Gentlemen s -
Attached hereto you will find a oommunication from Chief of Police, W.J.Whitman,
'which fully explains itself.
I beg to say to Your Honorable Body that I have investigated this matter and failed
to find evidence to substantiate any charge against Mr. Whitman, other than Drunkenness,
which he admits.
I have not talked with Mrs. Ritchie about this matter, but through her husband, had
en, appointment with her, but he oanoelled the appointment.
I also attach hereto a oopy of a communication I sent Mr. Whitman in regard to this
matter
I wish to state to Your Honorable Body that under no circumstances will I tolerate
drunkenness on the Police Force, especially by the Chief, but knowing Mr. Whitman to be
greatly humiliated and truly sorry, and this being the first offense, so far as I know,
and he promising so faithfully never again to take a drop of liquor while in the service,
I deoided to give him a chance to redeem himself and demonstrate to the people, with
whom he has lived so long, and who at the Election ahowed their faith and oonfidenoe in
him by giving him such a flattering vote, that their faith and confidence was not mis-
placed.
I will state further that while I do not anticipate any more trouble with him from
drunkenness, yet should it ever occur again, he will immediately be discharged from the
service.
It gives me pleasure to state that during Mr. Whitman's administration, the Police
Force has done very efficient service, and has been nearly self sustaining. No hold-ups,
burglaries, or robberies were committed in Miami during last winter, but several suspioious
parties were driven from the city.
While this is a very unfortunate occurrence, I am satisfied it will be a very severe
lesson to Mr. Whitman, and I earnestly believe he will render in the future the very beat
service that he possibly can, if given an opportunity to do so.

Dear Sir: -
I wish to make to you a statement in regard to the charges published in the
Metropolis of the 27th.
The true facts are as follows: I was somewhat intoxicated, I am truly sorry to say,
. I drove up to that section of the city in search of an old lady with four or five grand-
children, that are dependant upon her, and they being in straitened elrcumstaneea,and as
you will remember you wished me to look into the matter, aid not knowing exactly where
to find this party and seeing Mrs. Ritchie on the porch, I stopped and went into inquire
whether or not she could give me the address of the old lady, and I suppose Mrs. Ritchie
seeing my condition, became startled and rose to go in the house, then I tried to explain
that I was the Chief of Police, and pointed to my badge. Nothing was farther from my .
thoughts than any intention of frightening or insulting Mrs. Ritchie.
I can only say that I am very sorry that this occurred and wish to apologize for the
aame,I admit that I was intoxicated, and also give my word of honor, that I will not again
use liquor while I remain in office.

My dear Sir: -
Yours of May 28th reoeived, and replying to same, will say that I regret
very much to know that you were so derelict of your duty as to get intoxicated, as
stated in your letter. You were elected to this position by a large vote, showing that
the people had faith and confidence in you, and you should not have abused it in such
a manner.
I desire to thoroughly impress upon you that under no circumstances will I tolerate
drunkenness on the Police Force, especially by the Chief,who is at the head of the de-
partment, and whose every act should be above reproach.
I have given this mutter much oonsideration and serious thought, and as you have made
an efficient officer up to this time, and promising so faithfully never to do so again
nbile in the service, I have decided to give you one more chance, and I earnestly hope
that you will conduct yourself in the future in such a manner that I will never have cause
to regret having done so.

from the Police Force Mr. harry Lee and Mr. Frank McDade, for conduct unbecoming an
officer, to wit,- "Being drunk and disorderly". I wish to say that this is the second
time charges have been made against these gentlemen. I ask your approval of the same.

Moved by E. C. Romfh, seconded by J. A. McDonald, that the action of the Mayor
in discharging Harry Lee and Frank ''oDade from the Police Force be approved. Motion
carried.
After discussing the preposition of discharging policemen without giving them a
hearing, the following motion was made.
'roved by J. A. Conrad, seconded by C. F. Filer, that before any action le taken
in reference to discharging H. E. Lee and F. L. McDade from the police force that they
be allowed to appear Monday night June 8th for a hearing and that they be suspended
during the time. Motion carried.
H. G. Ralston thought under the circumstances that the Chief ought to be suspended
too, but although he hated to sustain Mr. Conrad's motion, he would do so. The City
Attorney explained that according to the Charter the man had a right of a hearing and he
had prepared a resolution to that effect, and that the motion approving the Mayor's
action in suspending these men should be rescinded.
Moved by H.G.Ralston, seconded by C.F.Filer that the motion made approving the
Mayor's action in suspending H.E.Lee and F.L.McDade from the Police Force is hereby re -
:winded. lotion carried.
Councilman Ralston thought that the meeting ought to be opened so that any persona
in the house could be heard on the police question. Dr. Merrill advised Council that
Dr. Faris was to speak, but after hearing the case would be heard Monday night, left the
building. The Dr. thought that both sides ought to be heard. Mr McLendon thought that
the Mayor and Councilmen ought to control the situation and the public should be disbarred
from taking any part in the proceedings. After a heated discussion, between Dr. Merrill
and Mr. McLendon, Mr. McLendon sustaining the actions of the Chief, urging that he be
given another trial and the Dr. advising an immediate discharge, the time for discussion
as allowed by the Chairman was up.

WHEREAS, it appears that one Tony Coliede has made oath that Frank mopeds, Gordon
McDade and Harry Lee , policemen of the City of Miami, Florida, have been frequently..
intoxicated in said city and while in suoh oondition used vile and abusive longuage
to said Tony Coliede, and without warrant or authority of law did assault said Tony CQAli+dh ,'
in said city, on or about Sunday, May 31st, 1914, and such conduct is highly repropeasOpicr

NOW, THEREFORE, BE IT RESOLVED, By the C- Council of the City of Miami that the
said Frank McDade, Gordon McDade and Harry Lehi',appear before said City Council on Monday,

Charges, and that the City vouncil meetat said time and place to hear and determine the

WHEREAS, W. J. Whitman, Chief of Police of the City of Miami, has been charged with
being drunk while on duty and while in such condition, attempting to enter the dwelling
house of Mrs. Ritchey, Ir. said city, against her will and without warrant or au-
• thority of law, arid,
WHEREAS, such conduct on the part of an officer of the city charged with the duty under
▪ the law of protecting the life and property of citizens and preserving peace and good
a order, is highly detrimental to the good order of society and one guilty thereof is unfit
to remain in office and should be removed therefrom; now,
THEREFORE, BE IT RESOLVED by the City Council of the City of Miami, Florida, that the
said W. J. Whitman be and he is hereby required to appear before said City Councilman
Monday, June 8, 1914, at 7:30 o'clock P. M., at the city hall in the City of Miafii, and
answer said charge, and that said City Council do meet on said day, hour and place to hear
and determine such charges so made against said officer.
BE IT FURTHER RESOLVED, that copy of this resolution be served on said officer by the
City Clerk of the City of Miami, Florida.

Mr. Riddle of the Railroad Company appeared before Council and presented an ordinance
which he had prepared and asked that it be read for information and passed if it met with
the approval of Council, saying that the ordinance was along the same line that was dis-
cussed before Council a few meetings ago, in reference to the Terminal facilities in the
north end of town. Councilman Ralston thought that the clause giving the Railroad Company
three years to move the yard was more time than was necessary and also thought that the
Railroad Company ought to open Fourth and Eighth Streets in addition to Eleventh Street.
Attorney Bowen for the Railroad Company said that the opening of Fourth and Eighth
Streets was a new proposition to them, as it was not brought up at the last meeting, and
this matter would have to be gone into by the Executive Committee of the Railroad Company.
After discussing the proposition for some time, the following motion was made:
Moved by E.C.Romfh, seconded C. F. Filer, that the Chairman appoint a Committee of
Three Councilmen to investigate the ordinance and rep:)rt to Council. Motion carried.
The Chair appointed J. A. Conrad, J. A. McDonald and C. F. Filer.
The Chairman advised Council that the ordinance granting the Fire Chief a raise
in his salary was up for its third and final reading:

Special Attorney Bowen advised Council that the next thing was the
acceptance of the work done by the Southern Asphalt & Construction Company and the
Creosoted Wood Block Company and he had prepared a resolution for each job except
Twelfth Street from the east side of Avenue D to the Railroad, and this was held up
until the repairs had been made by the Creosoted Wood Block Paving Company, as in-
structed by Council.
Councilman Romfh introduced the following resolution:

ACCEPTANCE OF WORK BY THE CITY COUNCIL.
WHEREAS, on the 16th day of Sept., 1913, the Southern Asphalt and
Construction Company did enter into a contract with the City of Miami, Florida, for the
laying and construction of a drain in, under and along 12th Street from Avenue C to
Avenue E; Avenue B, from 10th Street to 14th Street; 14th Street from Avenue B to
Bay Biscayne; and Avenue D from 6th Street to the Miami River, under and pursuant to
mem Improvement Resolution No. 98 heretofore adopted by this body; and,
mom WHEREAS, the said Southern Asphalt & Construction Co. has fully completed
the laying and construction of said drain in iccordance with the terms and conditions of
111 the said contract as shown by the certificate of the Consulting Engineer filed with
the City Clerk on the 18th day of April, 1914;

Florida, that the said report of the Consulting Engineer be, and the same is, hereby
approved and adopted; and that the laying and construction of said drain in, under and
along the streets designated in said contract is hereby approved and accepted as having
been duly completed under the terms and conditions of said contract, and the cost thereof
is hereby determined to be 016,242.94, as shown in said report of the Consulting Engineer.;

the acid report of the Consulting Engineer be and the same is hereby approved and aipted,
and that the grading, curbing, paving and improving made and constructed on said Street,
under said contract, is hereby approved and accepted as having been duly completed under
the terms and conditions of said contract, and the cost thereof is hereby determined to be
$6,779.68, as shown in said report of the Consulting Engineer.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami, Florida,
that the said report of the Consulting Engineer be and the same is hereby approved and
adopted, and that the grading, curbing, paving and improving made and oonstructed on said
Street, under said contract, is hereby approved and accepted as having been duly completed
under the terms and conditions of said contract, and the cost thereof is hereby determined
to be $7,025.97, as shown in said report of the Consulting Engineer.

terms and conditions of the said contract as shown by the certificate bf the
Consulting Engineer filed with the City Clerk on the 18th day of April, 1914.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Miami, Florida,
that the said report of the Consulting Engineer be, and the same is, hereby approved
and adopted, and that the grading, curbing, paving and improving made and con-

construction of said grading, curbing, paving and improving, in accordance with the
terms and conditions of the said contract as shown by the certifioate of the Con-
sulting Engineer filed with the City Clerk on the 18th day of April, 1914.
NOW, THEREFOR., BE IT RESOLVED by the City Council of the City of Miami, Florida,
that the said report of the Consulting Engineer be, and the same is, hereby approved
and adopted, and that the grading, curbing, paving and improving made and oonstructed
on said Street, under said contract, is hereb\' approved and accepted as having been
duly completed under the terms and conditions of said contract, and the cost thereof
is hereby determined to be ' 9,985.92, as shown in said report of the Consulting Engineer.;
