A communicationwas read from B.F.Lassiter and Co. asking permission of council the privilege of moving his bar '1xteres to the room immediately north of the room het is now being occupied by the bar,for the purpose of repairing the present room where fixtures are situated.. Moved by J. A.Conrad and seconded by J.F.Lummus that B.R.Lassiter and Co. be allowed the privilege of re, oving their bar to the room north of the present roomthat is being used for that purpose, for the purpose of having reairs made to same. We found the sane completed in due con''ormity with the profile And specifi- Cations of said work and therefor recommend the acceptance and payment for same. The Miami Shoe Company asked permissien to erect a corrugted iron building to the rear of their shoe factory. Councilman Lummus in answer to the request stated that council could not grant permission to break its own ordinance ,and that locality was in the fire district,euch buildings were barred. The Miami Shoe Co. also asked council to relieve them of their City license as it +vas a new industry end had a hard road to make goon. Moved by R.O.Watson and seconded by J.A.Conrad that'licenee when paid by the Miami Shoe Co. be refunded. Motion carried. Councilman Conrad called attention t the fact that the Miami Printing; Co. were allowed to put up a ge.vanized building temporary for storing their meohanery,and that the time allowed, eivty days, was about out. The chair announced that tpe ordinance annulling condemnation proceedings was up for its third and final reading. Moved by d.E.Lummus and seconded by R.O.Watson that ordinance be given it; third and final reading, Motion carried. The ordinance was read in full by the clerk, after which councilman Lunwus arose and asked the chriman to divert from the usual proceedings,and allow a full discussion by all present, before taking the final vote. The chair was also in favor of Mr.LUaunus proposition, stating that council had been accused of rail- roading a certain erdinanace, the milk ordinance, throug, , and he did not want it said again, and that the ordinance was open for discussion by all present. C.D. Leffler spoke against thepassage of the ordinance.judge Worley ale urged council not to pass the ordinance until they had had time to hear from the petition which had reeently been submitted t- the Railroad Co. Dr. Chapman also op eke against the passage of the ordinance. and asked the question, which was stranger the railroad Co. or the people. Councilman Watson was in favor of holding th election off till we had time to hear from the petition. Councilman Lummis explained his position and in response toJudge WorleySa qusstion,what assurance has the Railroad Co. given that they would make any concession should the ordinance be passed.Councilman Lummue stated that although there was no positive assurance from the Railroad Co. that from what he had heard,he believed that when all restraint was withdrawn that the Railroad Co. would make a proposition beneficial to both parties. Banker lioffetettler spoke strongly in favor of arbitretien,and to pass the ordinance ,clear all frictien,that arbitration maybe effected. Moved by J . F. BE IT ORDAINED BY T1E CITY COUNCIL OF THE CI'.^Y OF WATT: Section 1. That the City Council of the City of Miami,Florida, shall_ submit to a vote of its constituent electors at a special election, the time and method of the holding of which are hereinafter set forth, for their adotpion or rejection, a cer tain ordinance or measure, which said ordinance is in the follow ng words and figures, to -wit: "An ordinance of the Electorate of the City of Miami repealing an ordinance entitled " an Ordinance of the City of Miami directing the purchase or condemnation of certain lands on Biscayne Bay to be used for public parks and for the construction upon said land and operation of public wharves and docks". That certain ordinance entitled " an ordinance of the City of Miami directing the purchase of oondenation of certain lands on Biscayne Bay to be used for public parks and for the construction upon said land and operation of public wharves and docks' the petition for the passage of which was presented to Council January 19,1911, and appears of record in Minute Book 4,page 260, and adopted by the electorate of the City of Miami,April 4,1911, ate special election held on said date, un der and by virtue of an erdinance passed the 16th day of February, 1911, and approved by the Mayor the 20th day Of February 1911, and re- enacted by Council the 20th day of April, A.D.L911, and approved by the Mayor on the 6th day of May, A.D.1911, as appears o n page 310 of Minute Book of City Council No.4 and the saeme is hereby repealed. Section 2. That this ordinance,if adop ad, shall go into eft'eet as provided r by the city charter of the City of Miami, towit; ten days after the official count oft of the election herein provided for, shall be determined. Section 3. That all ordinances or parts of ordinances in conflict with the provisiots hereof be add the same are hereby repealed. Section 11. That said sp cial election shall be called and held in the City of Miami on the 4th Tuesday in Noven1ber,A.D.1912, the same being the 26th day of the ::aid month, for said purpose of submitting to the electors of said City the question of the adoption or rejection of the said ordinance or measure herein - before tet forth. No person Bha11 be allowed to participate in said election who does not possess the qualifications requisite to an elector at General State Elections and who shall not have resided in the City of Miami six monthsnect preceding tie said election and who shall not have been registered in the registra ion books of said city as required by ordinance ,and who shall not have paid his poll taxes for two years next preceding said election, provided, the :ame were legally assessable against hiss. Said election shall be conducted and held in accordance with the prvisions of the election law of the S ate of Florida as nearly as practicable, except that the 171110(3 City Council shell be substitued for the Poerd of County Commissioners. The polls shall be opened at S o'clock A.`d. and close at sundown. The polling- Ogee shall be .t the City all. The ballot to be used in said election shall be prepared by the City C i'ineil and shell have prited on one side: " For he Ordinance " and "Against the Ordinance." Section 1V. The Mayor of the City of Miami shell issue his proclamation giving notice of such election, the time and lace when and where the same shall be held, the qualifications of the electors, thenames of the Inspecbors and Clerks who areto conduct the same, and the time for the opening and closing of the po ls, which said proclamation shall be advertised in the newpaper published in the city o? Miami for the priod of thirty days next preceding the said election. Section V. That immediately after the closing of the polls, the inspectors and clerk of said election shell proceed to count the votes east et said Election, "For the Ordinance " and "Against the Ordinance", and shall prepare duplicate lists showing the vote east for each, and shall certify th- cerreetness of the same, and one of said certified lists, under seal, shall be handed by an Inspeotor to the City Clerk of the City of Miami, and the other certified list, also under seal, shall be handed by an inspector to the president of the City Council of said City. Section VI. That on the first Monday after said election, or as soon thereafter as practicable, the City Council shall convene a d proceed to ca nvass the vote cast at such election, and if it shall appear that a majority of the votes cast at said election are " For the Ordinance " then in such event said ordinance shall no into effect ten days after the official count shall he determined, otherwise such ordinance shall be rejected. Section VII. That all ord nanees or parts of ordinances in conflict with the provisions hereof be add the same are hereby repealed. Section VIII. The clerk bruught to the attention of couneil,that the property -olders had deposited between $'300 and S400 for the construction of the road way from Sth.St. and Forth River Drive to Prouta Avenue,and that they were very anxious to have the work done as soon as possible. Moved by d. ;.Lummus and seconded by C.hefty that when $1000 has been depos ited with the clerk by the parties requeabtng the city to build the said road,that the city wi 11 proceed with the work. Motion carried. Moved by C.Hefty and seconded by J.E.Lur,x,us that the street department be instructed to proceed with the work of paving 13th. Street from Avenue d to the river Motion carried. LL. Moved by E.F.Holmes and seconded by .;.A.Conrad that th city attorray be it structed to dradt an ordinance ereating a Board of Health,following the lines sub- mitted by the physicians and read to council.Motior, carried, Along the lines that was brought to the attention of council by the Mieti Transfer Co. W.J.Brown and a few others, asking for a reduction in ceetain license, the following redlution was introduced by J.E.Lummus: • Ates©lution. A resolution providing for and amending an ordinance of the city Pertninig to the license taxes to be colleeted for the fiscal year beginning October lst,1912. Be it res olved thzt the present license ordinance be amended providing for the following changes in the present license ordinance, viz: Automobiles for. hire reduced from $25.00 to 15.00 35.00 to 25.00 100.00 to 70.00 Providing that livdry stables shall not be required to pay an additional license on drays, omnibuses or other animal drawn vehiclee,and providing that auto trucks not earring passengers, ehall pay a license of $5.00 per ton capacity. and Be it Resolved that the city attorney be directed to prepare and submit to the council an amendment to the present ordinance embracing the proviions of this resolution, and Be it further resolved that the city clerk be autho ized and directed to issue licenses to persona calling for came in accordance with the pr ,viions of this resolution pending the passage of the ordinance in conformity with the said resolution. Motion carried. `� The matter of issuing $20,000 evergeney bonds was thoroughly alone over 1 by council,and after discussing it,the following resolution was introduced by J.F.Lummn Committeeman on Finance: A resolution by J.E.Lummus, Committeeman on Finance: A reso.ution of the City of MiE.n:i,authesizing the issue o? y20,000.00 of revenue bonds, to be carried and credited to the respective funds, hereinafter men- tioned, as show by the aesesarient roll of said city for the year A.D.1912. Be it resolved by the City Council of the City of Miami: Section 1. That the City of Miami, he and in hereby autho ized and em- powered to issue revenue bonds to the amount of $20,000 the same being lss than one half of the taxes 'or the year A.D.1912. As shown by the assessment roll of ;aid city for the said year. Seation 2. That the said City shall issue as evidence o" indebtedness of money borromed revenue bonds +against the General Fund of said City, in a series numbered from 1 to 8 tnclusive, of the denominetien of $1,000.00 each, the proceeds of said :gale th reof to be Carried and credited to the General Fund of said city. nAnd against the Repairs and Internal Improvement Fund of said city, in a sf series numbeed from 1 to 8 insluve of the denominations of 1,000 each the proceeds of the sale thereof to be carried and credited to the repai•s and Internal Improvement Fund of said city. Whereas, on the 30th day of Sept. 191?., ir. Dade County, Florida, Major S.kodmon Smith, departed this life, and Whereas, '.4ajor Smith was from the 1st r1 y f Nov. 1911 until recently Mayor or the !`ity of Miar,i, and resigned from such office on account of ill health. and Whereas, Major Smith was a worthy citizen, upright gentleman, energetic and efficient; Now therefore be it, Resolved, that this body, while deferring to the Greater Power which removed Major Smith from our midst, deplores and regrets the death of a gentleman so worthy and useful; and it is the sense of this body that in the death of former Major Smith the City and all the people have lost a valuable friend, a conacientous end eff- icient worker for the public good, whose official conduct was of the highest and best order. Resolved further, that © of this resolution he mailed to the widow of Major Smith, and the sympathy of this body expressed to her.
