The City attorney had been requested to examine the titles and render his opinion as to them in rerArd to the Lummus property,which in pert is as follows: At your request 1 have examined the abstract of title prepared ;,y the Uade County Title and Trust Company for the City of ';inmi,an,i which was certified on the 16th day of October,1913, covering the following described lend: (Giving; a des- cription of the land) I have al3o examined the deed in escrow in w ich 0. E.Lun,mus conveys the strip of 125 feet,together. with all riparian rights incident thereto, This being done the -ielivery of the Duman! deed,eovering the 325 feet ,together with the other Bleeds will vest,an unencumbered fee simple title in,and to the 325 feet above referred to,together with all the riparian rights in the City of Miami. Councilman McDonald had received a ;elegraru from the Mayor in Washington which was read by the clerk: J.A.McDonald, Miarii,Fla. War bepartment insist that all requirements be complied with. Therefore send af'fida- vits showing land has been bought,have council pass resolution stating that public dock will be built.basin and channel dug and R.R. connection made promptly also have plans for dock and basin made and taken to Slattery at Jacksonville for approval Insist that he approve them at once and send same to his superiors o fice here. Councilman McDonald explained to council why he had requested the Actin,z. Mayor t . call this meeting,and that as he and Acting Mayor Erfert both thought tnit it was very improtant that coufcil should send to the Mayor at once, a resolution showing that the city meant business in going ahead to build docks and improve the water front,they had purchased,and as the Mayor was in Washington,th: data could oe sent to him,and he could take the matter up with the proper officials. After discussing the matter of ahond issue,amount,etc. the following resolution was introduced: Resolution No. \ A resolution of the City Council of the City of Miami providing for the erection and maintenanceof wharves and docks of the city. Whereas the City of liiami,tnrou,;h its City i;olincil has purchased for phb- lic wharves and docks the following described property,in Dade Courity,Flurida,towit: Commence on the east side of Biscayne Drve where the north line of Block 20 North,City of Miemi,produoed due east intersects same;thence run east to the low water mark of Biscayne Bay, thence run southerly along low water mark of,Biscayne Hair 325 feet more or less to a point where a line running east and went through the center of Second Street intersects said low Ater mark of Biscayne Bay;thenee run west to the east line of Biscayne Drive,thence run north along the east line of Biscayne Drive 325 feet to the place of beginning;ineluding all riparian rights and water privileges and ell submerged land thereinto belonging. Whereas,it is deemed necessary to take immediate steps ';o improve the property by making such dhannele,basins and docks,etc, as may be required and approv ed by the War Department; Now therefore, Be it resolved,that the City attorney be,and he is hereby directed to prepare and eubn,it to this Council at its regular meetingiOctober 23,1913,an ordinance calling a city election to be held et Miami at the earliest pracitable date, at which. election there shall be submitted to the qualified electors of said city the question of whether or not bonds in a sum of not less then One Hundred Thousand Dollars ($100,000) shell be issued by the city,the proceeds from the sale of such bonds to be used for the purpose of providing,erecting and maintaining public wharves and docks for the City of Miami. He it fu.ther resolved that the Committeemen on perks end docks be re- quested to secure the services of an expert engineer and have him sumit to the Coun- cil plans of docks that will serve the city's purposes,together with an estimate of the cost of the improvements .contemplated. Be it further resolved that the committeeman on parks be directed to immediately take up with the proper officials or the Florida East Conet Railway Company the matter of ex ending their tracks from some point on the main line or from the spur tracks now located on the terminal dock,to be built on this property. be it further resolved that this council proceed es rapidly as possible to d do any add all things that may consistently be done to provide dockage facilities that will meet with the requirements and approval of the War Department, so t at the government approrpriationr, heretofore made fbr a harbor end other improvements at Miapii may be immediately available end place the city n R position to call upon Congress for further appropriations for deep water at Miami.
