Members present J.I.WilsoQ,J.E.Lummue,T.N.Gautier,L.Granger,C.J.Roue and W.A. Moore. Communication: Dear Sir: - Your letter of February,24th,1911,addressed to Mr.Carter,in the matter of petition to City Council for the opening of llth.Street eoroen our tracks and yard at Miami,has been refered to me for reply. It is quite probable that your good people aignpd this petitionxid did not appre- ciate just what would be the consequences of putting;:g crossing *A the traeke at this 1oe tion. You will reoell that the Railway Company's right of way and yards at this loca- tion were purchased before the streets were laid out and plotted. And when it came to laying our the streete,they were so arranged by having the streets parallel the right of way and connect up adjoining etreeta,aa to preserve and protect the right of way end yarde,in such manner as not to destroy or impair their ussfu11ness; and et the name time give access along eaoh side of this right of way and yard epees to the cros- sings put in at the North and South ends of this space.If something of this kind is not done;and a crossing is had nt every block,that would so interfere wits the switch- ing,delay the handling of ears and traAne,etc.,ato prevent us furnishi Cnoilitles or yards at this place: Arid in fact in any other town or city, if the::e corlditione were not recognized and concurred in. It is no different at Miami,tlan in other cities and towns; and the history of legislation and the decision; of our eourte,is that such fa- cilities are to be protected. This is neceseary on the principal that the the us, the Railway Company is making of suoh facilities is a public or quasi -public eervice,o" benefit to the public; and if the yards and facilities are t nos cut into,their very object would be defeated. There is already a crossing at 12th.Street and another one at 7th.Street. There is also a parallel road along the right of way,both on the East and the West side of the right or way and yards,from llth.Street,South to 12th,Street,.Under the conditions seek they exiat,it is certainly not undeas9nable to require the poublic to f011owtthese par- allel streets one block from lith.to 12th.Street,to use the crossing located at 12th. Street; and thus save our yards from being cut into and aacrifieed.,if w are expected to maintain these facilities at Miami. Trusting the City Council will appreciate the situation and will see that tks* our position ie entirely correct and for the best interest of the city. Ibeg to r,main.
