In Section 14, Says all sera shall be run so es to maintain n reasonable schedule, but it does not state who is to decide whet a reasonable eshedule is. Sestion 17, Seh3o1 children rates go into effect in five years. There rates should go into effect when the line is opened for business. Section 21, "Gives the arbitretore the right to determine the right route to be pursued by the interurban ears in r,heir ingress and egress from the city, ds." It seems to me that the city should eertainly have some rights in this mat- ter end at least name one of the arbitrators. Section 24, Freight rates should be fixed that will be approved by the Couneil. Section 25, "Provides that the Grantees should pay all publication and election expenses when aubi itted to the people", this being a mutter of great importance to the people, End provided for in the City Charter. I see no reason why the city should not pay theme expenses, as in other 'My matters. Section 26, "one per eont of the gross receipts ere given to the. city when the oity has 40000 bons fide population within its oorporate limits." I believe the city should get not less than two per cent for the first five years and then five per cent during the life of the franchise. In Miceli where we have a breeze most of 'the time, especially on our narrow streets, it will be impossible to sit on your veranda when the cars go Along unless the tracks are oiled or well sprinkled daily end this should be provided for in the franc' ise. The city should reserve the right to buy the line et a given time, ♦sluation to be fixed by arbitrators properly chosen. The party getting the franchise should not be allowed to sell the same without the consent of the City Council end approval of the voters. The party getting the franchise should be compelled to erect convenient sheds with seats, ,et the re giest of the Council, for the convenience of their p as sang er s . My reasons for not Approving this ordinance are es follows: let. I hold too dearly the lives of the citizene of Miami, oe I'fully believe that a crossing over the railroad tracks et llth Street would be nothing more nor lees than a death trap, especially for children, end I do not care to approve an ordinance that I believe will result in great damage to our 'citizens. ,It was suggested to me, that the Railroad Co., knowing they would be liable for all damages, would be exceedingly careful et this crossing. Damages world indeed be cold comfort for the parents woose little child, on hie or her way to school,would be killed et this crossing. 2nd. I realize th-:t as the City grows more streets must be opened ecroee the railroad tracks, but I do not believe that et the present time there is any necessity for opening llth Street. By going 1H0 yards more, you.get to 12th Street, and you will find, should the street be opened, that 90 per cent of those crossing it, except school children, would turn down Avenue F to 12th Street immediately after crossing, so they could ee easily go to 12th St. before crossing as after crossing, I am sure it would be much better to open Bth Street, than to c.pen llth St. It would relieve any congestion and reduce the danger. 3rd. If llth Street ieopened, every trough passenger train that stops at the dap pot would oe compelled to unoouple its care and teke port of the train south of the street which would be dangerous to people using ire street. In my Judgment the street should remain closed or the passenger depot cmdemned and the Reilroad Comomy required to move it. 4th. It may be true that t a whole matter will be fought out in the Courts, but that does not Justify me, if I believe its wrong to out the Railroad Company And the city to that expense. I would much rather see the city and the Railroad Co. whrking together for the upbuilding of Miami, rather than fighting each other in the Courts, and further, I do not believe that any court, after a thorough inveetigation, will allow the city to open llt. street. Rasp ectfully submitted,. (Signed) J. A. Watson, Mayor. After uiscussing the action of the Mayor in vetoing the ordinance opening Eleventh Street across the F.E.C. Railroad, the following motion was mode: Moved by H. G. R elston that Ordinance No. 111, condemning the Eleventh Street Crossing by eminent domain, be passed over the Mayor's veto. Mr. Rolston did not get a second to his motion. About this time Mr. Riddle, Superintendent of the P.E.C.Reilwsy Company, appeared before Council and explained the plena that the Railroad had in view. Mr. Riddle said that the Railroad Company had outgrown its present terminal facilities in Miami, end in the last two years his company had purchased property et tuena Vista for terminal facilities. He explained to Council why Miami was en ideal spot for e terrainel, as it wee about the right distance from Fort Pierce to run their men, as the State now only allowed them to work men ten hours, and that he did not come before the Council in the manner of a threet, but if the city did not allow them oertein concessions, they would be obliged to make their yards somewhere else, Rid that later he would present an ordinance to Council in which the Railroad Company would ask that the city close ell streets crossing the railroad from Johnson Street to Allepeteh Road. fir. Riddle also presented a map of the proposed terminals, and explained very clearly to Council that it was absolutely necessary that these streets remain closed. Mr. Riddle further promised thet es soon as Council agreed to this proposition and that the terminal was completed, that they w ,uld open Eleventh Street to track it, and tnet he thought all could be accomplished in from twelve to eighteen months time, providing the R eilro ad Company would make the financial err engement. Mr. Riddle said thet he would be glad to answer any 4ueetions in reference to the subject. After a general discussion by Council and Mr. Riddle, tne question of p easing the ordinance opening Eleventh Street again came up. Mr. Conrad was still egoist the opening of Eleventh Street, end favored the opening of Eighth. Mr. McDonald was in favor of gr anting re quest of Rei1ro ad Comp any 'nd not to p ass the ordinance opening Eleventh Street, Councilmen Romfh end Hefty agreeing with Mr. McDonald. Councilman Rolston argued for the passage of the ordin En ce anyway, so that the city would be in a position to open Eleventh Street, should the R ailro ad Comp any f ail to carry out its promise, as Councilman R al stun could not get a second to his motion, the following motion wee read: Moved. by J. Mr. Riddle q;ain addressed Council and said that their Attorney would submit an ordinance to the City Attorney to te submitted to Council, and he thought that he could out the time down to fifteen months when the yard would be completed and Eleventh ,street opened. Councilmen Romfh, C;onred, McDonald and T{efty . all expressed themselves in favor of the attitude of the railroad and their proposition, and after u general discussion, the followii.: motion was made: Moved by E.C.Romfh, seconded by J. A. McDonald, that tne City Council tender Mr. Riddle its thence for his talk along the lines of new railroad yards for the Cite of Miami, and he be recpested to submit 'in ordinance to our City Attor- ney for his approval and the City Attorney submit the ordinance to Council for its reading end passage, should it be satisfactory to Council.
