Communication was read from A.IT.Rosss,calling attention to the fact that the 12th Street bridge tender was running a bicycle repair shop,and using the City property for same. against which {r. He also advised the purchase of an auto tr'rcr' for hauling; off rubbish and rec �s. sale the appointment of another sanitary inspector to look after the wagons. The Mayor spoke in reference to the amount due the city by the county for read tax,and said that the county comn.isaioners wanted en itemized bill and he would like for council to give his', the power to appoint a ren to get tfe date fro. the tax books. Moved by F.F.Fiolmes and seconded by C.aefty that e '7w;or Le authorized to employ a man to ascertain from the records t he amount due the city by the county. Hbtion carried. Councilman Romfh introduced the following resolution: Whereas, it is necessary in paying bills to make transfers from one fund to another,that $1750.00 be transferred from the Lighting the city fund,to the Gener- al Fund,and $1250.00 from the Lighting the City fund,to the Fine and Forfeiture Fund and $1000 from the Lighting the City fund to the Hospital F nd,arri with the consent of the Mayor,these transfers will be made. The Mayor was present,and said he was will inf; that it should be done. Moved by F.'F.Holmes and seconded by C.Hefty that the above resolution be adopted. Motion carried. Councilman Romfh introduced the following resolution: Be it resolved by the City Council of the City of HiatLi,Florlcda,that, Whereas, Carl G.Fisher,of Indianapolis, Indiana, and f.T.Whaler,of Miami, Florida, have made appliction to the war department of the United States Government for permission to construct a sea wall , a pier, and a combination pier and boathouse in Bisayne Bay, and fill the area between the said sea wall and the shore adjoining their respective properties on the south side of the Miami River, in the City of Miar_►i Florida,a plat of said properties showing Laid proposed sea wall,piers,boathouse and fill be ng hereto attached; and Whereas,a part of said sea wall,and part of said fill as shown by said plat are opposite the end of Twenty-fourth street of said City of Mimui,and Whereas,the war department of the United States Gover ment will not grant the said Fisher and said Whaler permission to makethe said improvements as to that part of the bey included within the limits of said Twenty fourth street extended east t to slid proposed sea wall, without the previous consent of the City 'Council of the City of Miami,so to do,and,now, Therefore be it resolved, by the City Council of the City of Miami,Florida,t that the consent and approval of said city of Miami shall be, and is now given to said Fisher and said Whaler to build and construct said proposed sea walla,and to make said proposed fill on that part of the submerged lands in said Biscayne Bay in- cldded within the limits of Twenty-fourth street in said city extending eastwardly to the proposed sea wall as shown by said plat: Provided,that the riparian rights and other rights appurtenant to said Twentv fourth street and the proposed extension theref,shell remain in the public at all times and the said Twenty forth street sha1l at all times remain open to the general public through and over said proposed fill to the waters edd;e,and Further, That the said Fisher and Whaler shall file a plat of said fill showinf such extension of Twenty fourth street and dedicate the same to the use of the general pub. lic as a street or thoroughfare, together with riparian rights appurtenant to :.aid fill. The city attorney beported his investigation of the opening up of Avenue B. and said it 1as a complicated matter and could only he opened up by legal proceed- inhs,but would suggest that they first take it up with the Railroad Co. and see if the matter could not be settled amicably. Vernon Price-Wllliar.ia said that he had talked with the Railroad people,and thought that they would do anything in their power to ad just the matter.
