TAXES REQUEST OF SOUTH ATLANTIC FISHERIES FOR REFUND OF CITY LICENSE TAX "Miami, Florida, October 39, 1915. Ur. W. B. Moore, City Clerk, Miami, Florida. Eear Sir: On Ootober 22nd, 1914, you issued to ourselves a oity lioense as a wholesale skipper of fresh fish. The Florida legislature has passed an aot to protect and regulate ;the salt water fishing industry and imposed a license. The aot further says that no city town or munioipality ehall impose any further lioense tax. (Soo 14 of the General and $peoial Laws relating to Salt Water Fisheries.) n view of the above we wish to ask for a remittance of the amount of the-lioen�0 paid I South Atlantic Fiskeries, per #0,X ;s Moved by E 0 Romfk, seconded by 0 F Filer that the oommunioation be reooived ai# referred to the oity attorney for an opinion on t*e matter. motion WOO Regular meeting of council Thursday Nortember 4, 1915. POLICE SERVICE REQUEST FOR TRAFFIC OFFICER TO BE STATIONED AT SEVENTY AND AVENUE D the olerk read a petition signed by fifteen merohadts in the vioinity of Avenue D and 7th Street requesting thatla, traffic officer be stationed at that corner. Moved by E. 0? Romfh, eeoonded by C. F. Tiler that the matter be referred to the Mayor and Chief of Police. Motion carried. LEGAL PRINTING BIDS OF METROPOLIS AND HERALD. The olerk read the bid of the Herald dated Ootober 28, 1915, for legal printing for tke ensuing year at the rate of 75¢ per column inoh for first insertion and 37i¢ for subsequent insertions; all reports of publio interest free of oost. • The Metropolis bid was on the legal rates. A representative of the Herald was present and stated that the legal rate is $1. per inok for first insertion and 50¢ for subsequent insertions and that their bid is 25% lower. Counoilman Erfert stated that he is surprised that the Metropolis would ask for the printing again; that oounoil kad gone on reoord as willing to give the advertising to eaoh paper for two years and that the Metropolie is now going into its fourth year. Moved by F. G. Erfert, eeoonded by that the printing be given to the Herald because tkey have been oheated out of it two years and I think they are entitled to it. Councilman Romfk: I simply want a definite statement as to which is tke lowest bid; taking Mr. Coklin's word for it, tke Metropolis is higher and if the Hearald has tke low bid, giv it to them. Mr. Connklin: uour auditor knows that you have been paying $1. per inok and our bid is 25% lower. Chairman Hefty; if we are to advertise for bids I think we can get other propositions; I believe the Labor Journal would want to Dome in with a bid and I tkink it would be about one fourth the legal rate and if the rate per inok is to be considered I think the best thing we oan do is to advertise for bide. Councilman Wharton: If we are to have our notioee printed we want to have it done by a paper of general oiroulation and I second Mr. Erf ert's motion on the aseuuttion a that tke Herald has the low bid. Mr. Conklin: If there is a representative of the Metropolis here and he will not say. ours is the lowest bid we will withdraw it. Counoilman Ralston: We certainly reserve the right to select the beet as well as the lower bidder. I am not going to make a speeoh about either paper, but I would oertainly vote against Mr. Erfert'e motion and I don't mind telling you why. Everything this oounoil has endeavored to do, it has kad the.support of tke Metropolis and the other paper has supported the plan %l►to every oounoilmsn knew and knows 'mill have orippled tkie oity, would have exhausted our bonding owcaoity and would. natal not have constru aced out docks or tke skip okanne.; the Board of fealtk has been supported by tke afternoon paperaand praot.ioa22y every forward wove by tke Board Age been fougkt consistently by tke morning paper. If the oounoil okooses to go on reoord as backing the man who etruok us, all right; but I will vote against it. Counoilman Higkleyman: While the Herald did not agree with my stand when I ran for this oounoil, I regard it as capable of handling the proposition as the other paper and I stand for effioienoy provided we can get tke best at tke lowest prioe; it is not 'a question of animosity with me but what is the oheapeat we oan get for the city and I will vote for the Herald if their bid is lower than the Metropolis. Counoilman Romfh: It is true that the Metropolis has supported the polioies which, to my way of thinking are for the best interests of the oity but I don't think that has any- , thing to do witk the price of advertising and on an even basis I should give it to tke Metropolis but when they make a bid 25% lower, and while I had ralher give it to the other paper on an equal basis, I can not give it to them on a higher basis. Chairman Hefty: Do we oonsider these as bide to night? Councilman Romfh: You permitted them to be opened. Chairman Hefty: Were they marked bide? Clerk Moore: I said they were bids from the twoppaper©. Chairman Hefty: Ite possible we could get a rate 50% less. Counoilman Rumfk: The question of fair play oomes in. While I am heart and soul for the Metropolis, I wont do anything unfair. I would not be willing to oonsider a paper with praotioally no oiroulation at all; the oiroulation of the two daily papers is about the same, tkey reach the people ' Councilman Erfert: This same thing came up last time; the Labor Journal is a weekly and D tkink the attorney stated it must be a daily paper.- 'uounoilman Higkleyman: I would vote for the Metropolis on an even rate. Councilman Ralston: If I had not heard Mr. Romfh and others here vote for a higher bid at times, I would think that a good stand. Councilman Romfh: That is all right where outsiders are bidding against iome concerns. Counoilman Wharton offered the following substitute nation: Moved by F. H. Wharton, eeoonded by L. T. That at every high tide the street is flooded from 11th St to Avenue M, and this oondition obtains within a few blooks.of the court house; that the attention of oounoil and the street superintendent has been called to this oondition several times and some rook kat been spread on the surface but no permanent repairs have been made; that the street should be built up so water will not run over it at high tide. OSCEOLA ROAD AND WEST TWELFTH STREET Mr. Rogers addressed council uaging the improvement of Oeoeola road and 12th Street from Avenue M westwardly, stating that sinoe the street oar traok has been oonstruoted, there is no driveway on the southside for the passage of vehicles when meeting a street oar forcing vehicles to turn out against traffic, which is very dangerous; also request- ed the immediate improvement of Oeoeola road. Engineer Klyoe stated there is a sewer to be oonetruoted on the south aide of lath St. and the present intention, beoause of this underground work, is to oil only the north, side of lath Street; that the repairs to Oeoeola road will be taken up shortly and bids for the work be advertised in a few days. BUILDING PERMITS REPAIRS AND ALTERATIONS FRAME SCHOOL BUILDING ON 9th St. NEAR AVE D Mr. B. E. Willis stated that he had recently purchased the aald frame sokool buildings and property on 9th Street near Avenue D and proposed to move two of the buildings away and wanted to move a portion of one building in front of another and oonneot them up and remodel the reoonetruoted building for a rooming house and requested a permit to do o; that he would tear down the balanoe and improve the auditorium; that he made application for a grmit but the building Inspector went to see tee city attorney and tken advleed 'sAiL,%44 go bt4ort bit council and stets t`st olzoumetanots. Mr. Seltzer stated that the building is a frame struoture, will be in the new fire limitt8 and he didn't know whether he had a right to issue a permit. Mr. Willie wanted to know what difference it would make if he improved the building in question, tore down the others, and that when he got it finished it would be up to date and in better shape than any frame building in the vioinity. That he just wants to shove part of one tuilding over in front of another and join them up and use only a few bhards; the greater part of the work being painting and outting the building into rooms Chairman Hefty asked Mr. Seltzer if this building was condemned sometime ago. Mr. Seltzer replied: They have their notion and this application was made after the notice was served. Chairman Hefty stated that he didn't see that oounoil could do anything as the inspector had refused to issue a permit. MO. Seltzer stated he refused to grant a permit on the grounds that the extension of the fire limits is under consideration and this building would be within the new lines. Moved by F. H. Counoilman Erfert stated there is no use referring the matter to him as the buidling has been oondemned and that is the end of it; that this gentleman wants a permit to improve the buidling and he is not in favor of wooden buildings in the fire limits. Mr. Willie stated that council could not oondemn the buildings he had purchased unless all the buildings in that street (9th ) are oondemned; that there is not a better frame struoture in town and if the building is condemned oity will have to pay for it an that keproposes to fix the buidling. Chairman Hefty: Mr. Wharton offered a motion; what disposition do you wish to rake of it Counoilman Romfh: If it is in violation of a city ordinanoe we will enforce the ordinana but if not, we can't stop a man from doing something that is not a violation; if we pass the fire limit ordinanoe to night we oan stop him but if not he oan go ahead. Erfert, the same were ordered received and paid. • Oounoilman Romfh called attention to the exoess over the budget allowanoee in several de artmente and to the fact that it is in violation of oharter provisions to exceed the appropriations made for operating and maintenance exenses and requested the oommitteeman to secure a statement from the auditor; thatpossibly part of an allowanoe made for oertain expenses could be transferred so as to make up for a particular shortage, but impressed upon the committeemen that the departmental ex enses as a whole must be kept within the budget allowance; also nailed partioular attention that the street department pay roll exoess is $923. Mr. Ralston stated that $3500 of the appropriation of $5,000. had been diebureed but that the parks are now in good shape, but the the remainder of $1500 would enable the park department only to keep the parks in shape but would not permit any further improvements Mr. Romfh stated that a great many requests for donations are made on the city and it is not always possible to say just what is unappropriated and suggested that hereafter no donation of any kind be made unless the auditor certify that the funds are available LICENSE TAXES INTERURBAN JITNEY LINES Chairman Hefty stated that the request of the White Line should reoetwe further oonsideration and stated that other pities are not taxing them. Councilman Romfh: Most of them have paid but that oan be refunded and the others allowed to operate without paying the tax and inetruotione issued that they not be arrested, but I think the attorney might want to look into it. Councilman Wharton: That is their business and we all have to pay a lioense tax and while I would like to see al lioensee abolished, I say that so long as it is an ordinanoe and other businesses pay a license, I don't believe in exempting one. They interfere, to an extent, with other business that pays lioensee, haoke and other vehioles, they use cur. ,streets and parking spaoe, require the service of the polioe and I don't believe We ghoul exempt them as I understand the license is only $10. City Clerk: It is $20. Councilman Romfh: They are certainly a benefit. Councilman Wgarton: So are the banks but they pay a license. Chairman: We must look at it from both sides; we will probably have more lines this winter but not if we tax them and every lines brings people into Miami and also• afrorde oonvenient traveling facilities for the people to get out of town as they make five or six trips daily and there are only one or two trains and believe it is a mistake for the oity to tax them, in other parts of the state the oities are not doing so.
