Therefore T would recommend to your 1Tonorahle body that the ordinance be chenlr ed so as to allow,say 15 miles per hour within the city limits in the following terri tory,begin at cemetery going north, going west begin at Lnwren ce qr ive,going south begin At e.F.Cooks resieence,end the speed limit to remain ns it is elsewhere within the city lieeets. As they would he so near to the colored population,thet their property could not be rented to rlarkies,and the white people would not have it. After the clerk had read the lettere and petitions,Calst.1 rossier er.pleined the lines which the territory *could omobociy,anrl which would exclude virt.ia. lly all Of the Dale Miller treritory,from being settldd by the negroes. Councilman '!cDonn.ld said that he did not believe any ordinance could be eo drawn as to designate the place where certain people shoelri live,anl that tee council had never established any color line. H.G.Ralston spoke of sselging ceetein lines for eolored enri certain lines for white,and explained the reason they brought it tu council wee thnt the city attorney had already been in: tructed to draw an ordinance to this effect. J 293 dit City attorney Billingsley,believed that an ordinance segregating the races, could be drawn to be effective,and cited the case of such an ordinance in the city of Bai.ti.more,Which had been drawn and declared illegal but onl,; declared illegal on some technical error. Attorney Price,representing the Dale Miller intereat,igreed with Mr. McDonalrl and said that no such an ordinance ever had been parsed on by the Supreme Court,and argued that council had no right to pass such an ordinance,and as Mr. Billingsley said ,let the Supreme Court decide .To take such a step RR that would not be fair to Mr. Miller,as the colored people would be in doubts,and it would be impossible for him to sell them lots.Attorney Rand agreed with City attorney Billingsley in stating that su,h an ordinance could be drawn and made Effective.segergating the races,and cited as an illustration,the Jim Crow law,and said we had a law right here which would pro tect it. ,which was the whites would not allow the colored people to be buried in their cemetery. F.M.Davi and several others spoke as property holders,along the line and claim- ed that if that territory was opened up for negroes,their property in Mighland Park would be virtually confiscated. After dihsoussing the ordinance for some time between councilman and laymen, the following; motion was made: Moved by iE.C.Romfh and seconded by C.hefty that action be deferred to Feme future meeting. Mr. Shutts,rep esenting the city, in the new work eontempiated,addressed council stating that Mr. Bowen was in New York,end he after consulting with the New York attorneys,had recommended that all bi is for paving be rejected,on ace r..nt of one resolution being drawn,covering all of the proposed work,while R separate rerol- ut ion should be drawn euvering the improvements on each street. Moved by E.C.Romfh and :seconded by J.A.cDonald that all hide for paving, be re- turned to the bidders. Mot ion carried. Note.
