A communication wet a react from the Mayor advising the inability of the police to enforce the muffler ordinance. Two violators hav"_ng been Arrested and tried in the nunie ipai court, and were discharged. The court holding substantially that as long as the boats were equipped with a device, it would prevent sore noise,they were wit in their rights. Stating that he hai had vari us complaints fr m residents along the river,Rnd yachts frequenting these waters,Rnd that these yachts used supplies dur* during the winter am ountig to about S200,000, and under the present law,therc is a probability of losing this trade,therefore I respectfully recommend that the present ordinance be repea,ed and an amendment or new ordinance be framed ,requiring; all motor beat owners to have their boats with mu*flers,and that such mufflers be e tioely eubmerg;ed in the water at All times,and also that the owners of statinery engines and land rotor Vehicles should be required to provide such improved mufflers for the sup- pressiun of noise that are usual in a good high priced car. They eked that council abolish or amend section 239 of the city ordinance in regard to licenses,An(i that thus be relieved of paying a contractor's license. The chair announced that the election of a councilman to succeed C.W.7111 vesi.g;ned, wr::i n'w; ir. >rder. M.J.`.'cDonald nominated 71.0. Waton. 'Fv(i.Erfert called souncilman Lumwus. to the choir, took the floor and nominated S.'d.Tatum. Moved by J.A.0 nrad and seconded by C.Hefty that nominations be closed. &sting Chairman Turr.rnis declared the nominations slosed,and proceeded to ballot. R.O.Watsen received five votes, S.'R.Tetum one. The Chairmen declared R.O.liatson elected. R.O.Watson was sworn An by Munieipal Judge Phillips,a:id took his sent. As in installing the wires now, he would hove to hire extra help anyway and it would be cheaper to hire a man regularly by the uontr than by t the day. Mr. E.1T.Blaokrnan addressed council in referene to the Dade Cou' ty Fair and sited the benefits that this Fair had b,en to Dade County,end requested a don- ation of 4300 as council had hereto"'ore done. Stating th t owing to the death of two of its r: embers who were good contributors, tee Asso tint ion thoug} t et f :rat that they w)uld be able to get along without the assistance of council, but they now found that to open the fair they would have to havethe sane annual donation. Lawyer Seymour addressed council asking that the bond of Capt. Mr. Mooc•e bridge tender at the 12th. St. bridge addressed council stating that as it was he hacT no authority and was imposed upon by the public in g ttng on bridge while it was being turned, end he was helpless and requested that coun sil.give him police power or have a policeman stationed down there to keep them off. as it was causing the bridge to be damaged considerably,affeeting the balancing. B.Sutton addressed council verifying 7r. Moores statement.end insisted th t Mr. Moore be given police power. Councilman Conrad also vouched for Mr. ''ubre's statement, and spoke very favorably of M. . Moore seyng that he was a man that was aways at his place and attended trietly to his dutles,and furthermore he was receiving less money forms services than any mrn canneeted wit- the Citys wok:. And asked that Mr. Moore's salary be raised to 075.00 per rnonth,as he was a goad conscientious man and was worth it to the city . Moore all he could in maintaining order on the br1d"i. Mr. Cassidey addressed council in reference to lighting certain streets. The chairman announced that the oil ordinance was now up for its third and fine]. reading. After a long discussion both by council end the city attorney, as to the legality of the ordinance receiving its .first and second reading at a recess meeting, th. attorney stated that in his opinion that it would not be con- sidered a legal proceeding, and that his advice would be to have the farmer read- ings resended And that by the unanimous convent c' oouncil,and that we trap- the ordinance up at a regular meeting. By unanimous consent of the council the first and second reeding of the ordnance in regard to the storing of oil, gasoline and gas was wthdrawn. end t'Ze following was introduced by concilmen Lunmus. McDonesld, that the ordinance elating to the storage on oil, gasoline,etc. and the rem;val of the tanks fromthe Sout side of the 1iami river, be givenits first reading and read in full.Motiun carried. I earnestly esommend that See. 177 of the Code of the City of '4iami be so amended as to require that every tenantable house ke provided with a privy and that all prives be so constructed as to keep rsinwator and flies ob out of the bucket, on aeeount of the recent rains it has added a great expense to the seavanger work that the department will take more not1ne of vthen the work is paid for under the proposed plan, I also insist that all garbage barrel cans, boxes or reeept as].es of any kind be covered to exclude rain and flies and that an ordinance to that effect be prepared.
