilran Wharton: I have not been over the ground and know nothing of it ad these plans sere prepared before I name into offioe. 0ouncilman Romfh: I suggest that these two imrpovements be deferred until the street committeeman can look over the ground and consult the property owners. O airman Hefty: We had a general petition here from the south side association. nlr. Freedlund: These improvements were first talked over at a meeting of our association 1 1 was a member of a committee to interview the peopj.eand all we met were anxious to have e improvements made and argued for their particular streets. 26th 8t. was asked for beoause c,f the sohool children, who have to cross over through there. The sohool,is on 25th St and children coming from the Bay shore, there ie no way for them to gat aorose as 25th St woes not go through. About Avenue H, the oommittee saw a great many people but did not see Mrs. Briokell. Mr. Switzer: In regard to 26th St. I believe there was a petition from the property owners of Point View because there le no crossing between 20th and Broadway to enable the children to -et t sohool. I live on 26th St and admit in a shaok and have been waiting to have 36, t q ened so I can get the material in to my lot to build a house. I bought a lot ore,. 't etreet ree years ago and put up a shaok and have made no, protest since Miami Avenue was oompletei pd your engineer will agree with me that there is a 3i foot drop from Miami Abenue to 26th treet and it ie almost impossible to have our groceries delivered to us. Going further, ;would like to say that Mr. uharles Briokell signed this petition to Upon 26th Street from iokell to Avenue E. When we asked him about this he said "Mother oaloulatee to put a ewer down there and I said "that would not interfere with the sewer iS the street agraded for then it wont be as much trouble to put in the sewer" and he said "that is all ght, Mother will agree, and I think it is a good improvement". So we went along th the petition and it was acoepted by everybody and we have never said a word since; and he mprehensive plan of street improvements on the south side was gove over very oarefully ands jority of the property owners have asked for these improvements. We should have these 0 reete and I think the council agrees that we need them and not foroe us to go through tube weeds. An owner over there has • repeatedly put up signs to keep off hie property but the children go through there and •": he says nothing about it. 26th Street is as aeaeseary to be opened as any street in the oity, all the people who live in Point View would oome through thereto the oenter of the city. I am very much interested in seeing it opened. Moved by F. H. Wharton, seconded by F. G. Erfert that the oity prooe d with the improvements as have been advertised. Motion oarried. Mr. Wharton: I don't think it will be a hardship on Mrs. Briokell and will oertainly be a oonvenienoe to quite a number of people and for that reason I do not think we should hold it up. Adolph Fresdlund requested that council consider the matter of opening 24th St over he F E C tracks, it being dangerous for children to oross to the school; that the crossing ,ad been petitioned for. Mr. Wharton: Is the street opened up to the right of ways '114r. Switzer: It is opened to Avenue E and to Avenue F, the railroad running between those streets Engr. Klyoe: Council would have to condemn or get permission from the railvcaq to oroae its tra vke. f, Moved by L. C. Romfh, seconded by F. G. Erfert, that the street oommitteeman inveetigate the crossing of 24th Street over F E C and reportt: council. Motion oarried. WIDTH OF STREETS Mr. h�mfh stated tnat he noted some of the streets authorized to be improved are out down to 22 ft and thought it might be well to improve only one street to that width and see what the property owners thought of it. That while it had been advertised and some contracts let, thus complying with the law, and while in his opinion 20ft, on the side streets ie sufficient, yet the property owners should have an opportunity to say whether it ie agreeable with them. Chairman Hefty: A ;great deal has been said about allowing for parking space between the sidewalk and curb, especially in the residenoe districts, and that this will allow for 4 ft parkin;; apace and 5 ft sidewalks; that this had been advocated by the Chamber of Commerce, the Improvement Asaoolations and many others. SIDEWALKS !Mr. Wharton called attention of eounoil to the fact that there is a space on Avenue D betw .,4th and 5th St., 50 ft. where sidewalk has not been constructed and asked why it had been 'overlooked; that the property belongs to D. Afremow, who had said he was not going to .build the walk. Engr. Klyoe stated that he had no information as to why it was not inoluded, the sidewalk _work having been done under the former engineer and that there are a great many gapw of this nature throughout the city, moved by E. C. Romfh, Seoonded by F. G. Erfert, that the street committeeman and engineer prepare plans for oonstruotion of sidewalks throughout the oity where there breaks o0our.-- tdotion carried. CONDITION OF SIXTH STREET BETWEEN AVENUES C AND D Councilman Erfert called attention to oondition of 6th St between 0 and D; that tic yard is using the sidewalk space and part of the street for stacking their lumber''' one building a hulls: and using the street for temporary store are required to.pr. lights, but that this lumber is etaoked out beyond the line of poles; that a lua is all right in its p?.aoe but this one is obstructing the streets, that 6th $' p be cleaned up and paved and sidewalks put down. Mr. Wharton: That is a job for the chief of polioe. Wharton: I have a memo. here from the auditor oalling my attention to the fact that the ighting bills for Sept. are 4400. over the appropriation, hairman: I don't Bee how we oan remedy it, but there are some plaoee where there are more ights than needed. ARKING OF AUTOMOBILES r. Wharton: Two or three young fellows here have leased this blook between D and E and the ant two poles put in for lights, and want tohe oity to haul off suoh refuse as will not. •urn, and I rather encouraged them for I think it is ooming to a point where we will ave to have parking epaoe somewhere and if these men want to take it up and provide parkin epace for automobiles and haoks, I believe we should enoourage it. There are only ten or welve llads of rook, whioh we oan probably use, but the two light poles I refer to oounoil ney will coat probably 425. hairman: I understand the poles do not cost anything, only the lights. I believe we should ncourage the move. I don't beliefs we should haul oftthe trash, but might help them a ittle on the lighting proposition. r. Wharton: We don't propose to pay the light bills, I didn't figure on the oity pairing or the lights at all Erfert: I think it a wise move and we should assit them in some way, but don't think we hould assume any of the light bills. oved by E. ALLEN'S PROPERTY ON BISCAYNE DRIVE t r. Wharton reported that the telephone oompany has erected a pole in the middle of the xtranoe to tnie property so that the owner oan not drive in or out; tnat the city engineer idn't give them permission to erect the pole. ity Attorney Rose: I would out it down. 1 don't thine they have right to seta line. t;ity Engineer Klyoe: They askew me to give them a line on that street, saying they anted to be sure to get in the street. The fence along the property mentioned by Mr. harton is about where the curb line wilt be when the street is improved and the telephone ompany wants to set the pole behind the fence, on the man's property, but he would not allow it and they want the street line claiming they have a right, under the law, to set a )(pole anyehere they want to in the street and I told them I would not give them a line but i tney had a rignt oto put the pole there I couldn't help it, that would be a question betwee Ihem and the property owner City Attorney: I don't know whether the city has, by ordinance, regulated true matter, but of not it oan be done. Wharton, the bill was ordered paid and the auditor instructed to draw a voucher. Motion carried. ALBERT WILLIAMS VS THE CITY OF MIAMI Oity Attorney Rose presented the following letter, which was read by the clerk "November 11, 1915. ao tne City Council, ciama, Florida. yrentlemen: Judgment was rendered in the county court against the city on November 10, four 455. Warrant ehoulu be iseuea to pay this judgment ana costs, the total of whioh amounts to $66.32. A. J. Rose, 1 city Attorney. v Rose explained tnat last year suit was instituted by Williams to oolleot a fine imposed y tne Municipal Judge, for selling liquor without license, claiming there was no law provic ng for the fine which was paid under protest. That there was one mietrail of the oase but ast week the court rendered a ver:iiot in fav r of Williams and there is no appeal. and eked that voucher be authorized as execution mignt issue on the bond. S. Haisten has produced a certificate from a reputable physician stating that he is physically unable to do manual labor, this permit allowing the said S. S. Haisten to peddle without a lioenee is issued under the laws of Florida Section 596uu. Samuel J. Baroo, county Judge." me cle k explained that Haisten applied to the mayor for a similar permit and the mayor has requested that the matter be referred to oouncil. Moved by E U. Of couree it is up to the mayor but I would like to know what has come to pace. 1 don't like to fire a roan one week and hire him the next, if he was a.11 right then there was no reason to dismiss him, and if he was not all riEht then he is nct all right now. :,r. Romfh: 1 understand when a new administration comes in the patrolmen hold until their successors ape appointed. unless we know of some reason why he should not be on the force I never have been opposed to a man's appointment and have only voted against one appoint- ment by the ...ayor and that was of Fredericks, the engineer; unless I know something positively against a man I don't feel like voting against the appointments of the Mayor. ACCOUNTING UNIFORM METHOD MUNICIPAL AC^OUNTING IN AC".ORDANCE WITH ACT OF LEGISLATURE 1915 The olerk read the following letter from City Attorney Rose: "November 9, 1915. To the City Council, Miami, Florida. Gentlemen: The legislature passed an Aot approved June 5, 1915 providing for a uniform method of municipal aocounting whioh includes financial reports from every municipality within the state at least as often as once a year, on forme prescribed by the comptroller. These forms were reoeived by me from the oomptroller some days ago and have been delivered to the pity auditor. The first accounting required is one that shall show the financial condition of the oity as of Deoember 31, 1915. This is a duty that must be performed by the oity auditor and the council should direot the making up of such report showing the financial condition of the city as of December 31, 1915. .0011.
