in the chair.

the Avenue "D" Sewer so Fps to turn down 14th, Street and empty in the Biscayne
Bay exhibiting a numerously signed petition requesting that sane be done.
The following communication presented the :ouncil by the Mayor.

A Dear Sir; -
We have just been advised that the Empire Trust Company of this City
-as returned to the City of Miami 170,000.00 Bonds, being a part of an issue of
t1C0,000.00 wh1c' we, acting under authority of an odder of the !ward of Public
Works of your City an April 5th, 1907, delivered to the said !rust Company to be
held by it subject to the order of the Board of Public Work:, of your City.
The said $100,000.00 of bonds we understand war. to ;e delivered from time
to time to Edmund Seyrsore and Company of this City, which firr! -ad a contract
with the Fort Dallas National Bank of your City for the purchase of said Bonds.
We learn however Vat only 170,000.00 of the bonds were delivered to `Eeerrs.
Seymore, and toe balance, as abure, were finally returned to yuur City.
All or the above mentioned bonds bear our certificate of venulneress ac of
. March 27tt, 1907, at which time the officers signing the bonds were all in
office and ve bonds were therefore good delivery: Now however,we understand
that certain of said officers have been replaced ry others, and the bonds ere
therefore now nut good delivery, es the officers now in office are nut those ex-
ecuting the bond:; hence, s-ould yuu Nish to deliver tr.e bonds et ttie time, pru
per procoedings should be taker and new bonds prepared beering the names of of-
ficers in office et tht time said bonds are delivered to purchaser..
All of toe above borers bear a statement the legality has been approved by
J.l.Caldwell of t'is City, wnos opinion bnd legal papers are filed with this
Company for the inspection or the ^older.
At the time te bunde were preps:•ed it w s understood t-at tra Me ga. . ey-
more would purchase t^.e bonds fend h ve them sppru ed by "."r.Caldwell, who, as the
Attorney, could only approve euot bonds as were delivered; his opinion would
therefore only apply to toe t70,000.00 taken up by the purc attar, and does not
apply to the 170,000.00 now in the hands of the City: ':herefore,rhoul!1 the City
be able to find a purchaser woos Attorney would be willing to accept bonds bear..
ing the ateteoent with regard to Mr.Caldwells opinion, and this statement should
in such case be in some manner cancelled.
We believe Vat in any case it would be Getter for t - City to have new
bonds prepared and have the :i ned oy tope officers now in office, rather than
to issue is old bonds, and therefore have the question raised as to toe legali)
of its outstanding obligations because of the irre!rzler mode of their issue.
If there is any part of toe fore, oing letter which we oboe not made quite
clear, we would he glad to correspond with you further in :.ef;ard thereto.

this work would say that t-e specifications provide that where no solid rock ie
found, fill to be made to a dept of nine inc•esbelow finish grade line, seven
inches of which is to be filled with broken rock and reiewining two inches with
fine surfacing rock: The Contractor has complied with this rule on all of the
Street that he ear, yet worked except teat in a very few plats I find that he has
.placed the eert s little within this nine inch space, but I will see that.the
aupplus is removed prior to placing the rock fill,

Having made a recent examination of 7th, Street between Avenue "D" and
Boulevard, I ask your Body to withdraw my former cometunicntion approving said
work until such time es some additional work cwn be done on said Street: t'e Con-
tractor at that time assured me that he would fill up the low places in the sur-
face of the street and dress the st,.eet off amoothe, part of this work, oe has
done, but T understand he has not yet had time to make a complete job of it, and
recomend your Body to hold up the acceptance t,nd payment' until he has had an op-
ortunity to doao: There are a number of soft places that have developed in the
Street lately, which should be wet thrrougrcly and rolled or tamped: Tamping is
needed along the entire curb line on each aide: It has been suggested that not
sufficient ruck has been put in between Avenue "D" and the Boulevard, of tale I
have no means of ascertaining and suggest that your Street Superentendent with a
_laborer, could make a few excavations to ascertain if these charges are true,

The C.,ty Council are familiar with wat followed, Mr.Rutter was not satisfied

All of the decrees are couched in the 1rnguage above quoted: A Pester in Chan-
cer. is an officer of the Couc•t, and. the oRgoanewt ,of a,Meeter id discretionary .
with the Court: Under the Final. Decree it s^ ecretior of the Master in Chancery to
publisi his notices in such newspapers as he sees fit, and t•e newspaper can charge,

In the case under consideration the Master could nave given tre printing, had k

right to charge such rate as is. allowed by ntat.te.
You will observe the language of the decree above quoted,- that the City has a
right to purcheoe tne lands sold.at..such sale: In case the City makes such a pur-
chase it then etanda on a per with any other purchaser and must pay the cent in the
cage in order to obtain a deed: A part of thees cost is for t e n•-tice of sale.
The propoaitio,s of law are primary, and it is evident the LaSalle -Stoneman Co,
