I beg herewith to return to Your Honorable Body, duly signed, ordinanoe No.!/. ,"same being ap ordinance granting to the Miami Traction company, their, suooessors, heirs, legal representatives and assigns, the right.to oonstruot, orate. and maintain a street railway on and over the streets, avenues and highways of,_�_ City of Miami, Florida, and regulating the oonetruotion, operation and rnaintenanee thereof . " I wish to state, however, that while I signed this ordinance, 1 am opposed to the granting of this tranohiae, but as the same must be approved by the,oitizen* ,at the Polls before it is effective, I believe it but right and proper that they-.,``" should be allowed to pass on it. In my opinion, there is no particular need for a street oar line in Miami at present, and this franchise being a very valuable one, the people should not be too hasty in disposing of it, especially when they are getting nothing for it. In my` judgment, in leas than five years from date, it could be sold so that it would pay the city fifty thousand dollars during the life of the franchise. This opinion is based upon a great many letters I have received from parties from different sections of the United States, several of whom, desire to.submit a proposition for this frarchise, after they send a representative to thoroughly investigate the situation. I beg to state further ,at I have written to the Mayor of severe) cities, asking what they received for their►street oar franchise when same was disposed of, and the answers to these letters show most of them received from five.te fifty-five per cent of the gross receipts Other objections I find to the franchise are, First, The kind of motor power to be used is not stated. The people should know exactly the kind of power that will be used, so they can intelligently vote upon it. Second, Half rates for school children should go in effect as soon as the line is in operation, and not five years from now. Third, Rates for hauling freight from point to point within the city limits, should be approved by the Council before being effective. Fourth, The grantees should ask for only the streets they intend to use, and be compelled to operate their lines over them, and not tie up for eight years twenty-five miles of our streets and obligate themselves to build only seven and one-half miles of track in that time. Fifth, The city should reserve the 'right to buy the line at the expiration of fifteen years by giving twelve months notice, value to be fixed by arbitration. Sixth, The fare across the bay to the beach should be fixed in the Charter, or the Council reserve the right to fix it. The beach will be the play ground for our people, and right now if the time to regulate the charge for getting them there. The fare should be five Dents each way. Seventh,The franchise should state on its face that the grantees shall set apart a certain section of the cars for the negro race, and not allow them to ride in any other portion of it 'ighth, Th franchise should provide that all motormen and conduotors shall be white citizens of the United States and voters under the laws of the State of Florida.; Ninth, The person, corporation or association getting the franchise should not be al- lowed to sell it without the consent of a majority of the Council and ipproval of the voters. • Tenth, In the matter of an interurban line entering the city, and orossing the tracks of the grantees, or using any of their track through t:se city, 1 thick that if the parties at interest cannot aye as to the proper charges for same, that the City Council should have the authority to fix the same, or td at least name one of the arbitrators. I am heartily. in favor of encouraging inter- urban lines, and believe that an interurban operating into epd out of Miami ,, would be worth more to this and adjacent territory, as a developer, than every other agency combined. It would place the grove and kruqk lands, aniin filets the entire outlying distriot, in close touch with the city. Along the line of the road, homes, churches and school houses would be built,. 'e and until there is some means of transportation, most of these lands will remain ae they; are now. To The Honorable City Council, Miami, Florida. gentlemen: - and had and rep - opinion, the polioemen May 14, 1914. Attaohed hereto you will find a communication from Mr. Chas. E. Greening, in reference to closing the streets along the right-of-way of the F.I.C. Railway in North Miami, as requested by Mr. Riddle recently. This communication will thoroughly explain itself. The communication referred to was a protest against the city closing all streets from Johnson Street to Buena Vista-Allapattah Road, at the request of the Railroad Company to close them in lieu of the Company establishing yards and terminals in that vicinity. Moved by E.C. Romfh, seconded by C.F.Filer, that communication be received and filed. Motion carried. The Finance Committeeman advised Council that he had paid five (5) of the Emergency Bonds, issued by the city on the 15th day of September, 1913, against the taxes for that year, and which were due May 1st, 1914. The bonds paid were Bonds No. Two (2).Three (3) and Four (4), issued against the General Fund in the denomina- tion of Five Thousand (•�`5,000.00) Dollars each, and Bond No. Two (2 for Five Thous- and (V"5,000.00) Dollars , and Bond No. Three (3) in the denomination of Three Thousand Six Hundred (13,600.00) Dollars. Moved by H.G.Ralston, seconded by J. A. McDonald, that the actions of the Finance Committeeman in paying these bonds be approved. Motion carried. There was a petition presented by the property holders on Second Street between Avenue D and J, and by the property holders on Thirteenth Street between Avenues B and D, and D and E, and on Fourteenth Street between Avenue G and the Boulev'ird, and on Avenue G between Seventh and Twelfth Streets, and on Avenue D South of the Miami River, and on Avenue between Tenth and First Streets. These petitions all asked that the described streets be paved with asphalt. Finance Committee -an Romfh advised Council that as the cost connected with the paving of one street in preparing resolutions, etc., was as much as sev- eral, he thought it would be a good idea to wait and find out all the streets they were going to pave and put them all through together, and made the following motion: Moved by E.C.Romfh, seconded by J A. McDonald, that petitions be received and filed. Motion carried. The attention of Council was called to the fact that there had been pre- sented several petitions, asking that Tenth Street be paved from Avenue G to the river, and that Ninth Street had been paved since the Tenth Street petitions were sent in. T+roved by E. C. Romfh, seconded by C. Hefty, that the Engineer be instructed to prepare profiles for paving Tenth Street. Motion carried. Special Attorney Bowen explained that as this was the night advertised to hear any complaints that might be filed against the manner or cost in which the work was done in the new paving, and instructed the Clerk to take up each street separately and read the total oost of the work, the amount assessed per front foot and the total cost per lot to each property holder. The Clerk first read the notice given that the improvement of Avenue D from the North side of the Miami River bridge to the track of the Florida East Coast Railway Company between Fifth and Sixth Street, covered by Improvement Resolution No. 116, adopted October 3rd, 1913. After reading the notice, the Clerk asked the .following question: Are there any objections to the manner in which the work was done on this street, or the coat of the work? There were no objections. The Clerk read the notice given that the improvement of Avenue C from the Florida East Coast Railway's Spur Track, serving the Royal Palm Hotel, to the South line of Twelfth Street, covered by Improvement Resolution No. 117, adopted October 3rd, 1913. The same question was asked by the Clerk, and there were no objections. The City Attorney advised Council that he had also advertised tonight as the time for hearing complaints and instructed the Clerk to read the notices which had been posted.
