Recess meeting of the City Council called to order by President J.I.Wilson In the
chair.
Members present J.I.Wilibon,J.F.Lund..ue,L.grenger,J.J.Holly,C.J.Rose and W.B.Moore
A communication under date of 'ularch,6th,1911,signed by Mre.C.W.Gardner,attached,
to which was a City License, issued February,llth,1911,for the operating of a Moving
Picture Show ,at the corner of Avenue °G° and First Street; in which it was etaated
that her effort was an entire failure, owing to inability to get the negroe to at-
tend the pefoorrances; and after one weeks trial she was compelled to close the
business down: And in view of the fact ttkFt she could not make use of the license,
hoped that the 2'ity Council would refund per the money paid for the licenee,wae read.
Moved by J.E.Lumaiue and seconded by J.J.Holly that the communication from Mre C.W.
Gardner be received and filed; and that the question of re-imbursement be considered
Rt a later date: Motion carried.

Gentlemen; -
In compliance with a recent ordinance passed by the City Council; I hereby
make application for a permit to operate a Moving Picture Show,in the new building,
suet being completed,loca-,ed on the North 50 feet of lots 23 and 24 of Block 106 N.,
city of Miami.
All requirements pertaining to the operation of a moving; picture theeter,under the
ordinances of the City have been complied with,etand pipe,cmemical fire ettinguish-
erQ and other equipments ere provided: The floor plan of the meeting arrangement is
hereto attached,sawe is self explanatory.

Neq.,be received and filed; and that the Clerk be authorized to leeue him the License
for operating a moving picture theater,on payment of the r+mount as required ny the
City revenue ordinance,after the preriieis has been inspected by the Committeeman on
Fire Protection and found by him to conform to the requirements of the ordinances of
the City pertaining to :such business: Motion carried.

This is to ce.tify that David James has been under my treatment since Dec.St-
1910,having been shot on that date,accidentally,by a ,•ity Police Officer,in the dis-
charge of his duty. He ie now able to work;and I have dismissed him from medical trea-
tment. My fee for medical services is ,30.00;and I will feel very greatful,if you
will assist me in collecting this bill.

owing to hie being accidentally shot by an officer of the police force in the dischar-

edge receipt of same; and tnat the City Engineer had advised the City Council that the

A Resolution by J.J.Holly.
A Resolution of the City Council of the City of. Miami; Refusing to call an elec-
tion for the passage or rejection of an srdinance authorizing motion pict'ire shows on
Sundays.
Be IT RESOLVED by the City Council of the Cit of Miami:
That Whereas,a potion has been presented to Counoil requesting the amendement of
an ordinance,or the submission to the electorate of an ordinanoe,ellowing motion pic-
ture shows on Sunday: And Whereas there are only 182 registered voters on said peti-
tion: And Whereas no ordinance is set -out in said petition,that Council eould pass:
And Whereas Council does not view -the question presented as one effecting the welfare
of the general poblie,or one in which any great portion of the public in interested:
And Whereas,the ordinances of the City prohibit the marrying on of nearly all business-
es on the Sabbith Day: And Whereas,the provisions of the Charter governing the inniti-
etion,have not been strictly complied with: And Whereas it entailer considerable ex-
pense on the part of the tax Payers to call an election; therefore Council declines to
call an election until the law has been strictly complied with.
Adopted this 9th,day of march,A.D.1911.

AN ORDINANCE.
Moved by J.J.Holly and seconded by J.n:.Lummius th't the ordinance be given its
third and final reeding and be read in full: Motion carried.
The ordinance was given its third and final reading and was read in full as fol-
lows:
An ordinance of the City of Miami;preeeribing the powers of the Street Superinten
dant at mad Nity and Chief of Police of said City,with respect to enforcing order and
labor,on the part of prisoners serving sentences in the City Jail of said city.
Be It Ordained by the City Council of the City of Miami:
SECTION :1:
That all necessary means shall be used by the Street Superintendent and
Chief of Police of said oity;and such punishment as shall be needful,ahall be adopted,
to maintain order,enforce obedience and dioipline,suppress insurection,prevent escapes
and compel the performance of labor on the part of prisoners serving sentences in the
City Jailor on the streets of said eity,or other City prisonere,but no cruel or inhu-
mane punishment,iniurious to the mind or body of the prisoner shall be perriitted,nor
shall any prisoner be compelled to labor without food.
SECTION 2:
That this ordinance shall take effect upon s its passage and publication as
required by law.
