Recess meeting called to order by the chairman r.G.Erfert, members present:
P.G.Erfert, M.J.MeDonald, J.A.Conrad, C.hefty, P.O.Wason, J.E.Lummus, E.F.Holmes.
A communication was read from the city attorney addressed to o ief ofpolise in
reference to the closing of bar rooms o n special election days,in which he quoted this
section :
"Section 240. Bar rooms to be closed.
All bar rooms, sa ' oone and other pieces for the sale of liquors by
retail should be closed at six o'clock of the evening preceding the day of any election
and shall remain closed until six o'clock in the morning of the day thereafter. And
during the time aforesaid, the sale of all intoxicating liquors is prohibited."
Chapter 5823 of the Laws or 1907, which is the Miami Charter, provides that the
City Council shall have power to regulate bar rooms and saloons in any manner not in-
consistent with the state laws, but I find our City Cyde silent on t is particular sub-
ject; therefore, the statute above quoted controls, and in my opinion, it is your duty
to see that the saloons in the city of Miami are closed in accordance therewith.
Mr. W.N.Hu11 was also present and requested that the bar rooms be permitted to
remain open,but after hearing then:eaning of the opin on of the city attorney in regard h
such, he withdrew his request,stating at the time that he tho ght the Chief of Police
wise right in closing them.
Minutes of recess meeting of February 8th were read. Regular meeting minutes of
February l5th. were read. The chair ordered as there wereno errorsor omn:issions that th
minutes would stand as read.
W.W.Di11 addressed council in reference to keeping roosters in the city, etatig
that the early crowing was very unsatisfactory to tourists and stated that he thought
an ordinance should be passed prohibiting fowls to be kept in the city and ale
another ordinance be passed prohibiting th streets being town up from November 1st to
Aril 1st. and that no assistance should be allowed the city attorney inthe condenmaton
suits. Councilman Conrad explained to Mr. Dill why the streets bad to oe torn up
durinE the tourist season.
The chair in: trusted council that sanitay inspector, Dorothy,reco.*.fended that
sewer connections should be ordered ae soon as sewers were placed on streets. The *bllot
ing lots were recommended by sanitary inspector Dorothy to hav e sewer connections made
at 'once. Lots 19 and 20 of Block 17 N. corner of Avonue D and 2nd et. Lots 5,60,ts,9,
10 of block 77 N. and lots 16,17,1r,19,2u,of Block 64 north, 7th st. and lots 1,2,3,4,4
4,7,8,9,10 of block 86 north,an Iota 15,16,17,1P,19,20,21,2?,23,24 of block 77 no.rtn,
on 8th. street,.
Moved by M.J.McDonald and seconded by J. R.Lummus that special report of sanitp
ary inspector be received, 'and connections ordered made. Motion carried.
Moved by F.F.Holmes and seconded by C.Hefty that the form ofbal lotbe iced
in voting on the measure in this special election sailed for March L't!',,1912

A special election relating to the extension of the territorial
limits or boundaries of the City of Miaml,Floricia,in accordance wit', an ordinance of
the City of Miami approved January 31,A.T).1912, and a call heretofore issued naming
the date and describing th•., territory proposed to be incorporated into the city of
Miami,l71orida, and in accordance with Section 1075 of the General Statutes of Flo ida.

Against Annexation. Motion carried.
Moved by J.A.Conrad and seconded by M. J.McDonald thN t the ballots and
other necessary effectsfor holding the special election on Merch1 22th be placed in the
ballot box,the boxes sealed and the keys delivered to the Preeident of co;incil,and the
boxes be placed in the custody of the chief of police,and he to have tl em at the place
of voting on the morningof March 12th.Motion carried.
Moved by J.A.Conrad and seconded by M.J.'!cDonald that council adjourn.Motion
carried.
