The following communication was read: Miami, Fla. Dece ber 11,9 Honorable City Council, Gentlemen: I want to erect a pergola adjoining Hotel Halcyon Southwest o corner en 12th. Carried. The following communication from the Mayor was read: The Honorable, The City Council of the City of Miami,Florida. Gentlemen: Referring to my communication of the 3rd. inst. regarding the enforcement of section 190 of the City Code, I am under the impression that it will require thepassage of an ordinanee designating the sides of any street in the c$ as a stand for vehicles forDire, end an equal authority to impose an obligation on the drivers of such vehicles, to keep their conveyances at such stand during deaignai ed hours men not actually engaged in carrying and diachargingpaasengers or freight in their regular course of business. I would respectfully recommend that the matter be referred to your committeeman on streets and sewers, and by that committeeman to the City attorney for the prepa-ation of an ordinance covering the above paints, and if the suggetion that the use of Court Street meets with approval, that the east and west sides of that street be deaignated as such stand, under such rules and regulations as may be impoad by your Honorable body, or the commttee on street and sewer under authority to be granted him in such ordinance. The committee appointed to nvestigate the duties of the various a !ficers and to sake a recommendation in regards to the salary to be paid then, reported as follows: The preidsnt and :Meabereolf tkbeCity Council, Gentlemen: We, the undersigned, your committee, to whoa was referred the investigation of salaries of city employees, begto reort as,fellows: We will recommend that the City Attorney receive a salary of $60 per month. Moved by E.F.Molaee and seconded by C. Hefty that City Attorneys salary be fixed at $40 per month. Motion Carried. Section 2. We also recoaaend that the Supt. of Streets be paid a saery of $125 amonth until he is relieved of the sewerage system, Moved by J.A.Conrad and seconded by E.F.Holaes that Section 2 of committee reort be accepted. and the present ea ary of $125 a month be paid Supt. of Streets intil he is relived of the sewerage system. Motion carried. Section 3. The City Engineer shall receive a salary of $90 per month, he devoting his entire time and attention to the need of the City and to work in conjunction wit h the Supt. of Streets. He shall maintain regular efficehoure where homey be found. to inepevt all ewer sonneoiune, and issue permits ete. and such other duties as council may direct. Mood by M.J.McDonald and seconded by E.F.Holmee that the City Engineer shall receive th salary of $90 per month, and the City Attorney be instructed to draw up an erd inanee defining his duties. Motion serried. Section 4. The City Auditor shall receive the sum of $7% per month for hie services. Moved by J.A.Conrad and seconded by Caspar Hefty that.recoaaendation of the Com- mittee be adopted and the City Auditor be paid 375 per month. Motion carried. Section 5. The CityPhysician shall receive the sun of $10 per month as oity physician and $90 per month as Supt. of City Hoapital. Moved by C.Hefty Nod seconded ey F. .Holmes that the City Physician and City Supt. of Hospital be retained at his present salary and that the City attorney be instructed.to draft an ordinance outlining the management of the City Hospital and the duties of the City Physician, and the duties of the Supt. of the hospital. Section 6. The committee would :ecoamend th t the city would dispense with the services of cemetery superintend, and tht a eextion be appointed, and that an inex- pensive dwelling be erected at the cemetery for his occupancy, and that all r eords pertaining to the cemetery be kept by said sexton, that all permits for burials and and for lots an d graves be issued by said station, he to muke a monthly reort of ell resoipts of disbursements to the City council. We would also recommend that no lots or graves be sold for speculative purposes. Moved by M.J.McDonald and seconded by C.'efty th,t an ordinance be drawn abolshing the office of Supt. of cemetery and that ar eezton 'be appointed to aseu me the duties. Motion carried. Section 7. The Sanita y Inapestor we recommend to be planed en a stated salary of $100 per month. We find that by.ths present system that this position is paying the Inepester about $350 per month. We would suggest that the inspector be placed under bond for $1000 and that he make all olleotisna, and report same to the ouncil- Moved by C.Hefty and seconded by E.F.Holnee that Becton 7 be referred to the City Attorney to draw up a suitable ordinance regulating the duties of the sanitary Inspec- tor and the management of his department. Motion carried. 439 The report of the above committee was road and sated upon in sections. Said reportwas signed by Caspar Hefty, M.J.McDonald, and C.W.H111, committee. Moved by J.E.Lumolus and seconded by J.A.Conrad that the present salary of ordinance be conformed so as to cover the vrious duties, and salary of the officers elected. Moved by M.J.McDoneld and seconded by J.A.Conrad that the salary of Chief of the Fire Department be fixed at a salary of $100 per month, and es Supt. of the Alarm system an additional salary of $25 per month. Moved by J.A.Conrad and seconded by J.E.Lummus that the communication of tb Mayor be received and filed, and his appointments be confirmed, with theexception ofa cemetery superintendent, and action be postponed on his position to some fut re date. Application for cemetery ssxtion was referred to some future date. The Chair announoed that the election of City Attorney was now in order.M.J.li Donald nominated G.A.Worley, E.F.Holmes nominated R.R.Taylor., C.Hefty nominated J.L. Billingsley. Moved by MoD nald and seoonded by Holmes that the nominations be closed. Carried. The vote was then taken by ballot and resulted as follows: G.A.Worley, 2, J.L Billingsley 3, R.R.Taylor 2. As no candidate was sleeted, the chair ordered a second ballot which resulted as follows; G.A.Worley 1, J.I,.Billingaley S, and R.R.Taylor 1. The Chairman thereupon deelared J.L.Billingsley elected City Attorney untilll his successor is appointed. Mr. Billingsley bang present , accepted the position in a few very approp- riate remarks. The chair now declared that as they had about finished with the routine business, the council was now ready to discuss the north end annexation proposition. Mr. Edwin Nelsen addressed Council in reference to the above petition, stating the many advantages the purchase of this *emit of land would be to the oity,both as a park and for commercial purposes. Mr. Nelson was followed by T.V.Moore who addressed council strenuously opposing the proposition of purchasing the tract f land. Mr. Huffetettler supported Mr. Moores argument. Close strongly urged the annexation proposition. but opposed the purchasing of the 35 acre tract. After a long discussion by others present, the following motion was made: Moved by .E.Lu.mua and seconded by J.A.Conrad that the petit en offered by the citizens committee b accepted and filed for future consideration. • Mr. E.A.Waddell addressed council u!•g ing the support of City Council in help ing to keep the present Second Regimental Band ineervice by making a don- ation of $100 per month towards their maintainenoe. Capt. G.D.Brossier followed Mr. Waddell in a strong argument for the Band,giv ing its history and noting with pride its efficiency in the high merit by which it isheld by the State officers of the military department The chair advised that said matter mild be considered and taken up later. Thesrdinan oe regulating traffic introduced by J.A.Conrad, was taken up and acted upon in sections. Moved by J.E.Lummus and seconded by J.A.Conrad that Section 1 be passed as read. Movedby C.Hefty and seconded by F.F.Holmes that Section 2 be amended se as to read " that provided that bussess, drays handling freighted bagge and delivery wagons shall beallewed to back up to side walks for the time necessary to dispose of er receive freight or passengers, but for no longer time after which said vehicle shall resume the direction in which itwas going". Moved by J.E.Lumaus and seconded by C.W.Hill that aaendmentedded to Section 2 be added as read. Moved by J.E.Lumaus and sseonded by J.A.Conrad that the following amendment to seetien 3 be added; " Provided all vehicles shall be allowed to turn around at all *ntsrseetional etreests. Be itordained by the city council of the sity of Miami: Seotion 1; That from and after the passage of this eidin nos and itep publication as required by law; it shall be unlawful for any person sr persons, fin firm or eerpeation to operate any ve hi ale propelled by power, man or besot upon the public streets and thoroughfares of the sity of Miami, except as hereinsftee preaorid ed. Sestien 2. All automobiles, auto trucks, observation oars and all vehicles using power ae wel as all ha.ks, carriages, wagons, bisysles and all every kind and nature of vehiolee whatevr, operated upon the streets or public thersughfars of the sity of Miami ,Slerida, shall keep toe the right side of the atreetat all times, and shall net be operated at • greater speed during the day time than twelve miles per hour, and during the night time at a gtsater speed than ten miles per hour. The definition of night time in this ordinance shall moan fees the setting of i the sun to the rising of the sun inthemorning of the succeeding day. In the passing of vehicles going in the same dire° ion, the vehicle to pees, shall be allowed to pas en the left side, taking only as mush of . the street as necessary and immediately upon affecting the passage of the vehicle to be passed, shall immediately resume itsposit'en on the right side of the street, where it shall remain at all times while traversing the said streets. And vehicles desiring to stop fer,the purpose of taking en sr discharging passengers or for any purpose whetevr, shall only be allowed to stop headed in the dirsotion in whioh said vehicles are going at the time of stepping and net farther from the outer curb then a distance of seventeen inches. Provided that busses, drays, handling freight and bagga ge, and deliver wagons shall be allowed to back up t, sidewalks ,;ter the time necessary to dispose of or receive freight or passengers, but for.no longer time after which said vehicle shall resume the direction in whieh .t was going. Section 3. That from the intersection of Fourteenth Street and Avenue D. extending no thward along Avenue D to the intersection of Tenth Street, and from D the intersection of the Florida East Coast Railway Company tracks en Twelfth, Street, extending eastward to Avenue B. no vehicle of any kindornature shall be allowed to turn around on said partnef Avenue D. and Twelfth Street. Provided all vehicles shall be allowed to turn arond at all inter- sections o f streets. Section 4 . In turning coroners all vehicles shall keep to the right until the center if tfe street intended to be turned into shall be paced, before said turn shall be made, and in turning corners for the purpose of passing from one street to ansther, the speed limit of all vehicles shall not exceed eight miles per hour, except in cases of extreme necessity. Section 5. It shall be unlawful for any vehicle whatever to atop en the streets and thoroughfares of the city of Miami, in auoh marazeras to vlock orinterfere in any manner with the ordinary traffic in the street. Section fi.All meter vehicles operating on said etreetebetween subset and sunrise shall eery at all times lighteae now prescribed by ordinance, and all vehicles driven by power , including motorcycles shall have, at all times while beingeperated upon said streets, headlights se se to be plainly ♦ixilDie at a distans of one hundred feet, at least. All vehicles driven by motor power shall be fitted with s sounding bell, horn or geng, which shall be sounded at the turning of street corners and the spproashing of obstacles, and When passing vehicles, and notapre than one person ehal ride any motor cycle within the city limits at the same time. Section 7. All vehicles wishing to turn and retrace their 'curse shall always turn from the right to the left, crossing the street et se st o be enththe emiddle right side after the movement is finished. Boston 9. It shall be the duty of the polies department of the city of Miami to strictly enforoo this ordinance et all times, and the duty of the mayor to see thst the duty is performed. Section 10. Any person violating any section of this ordinance, or any part thereof, shall be arrested, and tried before the munioial eourt in the city of Miami, and upon conviction shall be btsmtsksi punished b- a fine not exceeding twenty five dollars ($25.00) tsr the,first offense, or imprisonment not exceeding thirty days, or by both fine and imprisonment, at the discretion of the trial court;and upon the second conviction of the safe person for a like offense, sh shall be punished by not exceeding double the punishment prescribed forthe violation of this ordinance as a first offense; end for a third conviction of the same person, for the violation of this ordinance shall be pubished by fine or imprison- . meat or both, in a sum, er for a term, not to exeeed three times the amount of term prescribed for the violation of this ordinance forth* first offense, pro- vided said conviction occurs during a yearstime.
