present: F.f.Erfert, J.A.Conrad,C.Heft; ,E.P.Ho1mes, F.C.Romfh, J.A.McDonald, R.O.Watson
A corm mication from the city clerk addressed to coenc?_1 was read in which
he asked that his present office be enlarged,as it was entirely t :o small for the use
for which it is intended.
'.Moved by E,C.Romfh and seconded by J.A.McDonald that communication be received
and the natter be referred to Committeeman.on Puildings„and Committeeman on Parks and
Docks. Motion carried.
Police Commissioner Watson called attention to the fact that he had ordered ell
his policemen to wear uniforms while on duty,and that the;; claimed that the uniforms
they had were too hot,and as it had been the custom of council in the past to furnish
the men with uniforms,he would like to know whether council still intended to furnish
ther_i,or have the men furnish their own uniforms.
Moved by J.A. Conrad and sec nded by C.Hefty that in the future all policemen
be required to purchase their own unifores,and to wear them while on duty.Motion
carried.
Committeeman Watson also stated to council that he war shy one horse for his
mounted police,and that one of hie policemen was willing to purchase and furnish his
own horse if council would feed and take care of hire, and increase his enlary. Commitee-

Chairman Hefty called to the attention of concil the inability of one of his
mules to work,and said that he had traded this mzlefor a horse,and pdt 75 to boot

Councilman Hefty also called attention to the condition of his depart ent,and
said that from all sources came re»orts that the city was in a better sanitary position
than it had ever been. Councilman Hefty also advised keeping the rate of lOcente per
barrel for removing garbage up for the present.
Councilman Romfh and McDonald were also in favor of keepinguppthe charge of
ten cents per barrel for removing garbage.
The chair announced that the Poard of Health Ordinance w.vaS up foe its third and
final reading.

An ordinance of the Cit', of Miami creating a Health Department of :Aid city
which shall be a part of the Sanitation Depar tmentof said city, providing for the
appointment of a Board Health,a Health officer,es sistants and employees; providing
for their salaries a'd prescribing their powers and duties;prescribing he powers end
duties of the Board of Health es such board,end making regulations for the conduct o
such 7ealth Department.

Be it ordained by the City Council of Miami:
Section 1. A department of the city government to be known and designated es
the Health Department and which shall be a part of the Sanitation Department of the
City of Miami is hereby ereated,to be composed as hereinafter set out. and invested with
the powers and duties herein enemerated.
Section 2. The Health Department of the City of "Miaei shall be composers of a
Board of Health, a Healf Officer and such assistants and employees ::s may from
time to time be authorized by council.
Section 3. The Ralery or wages of the Health Ofrieer, assistants and employees
elall be fixed by the city Council by resolution or by ordinance.
Section 4. The Board of Health shall be composed of three members,two of whom shi
shall be practicing physicians and the other. Iha'.l be the committeeman on sanitation of
the city council of the city of Miami, and they shall receive' no salary provided how-
ever that this shall not preclude the committeeman on eanitiwtion from receiving compen-
sation for his aervies as councilman.
Section 5. The members of the Board of Health, except the committeeman on san-
ita,,ion ,shall be appointed by the Mayor, and confirmed by the council, and the term of
said officera shall be for two years; or until their s:caceasors shall have been appointd
ed and duly qualified,provicded,tbat the appointment shall terminate with the term of the
Mayor so appointng.
Section 4', Any vacancy oeour ing among the physicians in the Board of Health
shall be filled by appointment by the Mayor and confirmed by the Council. Snob appiint
ment shall not extend beyond the term of the Mayor so apponting.
Section 7. Whenever a vacancy shall occur by reason of death, resigriation or
otherwise, the vacancy thereby created shall be filled for the unexpired term in the
same mangler as new members are appointed or selected.
Section 8. Members of the Board of Health, except the Committeeman on Sanitation
shall be subject to removal by the Mayor, approved by the Coune.il, whenever in his
opinion any members if negligent in his duties or has failed to perform the duties of
hie office. In removing a member the Mayor shrill state in wrltIng to the council hie
reneon for so doing.
Section 9. The Board of "ealth shell ,subject to the approeal or modification
by the cite council, adopt all needf .l rules and regulations for the proper and suc-
eeesfull operat on of the Health department of the cit,y,not in conflict with the rules
of the State Poardpof Health or the laws and Constitution of the State of Florida, in th
prevention end elimination of diaeases,the prevent on and abatementof nulsances,and for
the proper and prompt performance of such other duties as said department mey he reuired
to perform by State Law or the ordinance of the city,and recommend to the coejei1 ouch
health ordinances as from time to time it may deem advisable for the following purposes:
(a) To prevent adulteration of all kinds of food and cirin'f, end to prevent the
sale, or exposure for sale,of any kind of meat or vegetable that is unwholesome or unfit
for food.
(b) To regulat the bacteriological examination of such mutters aid things as the
public health may demand the inspection an examination of milk, the regulation of dair-
ies and milk dealers and the care and housing of milk cows.
(o) To prevent the spreaing of dangerous epidemics or contageous diseases,and
to declare that same has become an dpidemic and to maintain or enforce sufficient
quarantine whenever deemed necessary.
(d) To regulate and control the keeping or slaughtering of all k nds of
anima ls , fowl or fish.
(e) To regulate, control and prohibit the aecumuletion of offal end all decaying
vegetable sub/stance.
(f)To prohibit and remove any offensive matter,er abate any nuisance in any
public highway, road,avenue,alley,street or other plaee,public or private And to cause
the removal at the expense of the owner.
(g) To compel the return of all births and deeths by physicians,midwives,nurses
and other persons professionally officiating at such death or birth.
(h) To regulate and control the mode of connection of house drainage and plumb-
ing with outside sewers,cessOpools and other receptacles.
(i) To regulate and control the method of construction and location,the method
and manner f emptying and cle ning and the frequency of :leaning cess-pool, and privies
(j) To protect the public water supply,and prevent the pollution of any stream
of water or well,the water of which is used for domestic purposes,and to order not to
be used or cloaed any well,the water of which is polluted or detric:entel to the public
health.
(k) To reg late the burial an disinterment of hu an bodies.
$action 10. The Health Officer shall be appointed by the Mayor upon the
reeomr.,endation of the Health Department and confirmed by the council, and shell hold
office for two years,or until his successor shall have been appointed and qualified.
Provided, that the term of said a_.pointment shall not extend beyond the term of the
Mayor so appoint{•,g.
Section 11. The Health Officer shall havesupervislon of and be responsible for
all garbage and street cleanings, and the sanitary ispecr. or shall (tarry out the
instr:ict ions of the Health Officer.
Section 12. The Health Officer shall at all tines have care and superv" Sion
of the Health and public school buildinCsand shall from time to tilde make such. medi cal
examinations of pupils as himself or the Board of Health may deem pvoper,and recommend
to the City Board of Health ;Who shall report to the council from tie to time such
matters es may require attention from the standpoint of health and sanitation.

plumbing was in a very bad condit!on,and as 'Tr. Ashby is not here, he instructed the
Plumbing Inspector to hire a plumber and have it fixed.

An ordinance to provide for the laying of all sewers,wa?,er or gas mains,
telephone or electrical co•,duits,or other under,:round struetures,with their services
and connections in advance of any peranent improvement.
Whereaa,the City of 'Tiar.i is about to contract for permanently paving or
otherwise improving streets,alleys and public places,and to anticipate the name to the
end that when once laid a minimum of disturbance to the pavement shall he permitted,
tow therefore,
section 1. Be it ordained that when any street,alley or public place within
the limits of the city of Miar:ri has been ordered paved and otherwise per,i.amently imp
proved,it shall be the duty of all individuals,organizations and publi.c service cur-
porations,legally occupying such street,alley or public place, to proceed without
delay to order the necessary materials for the laying; o? sewers,water and gas
rains,telephone or electrical conduits,with connections and services to :;acre and to
proceed with reasonable expedition to excavate and install the sane.

Section 2.Ten (10) days notice of the city's tion to so permanently improv
any street,alley or public place stall be given the public by at least three (3) cdver
tisements in a local daily newsvper and within thirty (30) days thereafter all such
excavations and installation as here nbefore stipulated shall be fully completed to tb
the satisfaction of the Chairman of the Street Committee or other designated city

Section 3. If,at the end of the thirty (30) days hereinbefere pro;rided ,any
endividualorgenization or public service corporation shall neglect or refuse to
comply with the foregoing provision of this act, then and in that event,the chnirean
of the Street Committee, acting through the City' agents or eorces,mey purchase the
revired materials and employ the necessary labor by contract or otherwise .to excavate
and install such sewersigas or eater mains, telephone or electrical conduitm,or
service or connection to same and msy assess the cost thereof to the delinquent in-
dividuallorganization or corporation ant collect the same et the sene time and manner
as ie provided for the coeleet'on of aity taxes.
Section 4. Should the Chairman of the Street Committee decide it to be against
public policy to undertake said excavation and installation as hereinbefore provided
for, he may cause the aid delinquent indiyieeal,organizetion or eorpormtion to be
summoned to appear before the MuOieipal Judge to show cause why said work hart not beem
completed according .to the terms of this Act and upon conviction of neglect or wilfull
disobedience uf said notice,the Municipal .Jude shall a sess a penalty of not less
than Ten (e10) dollars ?or each and every days delay on and after tne limit set for eel
aOmPletion as hereinbefore provided.
Section 5. All ordinances,or parts of ordnancee n conflict with this Act are
hereby repealed.

Councilman McDonald notified council that he and the Comnitteemen on Buildings
had gone over the plans of the fire station,and accepted them,which would be subject 6
to changes to be made by the committee.

O'Brien for the fire station,be accepted subject to any changes made by the committee.

feet of sidewalk during the month of July,most of which has been installed.
Work is progresaing satiefaatorily on the several contracts as follows:
Sewer on 6th street between Ave.F and I
Sewer and pavinG on 15th street from Avenue D west.
Sewer on 9th street between Ave.F and North River Street.
Grading and paving 12th street between North River street and Ave. M.
The 40 days allowed for owners to construct sidewalks in Dist. 1 has passed and
several have nut been aommenced,I therefor suggestthat council advertise fur bids fur
th construction of the remaining walks.

Park Commissioner ?McDonald stated to council that in order to build
the roadway across the park on the ocean front,it was necessary that that part
be graded to the level of the read.

referred to the street committeeman and city engines to have the necessary
