ANT) W! PEAAS, The said CITY OF MAiI; Florida, has made provision for constructing the
terminal facilities aforesaid and has taken preliminary steps to raise the necessary
funds, by an issue of bonds, for the performance of said work;
NOW THEFtF'F'ORF, If the said CITY OF MAUI, Florida, shall and will in all respects duly
fully perfo:.:r the work hereinafter, specified, according to the true intent and meaning
of the requirement of Congress aforesaid, that is to say, shall promptly construct the pie
and slip and dig the basin and the channel aorosp the bay, all as shown on the. Randolph
plan, which plan for said purpose and to that extent is hereby adopted by reference and
wade a. part hereof; shahl provide rail connections and switching arrangements satiefacto4y
to the Chief of Engineers • connect the turning basin in front of the city wharf with
th3 turning: basin in front of the railroad wharf; and shall maintain in the turning;
basin and channels aoroee the bay dug by said city, for at least three years after
the entrance channel is completed by the United States, a depth of nit less than
Btg?rteen feet, and inthe channel from the city turning basin to thL- railroad

railroad. In order to complete thiM work in t;.e shortest possible time, regardlees
of the c..:tvenienoe of the public, the proper e: to do W .u1.1 be to allow the. to go a
ahead and lay their tracks as rapidly as poeeibie, following with the pav n -.
Necessarily, however, the paving will be co..i leted about two weeks :after the street
is opened up for the laying of the tracks. Accordingly, as it will regoire about
three weeks to lay tho tracks, supposing they are allowed to sc ahead without .any
interruption, about two weeks later the pavir+- would be ec:c.F.leted. However, this
would involve the obstruction of the streets more or less along the entire length of
Avenue C from about 8th street to 12th street and on 12 th street to' the F:1 .O
tracks. If, however, it is desired to not obstruct so many streets and require them
to lay the tracks and complete the pavement or Avenue C before opening Up 12th
street, this will require acne two weeks longer. So that it eeems.there are two
alternatives, one to get through the whole work in abo. t five and a half weeks,
supposing that the paving materials one iw promptly, and to obstruot practically
the whole district mentioned on both Avenue 0 and lath Street, except, say, for an
occasional crossing. The other is to entirely cca,pfete the work cr. Avenue C
before do..n;g' any worts on l2th street. lathe first case you will et three h some
two weeks sooner than in the second.

Ralston: That's the impreteion I Got from the newspaper; that we have lost the blocks
and possibly stand as, suit, but if we say to the Traction Company that they must use the
blocks they will.use them and if Manley & Stearns send in as, bill and the Ta►tum's refuse
to pay and the City refueeeto pay, we will probably stand for suit against the Tatums and
a edit of _a.taniey :z Stene ::against the City and we have made uee of the wood blocks anyway.
