Regular meeting called to order by the chairman F.G•.Erfert,

C.Hefty.
George Coats addressed council in reference to the impoverished condition
o f 'rs. Hewett, stating that Mrs Hewett had relatives in Atlanta and if she eo Auld
get tranepertat ien to that city, and get with her family, she would be token sere
o f.
Chairman Drrfert instructed Mr. Coates that he would take the matter up
with the F.E.C.Reilread Co. and he thought he could get transportation for them.
A communication was read from C.H.Perry offering to sell the city an
automobile for the fire ahief en very easy ternR,etating that the retail prise of
the sore was $1150.0U,ano that at the end of the year if your Honorable body con-
sidered that an autumible was netneeded for the use of the Fire chief, I will sell
the ear without charging a commission, and I am sure with the use that the car would
be subjected to, that I could get as mush for it as it will new cost you. After
dieeuseing the preposition for some time, the following pieepeortlen was made:

Before bidding en Gth street sewer, Mr. J.C.Tucker told me th t he had

and I respectfully ask the eeuncil to allow me the sum of C cents per tie to offset 4
th expense incurred and a further amount of A5 sets for eonnesting sateh basin sewer
with man hole at Avenue D. and filling in ditch. There were 372 ties at tI etc per
ti • amounting to $29.76 and a further amo .nt of 15 ate. total $30.61

Mr. Pierce and sevral others addresses! council in reference to to legating
the incinerator at the corner of First and J,etrongly pretesting against dame. Couned
man McDonald explained to them that in his judgment that is the most desirable situa•
tien as there were ne huses near and that .hlrther mere you could guarantee that there
would net be any oder arising from it. After various suggestions etc. the following
motion was made:

to llth Stree and moving it 100 feet east ,was up for its third and final rending.

AN ORDINANCE VACATING CE^TAIN STREETS AND NIS WAYS
IN THE CITY OF MIAMI FLORIDA AND PROVIDING FOR THE
DEDICATION BY THE FLORIDA EAST COAST RATLWAY COMPANY
OF A CERTAIN STRIP OF LAND TO BE USED FOR NIGHWAY PUR
POSES IN LIEU OF STREETS VACATED ALL FOR rim PURPOSE
OF SNARLING SAID RAILWAY C MPANY TO ERECT A RAILWAY
DEPOT IN LIEU 0' ITS PRESENT DEPOT AND SANCTIONING
AND APPROVING THE gFMOVAL AND CHANGE OF ITS PT'ESENT DEPOT
FACiI"i13 TO THE LOCATION HEREIN PROVIDED FOR.
Whereas the Florida Fast Cost Railway 'Company, a corporation organised
and doing bus ness under the laws of the State of Florida, is deeirous of erect-
ing and maintaining a railway depot and of transacting other railway business
upon that tract of land now embraced within the limits of the hereinafter described
portions of Avenue E ,eighth, ninth and tenth streets in the cit of Miami, Florida
and,
Whereas, the railway depot and other railway facilities so to be erect
ed and maintained upon said describedtract of land, are to be in lieu of those
buildings or structures used for similar purposes owned by eaidrailway company
and now located in blocks fifty nine (59) north and sixty (60) north, in said
city of Miami, and
Whereas, said Florida East Coast Railway Company has indicated its willing
ness to dedicate to the perpetual use of the public forhighway purposes, a cer-
tain strip and tract of land fifty feet (50 ft.) ih width and one hundred one and
five tenths feet (101.5) ft. more or less east of and distant fron said Avenue
"E" and extending from Seventh to Eleventh Streets in said City, and
Whereas, this body is of the opinion and belief that such plan will be to
the beat interests of the citizens of Miami and visinity, as the ,ne that will best
enable said railway company t establish and ILainta n needed railway and depot feel+
ities in said city.
Now therefore, to more fully enable said City of Miami and said railway
company to carry out and perfect the plan above set forth,
Be it ordained by the city council of the City of Hiand,Florida, that,
Section 1. The following described portions 'of streets and highways
lying and being within the corporate limits of said city, according to the plat of
said city recorded in Plat Book "B" at page 41 of the Records of Dade County,
Florida, be and the same are hereby vacated, discontinued and abolished.
(a) That portion of Avenue "E" lying and being between the south bounday
line of Seventh Street and the north boundary line or Eleventh Street.
(b) Thatportion of Eighth street lying east of the east boundary line of
Avenue "E" and extending eastwardly a diAanceof one hundred and one and five tents
(101.5) feet,more or less, to the west boundary line of the fifty (50) foot strip e
no to be dedicated by said railway company, as aforesaid.
(c) That portion of Ninth street lying east of th east boundary line
of Avenue "E" and extending ;>astpa .oily a distance of one hundred and one and five
tenths (101.5) feet, more or less, to the west boundary line of the fifty (50)
foot strip so to be dedicated by said railway company, as aforesaid.
(d) Tht portion of Tenth street lying east of the east boundary line of
Avenue E and extending east wardly a diatanceof onehundred and one and five tenths
(101.5) feet,more or less, to the west boundary line of the fifty foot (50 ft.) strip
so to be dedicated by said railway company, as aforesaid.
Section 11. Said Florida East Coast Railway Company, in consideration of them
vacation, discontinuance and abandonment as a highway, of the above described portion
of the streets and highways, aforesaid, shall open, extend and dedicate to the perp$
tual useof the public, for highway purposes, that certain strip; or tract of land, de
described as follows;
Beginning at the northwest corner of lot nine (9) in block seventy seven (77)
north, of the city of Miami, Florida, acco ding to the plat thereof recorded in Plat
Book "B" at page 41 of the Records of Dade County, F orida, running thence in a south
erly direction along the west boundary lines of lots nine (9) and sixteen (16) in
each of blocks eeventy seven (77) north, eighty six (86) no tip ninety seen (97)
north and one hundred six (106) north, to the north boundary line of Eleventh Street;
tnence in a westerly di eetion along the north boundary line of Eleventh Street a die
tance of fifty feet (50) feet. thence in a norther y direct on and parallel with the
east boundary line of this described tract of land to the south boundary line of Sn
Seventh ctreet;thence in an easterly direction along the south boundary line or Seveib
th street a distance of fity feet (50ft) to the place of beginning, excepting there-
from those certain tracts of land included in said description now occupied by
Eighth, Ninth and Tenth Streets.

the reversion and reversions of said tract so dedicated, to iteelf, its successors
and assigns, whenever the same shall be discontinued by law. Said tracts, so to be
dedicated as aforesaid, shall be graded, in accordance with the specifications for
etreer, improvements heretofore adopted by this body, and now in force and effect,and
subject also to the supervision and approval of the CitEngineer, and improved by
as d railway c mpany, without expense to the city of Miami, or the citisene theref,in
a manner suitable for highway purposes, with material similar and equal in quality ad
grade tb that used for s imilt.r purposes upon streets adjacent thereto and intersect*
ing therewith.
Section 111. The railway depot and other railway facilities so to be erect
ed by said railway company upon the a ove described portions of streets hereby vacatd
discontinued and abandoned, shall be in lieu of the present railway depot and station
facilities now owned, used and occupied by said company in blocks fifty nine (59)
north and sixty (60) north, in the city of Mialq, end such change in locet on of :aid
railway depot and other railway facilities so to be made by said railway copeny is
hereby expressly authorised and sanctioned.
Section 1V. Phis ordinance shall takeeffect immediately upon itepaseage and
one publication in a daily newspaper published in the city of Miami in the State of
Florida, and approval thereof by he !Mayor of said city, and its subsequent acceptance
by said Florida East Coaat Railway,Company provided, that said Railway company is
hereby given and granted until and to the 21st day of Apri1,1913, in which to grade
and improve amid fifty foot (50 ft.) strip, as abovedescrihed.
Section V. All ordinances, or parts of ordinances, '.n confli t herewith, are
Hereby repealed.

A certain street railway ordnance asking for a street railway franchise
was presented by Hr. Boggs,and was read by hies forinformation of council. Moved by J.A.
Conrad and seconded by 11.J.McDonald that ordinance be referred to city attorney for
his opinion. Motion carried.
