Regular meeting called to order by the Chairman. Members present: P.G.Erfert,
E.F.Holmes, M.J.Mcnoneld, J.A.Conrad, R.O.Watson, C.Hefty.
The following petitions to e,uncil were read:

We the undersigned, citizens and tax payers respeetfuly petition your eonorO
eble body to rock and crush the same commencing at Avenue going west lPlth. St. to
Avenue I. thence along this avenue to lf►th. St.,thence west along l6th St. to Avenue
I,which has been rocked, and your petitioners will ever pray.

Mr. II.H.Harrison was present and explained to council what the petitioners
desire. The chairman instructed the city Engineer to make a plat of the lines as rep
resented by the petitioners, and have all data in ref, ence to costs ready and report
at the next meeting.
Mr. A.H.Adams addressed council in ref rence to an error in assessing lotsl and
2 in block 17 north, having *400 dollaraimprovementsassessed to these lots, when there
are no improvements on them,ahowing to council that it was merely a clerical error.
Moved by F.F.Holmes and seconded by C. efty that a warrant be drawn in favor
of A. .Adams for $14.00 refund on lots 1 end 2 in b ock 17 north,account of error in
a ssessing the 1911 taxes are paid. Motion carried.

Miami City Council,
gentlemen:
In order to supply gas for to south aide, we hereby request
permission to use the approaches of the Avenue D bridge, to rest our pipe upon.We
propose to run a two inch line along the side of theiron girder of the bridge,from
the base of the street to the opening of the draw , thence to and onthe bottomof the
river to the other side of the drawer,thenceup to and on the girder of the bridge and
on to the street. All work to be done under the supervision of the city en,ineer.

A communication was read from the Chief of the Fire Department, addressed to the
committeeman on fire protection, requesting council to give him definiteinstructions
as to whether in case of fire,he should go beyond the north city limits and protect
the outside property or not. That he did not want to take the responsibility upon
himself, such an emergency arise.
Moved by J.A.Conrad and seconded by M.J.McDonald,th •t the communication of the fill
chief be referred to the Mayor.by the committeeman on fire protection,and they in-
struct the fire chief as to what course he must pursue. Motion carried.

Councilman Holmes addressed council stating that he was uno"ficially
informed that the Gulf Refining Company was going to move their pla'ht from its
present location on the out bank of the Miami River. After discu.sing the
subject,the chair appointed the following committee E.P.Holmes, M.J.
MoDonald,c6airman,to investigate and report at next rmeoting,the facts in the
cave.
Judge Phillips addressed council in reference to duties of municipal jud e
and wanted to know if council was satisfied with his work as municipal judge,
stating that one of the city officialshad seen fit to criticise im at a Board of
Trade smoker, dubbing him as the shim, judge. The judge wanted to know posi-
tively if council was satisfied with his stewardship an wanted each councilman
to express himself. Mr. Conrad, Hefty, Watson, McDnald, and Holmes all agreed
that they were satisfied. Cou ncilman Holmes stating that he was satisfied
with the judge but that he did notthink the policenme_i did his duty in arresting
him for violating the traffil ordinance.
The city attorney offered the following ordinance forits first reading.

An ordinance requ it ing the inspection of every stationery steam boiler
and gas engine plant wit in the limits of the city of Miami,providing a monthly
fee to be a o:►ser1 against the owner threof, providing for an examiner for
examinations of and licensing of engineer of said boilers and plant:.; prescrib-
ing a license fee,qualificationsneeessary for an examiner,and classes of license
providing; for compensation of theexaminer,exempting gas engines of 20 horse
power orunder, end providing a penalty for violating.

first reading and read in full . Motion parried. The ordinance was reed in
full.

secandreading and read by title only. Motion carried. Ordinance was read by

Counc lman McDonald introduced the rollowingordinance:
An ordinance amending 358 of the co'e of the city of Miami, relating to
fowls.

eity of Miami -elating to the service of notice of unsanitary condition owns up forits
t'ird and final reading.

An ordinance amending section 168 or the code of Mismi relting to the serve
vice of notice of unsanitary eandition.
Be it ordained by the city council or the city of Miami.
Section 1. That section 168 of the code of Miami be and the same is hereby
amended so as to read as follows:
Section 168. It shall be the duty of the Chief of Sanitation to see that al
kitchen slops, garbage, swill add night soil in the city of Miami is removed as
often as necessary, with the due consideration f good sanitation, nd unle s the premie
es upon which such kitchen slops, garbage, swill or night soil is routed, shall be clean
ed by the owner , agent, or occupant of .such premises within twenty four hour:' after
notice made by the Chief of Sanitation w ich :aid no ice rhall be 9s follows,towit:
State of Florida, Co:ihty of Dade, lity or Miami, Department of Sanitation
of the City of Miami, O''fice of Chief of Sanitation.
To
You are hereby notii'ied that your premises situated on in the
city of Miami,. are in an unsanitary condition, and unless the same are el aped of such
unsanitary matter fromand after twenty four hours from the receipt of t is notice,
you wit l be Dnnnaht before the Municipal Judge of the City of Miami to answer therefor
in accordance with Law.

A copy of which raid notice the Chief of Police shall serve or cause to be
served upon such owner, agent or occupant, and return m de on the back of the original,
which said original shall be filed in the office of the Clark of the City and preserved
as a part of the records, and if after service of such notice and the expiration of nal
twenty four hours said premises are not cleaned, then it she 1 be the duty of said Chid
Chief of Sanitetio to cause such owner, agent or occupant to be arrested and brought
before the Municipal Judge to be tried according to the ordinances of the said
City, to the end that the owner, agent or ocupantof premises shall keep the same cleand
at their own expense of all garbage, decayed meats and fruits vegetables, potatoes,
rubbish and slop swill, night —soil and all unhealthy and unsanitary matter of any
nature whteoever.
Any person or persons, eith r as owner,
with the noticehere in prescribed upon service
the twenty four hurs after its service, shall
upon conviction th reof, sha'.l be punished by
imprisonment not exceeding thirty days, or by
agent or occupant failing to comply
thereof by the Chief of Sanitation within
be deemed gui'ty of atisdeameanor and
fine not exceeding fifty dollars or by
both."
Section 2. All ordinances or parts of ordinances
are hereby repealed.
